I. PURPOSE:
The Review Board will review each accident involving department property to
determine cause and employee negligence. This policy shall include but is not limited to
vehicle crashes. It will also include any department property damaged while in the
custody or control of a department employee. This review process is applicable to all
employees who are in possession of department property at any time.
II. PROCEDURES:
A. Board Members:
In the event of a vehicle crash, the board will consist of the traffic unit
supervisor, the investigating officer or employee selected by the chief or his
designee, and the immediate supervisor of the employee involved. In the event
of any other type of accident or damage to city property, the board will consist
of the immediate supervisor of the involved employee, and two other
employees designated by the chief of police. In the event any of the above-
mentioned supervisors are involved in the accident, that position will be filled
by a designee as directed by the chief of police. All testimony given to the board
will be recorded and maintained.
B. Determination:
Factors to be considered will include but is not limited to employee actions,
driving pattern, employee training, environmental factors, and avoidance
factors.
The board will determine avoidance and causation. In the event the board
determines employee error, the board may recommend assessing a monetary
penalty to reimburse the deductible for insurance repair or replacement to the
city, disciplinary action, remedial training or any combination thereof in

perspective to the negligence. The board’s findings and recommendations will
be forwarded to the chief of police for review.
C. Convene:
The board will convene on the accident review within ten (10) business days
from the date of the accident, unless exigent circumstances exist and are
approved by the chief of police. The board will forward their findings to the
chief within three (3) business days; providing there are no outstanding
exceptions (i.e. test results, witness contacts, final reports, etc.). Upon review of
the Accident Review Board’s Findings, the chief will forward a determination to
the involved employee within ten (10) days.
D. Appeal:
Upon receipt of determination from the chief, the employee has 24 hours to
appeal the findings in accordance with the appeal process, as outlined in the
City Personnel Policy manual or any applicable collective bargaining agreement.
If no appeal is made, the employee shall adhere to the findings of the board and
comply with the chief’s final decision. Failure to comply may result in
disciplinary action in direct proportion to the insubordination act.
