Mayor Maingot c;~ led the meeting to order at 6:08 p.m. Mayor Maingot moved to c;ontin~a.e to observe the rules to insure an orderly conduct of the discussion. and to insure not more than one person is speaking at a time. Seconded by Commissioner Sackett. Motion failed to carry by a two/two/zero voice vote with Mayor Maingot and Commissioner Sackett vofirig aye, Commissioner Holt and Commissioner Bundy voting. nay, and Deputy Mayor Anderson absent. Mr. Roper reminded the Commission that as to Pine and Wilma, it was still in litigation. He stated there was an C~ctobe.r 3rd hearing date. He said he did not have a problem in hearing the plaintiffs in this lawsuit concerning their position in regards to the Pine and Wilma project. They are still waiting to hear from planning, engineering, and other departments with staff comments. He advised they would announce tonight and requesi: a Shade Meeting with the Commission in the near future. He would prefer to lirr~it the amount of feedback atthis time in regards to the Pine and Wilma project. He encouraged free and open discussion in regards to the 13.1 Longwood Hills Road and the Bay Avenue projects. He did put the caveat that there had been some verbal and written threats to add Bay Avenue ~ to the Pine and Wilma litigation. CC 09-18-Oi~/275 Commissioner Bundy moved to suspend the rules and be very circumspect with what they discuss regarding Wilma and Pine and.if at any time the Attorney feels they were getting dangerously close, for him not to hesitate to speak up. Seconded by Commissioner Holt. Deputy Mayor Anderson arrived at this point in the meeting. Mayor Maingot explained to Deputy Mayor Anderson that prior to his arriving, he made a motion to indicate the desire not to suspend the rules in this, instance so to show an orderly conduct. The vote on that motion was two/two. He stated Commissioner Bundy had. just made a motion and he requested Commissioner Bundy to repeat the motion. Commissioner Bundy advised Mr. Roper had. stated they needed to be very circumspect in hearing information from the applicant regarding the Pine and Wilma project since it is involved in litigation. He said, with that caveat, he made a motion to suspend the rules, but be very circumspect with what they said and for the Attorney to not hesitate to caution them. Motion carried by a unanimous voice vote. 2. BUSINESS. A. Discuss an agreement regarding 131 Longwood Hills Road to be voluntarily annexed into the City of Longwood. ter' . Mr. Towers stated they have had apre-application conference with Development Review with regards to this project with feedback. He said, absent of broad spectrum engineering issues, the site plan for this project meets the Longwood Development Code as it currently stands. He advised they made application with the County as a result of withdrawing their application. at the last meeting. He stated it would take approximately three months for them to voluntarily annex into the City. He said they would offer and agree to come back. to the City Commission with the approved or proposed site. plan to Seminole County and agree to include anything the Commission would like in the development order. He said he would like to run this by staff and receive their comments and pre-confer to meet codes as far as Longwood acid Seminole County jointly. He said once they have completed the process at the County, they will start the application process to annex into the City. Mayor Maingot inquired if it was the applicant's intention to meet the LDC in terms of ther~design. Mr. Towers declared they would make sure it does. He said they were proposing one of two architectures. and he briefly spoke with Mr. Drago regarding these.. The first one is a Mediterranean Style of Architecture and the other one is more of a downtown College Park look. ,~~ CC 09-18-06/276 Mr. Drago said either style would. be okay. ~~ Mr. Towers said either design sty e would look nice and meet the price point they are looking for. He inquired what the City would like to see. Commissioner Sackett inquired if the site plans were the same plans sent to Seminole County. Mr. Towers responded in th.e affirmative. Commissioner Sackett inquired if~he held a meeting with the neighbors and if the site plan was reviewed. , Mr. Towers said the first meeting they held with the neighbors was a good meeting, but they did not have a site plan made out at that time. He advised they had a meeting with the homeowners tomorrow at the. CommLUlity Building and the site plan will be reviewed at that time. Commissioner Sackett inquired where this was. in the process with St. Johns and water nuz off. Mr. Towers stated they have had some silt nm off that was not able to be captured in the filtration pond on site and that would be cleaned up. He said they were currently putting in the masonry retaining walls. They have ~ corresponded with the City Administrator regarding the types of walls. He said they would take comments received from the homeowners and include those with the site plaai approval back to the Commission. He said the water runoff engineering and. ~_he planning and zoning should be completed within the next thirty (30) days. Commissioner Sackett inquired ~-hy the applicant didn't originally bring this to the City to work on the development. Mr. Towers said they originally wanted to work with the City, as they do today. He stated the problem ~~as with. the annexation and it would take six (6) months under the City's current Code to continue the process. He advised they .have a .grade and fill permit that the City does not have. Deputy Mayor Anderson stated if'the development meets the Code then they could. proceed. He said he liked the style of architecture being presented. Commissioner Holt said on Long°NOOd Hills Road there was a tree and a block wall in a "U" shape that he did not see on the site plan. Mr. Towers said the oak tree was to the left of the stop sign at the entrance. He said the conceptual site plan was done a few weeks ago and CC 09-13-OtS/277 the wall within the last week. He communicated with Mr. Drago aspects of the wall before finalizing that aspect. ~ Discussion was held regarding the court yard and the sidewalks. Commissioner Holt inquired about existing; wood fence that abuts the private homeowners' property. Mr. Towers advised the wall would be .eight (8) foot in height from finished elevation and above it will be a hedge line. He stated when looking'at it one would see a stone fmished concrete masonry wall, the hedge line above it and ivy growing on the wall below. Commissioner Holt inquired what the look would be .from the north side. Mr. Towers stated the two buildings on the site plan that would face the homeowners would have lirriited~ access and openings. He said the first floor would have two bedroom windows and the second floor would have one opaque bathroom window. He advised'the block wall would cover the first floor windows. Commissioner Holt inquired if the Mediterranean style- would have a file roof. Mr. Towers stated there would be a file roof around the sides and the back ~~ sides facing the tree line and wetlands would have a 1.,000 foot open deck. The fronts will have file roofs. He said the. pedestrian court yard would be an ,attractive feature and they were .also going, to have gas street lighting throughout the complex. Commissioner Bundy said both designs would look nice and he had no preference. He stated he would have more feedback from the residents of Longwood Hills at the meeting tomorrow. He inquired if there could be some articulation added to the -back so it would not be just a solid flat wall. Mr. Towers stated he and Mr. Brobst would work through what. he would like to see from his property regarding the finish of the wall with the , Commission's approval. Mayor Maingot restated the entire stricture design and all necessary Codes established by the City of Longwood would be followed in this . particular project. He discussed the care of the oak tree and stated there should be the same distance in the. back as in the front of the tree or it would deteriorate over time. Commissioner Bundy stated there should be different entrances or articulation so they do not look the same. .,J~ CC 09-18-06%278" Mr. Towers stated they were working. with Winter Park Design on this and there would be distinct diffe;rences. He said if the City was in agreement ~ with them proceeding with the County,, they would issue a letter and sign off and agree. to work with the City's Codes. Deputy Mayor. Anderson said he wished they could have started this earlier. He declared the overall concept was wonderful. . , Mr. Drago recapped That. Nh~. Tow:ers would submit an engineered site plan to be reviewed by City staff. The site plan will be in compliance with the City Code and simultaneously processed through the County. Mr. Towers stated they may ncn veto some minor details, but should be able to work through these. Commissioner Bundy said he did not want this to be like the Hattaway project and' wanted to make sure there were no issues prior to construction starting. Mr. Towers stated with the excepi:ion of water retention, they were in good shape and would be back before tl.le Commission by the middle of next .month. Mr. Drago inquired who would be; issuing the permits. He said he was ~ having trouble following the fime:iine. He said the issue eventually before the Commission would be if_ they would annex the property having met the Cotmty Codes. Mr. Towers said based on. his rnecsting with Mr. Sizemore and Mr. Miller the project met the Code at that tune. He said; unless the Code changes, the project will meet City Code. He declared he would make sure the City's requirements were included in the development order with the County. ~ . B. Discuss the site plan for the property located on Bay Avenue.. Mr. Towers reviewed a smaller version of the site plan submitted to the City previously. He stated the problem they currently have is based upon a change to the Historic Code Book regarding lot splits. He declared there was also a Code that limits one unit per lot. He ,said he was going to discuss condominiums as opposed to single family home ownership. He stated they were .looking for exterior uniformity. He said there was no visual. difference from the street or the site plan of whether it is owned by a Condominium or owned by a Homeowner's Association. He declared there was an administrative code under the Florida Administrative Code that requires a Homeowner's Association or a Condominium Association to maintain any kind of a water retention system. They are proposing to allow this project to be built: in a condominium ownership situation. He CC 09•-18-OE~/279 said the benefit would be that the reserves for all. exterior maintenance would be there and it would always be maintained. Mayor Maingot said he understood that City staff recently gave back the submitted site plan with comments. He stated the site concurs with the application of three units, not six (6). Mr. Towers responded this was prior to'the restriction of lot splits. He declared he went through the tapes and minutes for the Commission meetings and was not aware of the Commission voting on restriction of lot splits. He said this site was able to be built in January of this year and at some. point there was a Code change of the Historic Code Book restricting lot splits. He stated their application for Bay and for Pine was submitted in December 2005. He requested for the Commission to approve a condominilun environment. Secondly, they are at 62% impervious which is 2% over and-would like this to be approved, if not, they will bring it down to 6Q%. He reiterated, when they met with staff in January, this site plan worked. He declared to build something on the three lots as they exist would look terrible. Commissioner Sackett. said he did not see this fitting in with the character of what is currently there. He stated he did not see how this would fit on the lot size. Mr. Towers said the current Code requires six (6) feet. between buildings ~ and they were at ten (10) .feet. Mayor Maingot asked the City Administrator if this was initially a completed application. Mr. Roper stated his recollection was that the first complete site plan application packet was submitted July l Oth and what was discussed in January of 2006 was before the Historic Preservation Board involving concepts and drawings without any type of engineering. Mr. Towers said Mr. Roper was correct on both accounts. However, if an application was to be submitted, the current Code requires meeting with staff prior to any site plan work.'He said they did this and siibrriitted an application to the Historic Preservation Board. He stated staff should have notified them within five (5) days that the application was incomplete. He said they never received any such letter: The site plan could not have been drawn as the question was in regards to common walls. He said they were placed on the agenda and because of the type of question, they were tabled and that was the- last they heard from the City. . 1 Commissioner Holt stated the applicant was trying to do something in the City and trying to work with the property he has'. He said the Codes need y / CC 09-18-06/280 to be met and there may be some tweaking required. He suggested he work something out with staff and come back to the Commission. Mr. Towers stated if they can work on the two issues of a condominium environment and the restrictian of lot splits, he would like to work with staff. He said the third issue; of the Pine/Wilma suit, he did not think they would need to have the October meeting and the Commission would not need the Shade meeting. Commissioner Holt inquired if they should schedule another Work Session. Mr. Drago said the key issue for i:he Commission to consider was whether they would be willing to change the Code to allow more than one unit per lot. Deputy Mayor Anderson said he :had no problem holding a Work Session to discuss these issues, but it should be more than just the Commission and Mr. Towers. He said the people ~>>ithin the Historic District should have input. The Commission concurred: to holding a Work Session. Mr. Drago suggested they discuss this fiu-ther at the regular Commission meeting under their reports. C. Discuss the site plan for the property located on Pine Avenue. Mayor Maingot advised they would need to discontinue the Work Session due to the regular Commission meeting. Commissioner Holt left the meeting at 7:05 p.m. 3.
