G.O. 19 LONGWOOD POLICE DEPARTMENT GENERAL ORDER NUMBER: GO - 19 SUBJECT: EXTRA - DUTY AND OUTSIDE EMPLOYMENT EFFECTIVE: OCTOBER 1, 1995 REVISED: JANUARY 1, 2022 GENERAL ORDER EXTRA - DUTY AND OUTSIDE EMPLOYMENT GO – 19 PAGE 1 OF 6 I. PURPOSE The Longwood Police Department authorizes members of the department to take part in extra-duty and outside employment. The purpose of this directive is to provide guidelines for the approval, supervision, and assignment of these types of off-duty employment. II. DEFINITIONS A. Outside Employment: Non-enforcement related off-duty employment Employment not requiring enforcement powers as a condition of employment. B. Extra-Duty Employment: Enforcement related off-duty employment. Employment, commonly referred to as a “detail”, requiring enforcement powers as a condition of employment. C. Notification of Outside Employment Form: The form used to describe and seek permission to work a secondary job. The form is used to document the significant aspects of secondary employment including the location, dates, times, and any special considerations of employment, if applicable. The required use of this form does not relieve an employee from the responsibility of reporting any action or activity that should be brought to the immediate attention of a supervisor. III. GUIDELINES FOR ENFORCEMENT RELATED EXTRA-DUTY EMPLOYMENTS A. Authority of the Chief of Police: GENERAL ORDER EXTRA - DUTY AND OUTSIDE EMPLOYMENT GO – 19 PAGE 2 OF 6 1. The chief of police shall be responsible for the initial approval and, if necessary, the revocation of all requests for extra-duty employment from the public. 2. The chief of police may disallow extra-duty employment if it is determined that said employment would not be in the best interests of the Longwood Police Department. 3. The chief of police has the authority to suspend, revoke or terminate an officer’s privilege to take part in extra-duty employment if Longwood Police Department policies and procedures are not being followed. Procedures for suspension are as follows: a. An officer’s responsibility to an enforcement related extra-duty detail includes reporting for work on a timely basis, submitting all Longwood Police Department forms as required, and obeyance of all applicable Longwood Police Department directives. b. An officer failing to fulfill his/her responsibilities in regard to an enforcement related extra-duty detail is subject to: 1 First Occurrence: Oral reprimand to written reprimand 2 Second Occurrence: Suspension from extra-duty detail employment for a period of thirty days. 3 Third Occurrence: Within twelve months of a first offense; an employee is subject to suspension from an extra-duty detail for one year. c. The above process shall not prohibit the chief of police from permanently revoking an employee’s privilege to work an extra- duty detail. d. Officers who sign up for an extra-duty detail cannot cancel from the detail unless they have found a replacement for themselves. Nothing in this directive is intended to prevent an employee from being subject to disciplinary action in regard to a violation of law, policy, or a directive of the Longwood Police Department. f. Full time sworn police personnel are permitted to sign up for one detail opening only, during the first 96 hours of the posting. After the initial 96 hours, sworn personnel may sign up for additional openings on the posted detail. If an opening on a detail is not filled 48 hours prior to the day/time of the detail, any eligible sworn personnel may sign up for the detail. g. In the event the detail is requested on short notice, Longwood personnel will be given the first option to work the detail with considerations to the 96-hour rule. If the detail cannot be filled by Longwood personnel, then Seminole County Sheriff’s Office personnel will be notified of the availability of the detail. B. Responsibility of the Chief of Police: 1. To coordinate extra-duty employment of Longwood Police Department personnel. 2. To review requests for all types of extra-duty employment prior to approval. 3. The chief may disapprove any type of extra duty or outside employment if it is determined the employment would not be in the best interest of the police department. Certain types of extra-duty and outside employment are prohibited; see section VI. 4. To maintain enforcement related extra-duty employment records. 5. To post requests for extra-duty employment 6. To coordinate disciplinary action in direct relation to an employee failing to fulfill his/her responsibilities to an extra-duty detail. 7. To coordinate and clarify any special requirements or considerations of enforcement related employment with the requesting employers. 8. Resolution of enforcement related conflicts. 9. The chief of police may delegate authority to schedule and coordinate extra-duty employment to a designee. GENERAL ORDER EXTRA - DUTY AND OUTSIDE EMPLOYMENT GO – 19 PAGE 4 OF 6 IV. GUIDELINES FOR OUTSIDE EMPLOYMENT A. All personnel must obtain approval to engage in outside employment from the chief of police prior to beginning any outside employment. Personnel will complete and submit a notification of outside employment form through their chain of command. B. The chief of police may disallow outside employment if it is determined the employment would not be in the best interests of the Longwood Police Department. V. CONDITIONS OF EXTRA-DUTY EMPLOYMENT A. Extra-duty employment is a privilege, and it is secondary to duties performed for the Longwood Police Department. B. Personnel participating in extra-duty employment do so pursuant to this general order, other orders that may apply to related employment, and directives regarding standards of conduct. C. Personnel approached in regard to the employment of extra-duty police officers will refer all inquires to the chief of police or his designee. D. Enforcement related hourly compensation rate will be determined by the chief of police. E. Personnel working extra-duty employment are subject to recall to duty by the Longwood Police Department. F. Officers engaged in enforcement related extra-duty employment are responsible for all calls for service, arrests, and appropriate written reports of incidents occurring at the place of employment. To maintain continuous service at the location, on-duty personnel may assist with the completion of arrests. This assistance will be at the discretion of the on-duty supervisor. G. Officers engaged in enforcement related extra-duty employment shall do so in uniform, unless otherwise designated by the chief of police. H. Personnel will not formally or informally endorse or represent any product or service being utilized by the Longwood Police Department, without prior approval from the chief of police. I. All officers engaged in enforcement related extra-duty employment will be required to carry a radio and monitor the primary Longwood Police Department radio channel at all times. GENERAL ORDER EXTRA - DUTY AND OUTSIDE EMPLOYMENT GO – 19 PAGE 5 OF 6 J. Any officer that is on-duty will not be permitted to work extra-duty details during his/her assigned duty shift. Should an emergency situation arise the final decision will be authorized by the chief of police or the chief’s designee. VI. PROHIBITED EXTRA-DUTY AND OUTSIDE EMPLOYMENT A. Employment as a private investigator is prohibited. This includes, but is not limited to the services of legal process, private investigations, and employee background checks, etc. B. All personnel whether sworn or non-sworn, while on restricted/light duty or receiving Workers’ Compensation are prohibited from engaging in any outside employment or extra-duty enforcement related activity. C. Officers who have not successfully completed their field training curriculum are prohibited from engaging in enforcement related extra-duty employment and may not accept free or reduced rent residences. D. Personnel relieved from duty pending an investigation, suspension, or administrative action, are prohibited from engaging in enforcement related extra-duty employment or activities. E. Any type of extra-duty employment is prohibited if it is determined by the chief of police the employment would not be in the best interest of the police department. VII. EQUIPMENT A. Officers may utilize agency equipment, including vehicles, in the performance of enforcement related extra-duty employment. B. Any property of the Longwood Police Department damaged during extra-duty employment, not occurring during an enforcement related action, is the responsibility of the employee for repair, reimbursement or replacement. Any insurance arrangements should be made in advance with the extra-duty employer or be assumed by the employee responsible for the property. C. Any damaged equipment will be immediately reported to a Longwood Police Department supervisor. The officer shall prepare a written report describing the damage and shall forward the report to the chief of police, through the chain of command. An employee may be held accountable for damage to a Longwood Police Department vehicle or other equipment. Any action in regard to holding an employee liable for damage is subject to review by the chief of police. GENERAL ORDER EXTRA - DUTY AND OUTSIDE EMPLOYMENT GO – 19 PAGE 6 OF 6 VIII. EXTRA-DUTY OR OUTSIDE EMPLOYMENT WORK HOURS Personnel may not engage in employment prior to Longwood Police Department duty time, which would adversely affect their physical or mental condition for duty. IX. EXTRA-DUTY EMPLOYMENT AT PREMISES LICENSED FOR SALE AND CONSUMPTION OF ALCOHOLIC BEVERAGES A. Extra-duty employment at locations with on-premises consumption of alcoholic beverages will require a minimum of two officers at all times. B. Officers must wear the prescribed Longwood Police Department uniform. C. Officers will station themselves outside said establishments, although incidental contact inside the establishment is allowed as a result of calls for service. D. This section shall not apply to residential establishments not licensed to sell alcohol. E. Any questions pertaining to the classification of an alcoholic beverage establishment will be resolved by the chief of police. X. RENT FREE RESIDENCES - REDUCED RENT RESIDENCES A. If free or reduced rent is in exchange for security services, or if the security job provides compensation in the form of free utilities or any other consideration, these jobs are considered outside employment. B. A copy of the lease or other documents pertaining to a rent free or reduced rent residence must be submitted with the notification of outside employment form. XI. WORKERS’ COMPENSATION A. Personnel engaged in extra-duty employment are not covered by the provisions of the Workers’ Compensation Plan of the Longwood Police Department, except in the event that the employee is taking actual enforcement action as a police officer. B. Personnel performing extra-duty employment will ensure the extra-duty employer provides workers’ compensation coverage or liability insurance, or will assume individual responsibility as an independent contractor.
