CALL MEETING TO ORDER1 ROLL CALL: Chairman Lomax called the meeting to order at 7:10 p.m. The Recording Secretary called the roll. 2. APPROVAL OF MINUTES: The minutes from the November 23, 2004 meeting were presented. Member Tolos would like to make a few corrections on the minutes. He stated that his name was spelled wrong on page 3 and gavel was spelled wrong on page 7. Chairman Bob Lomax asked for a motion to approve the minutes with the two noted acceptions. Mr. McGarry made the motion and Mr.Greenhalgh seconded the mot?ion made by Mr-McGarry. Unanimous voice vote carried the motion with Member Randy Porter, Member Luis Alvarado and Member Les Simmonds absent. 3. ELECTIONS: Elections of Chairman and Vice Chairman. Member McGarry nominated Bob Lomax to continue as the chairman, seconded by Member Tolos unanimous roll call vote carried the motion. Member McGarry nominated Member Tolos, as vice chairman seconded by Member Greenhalgh and carried by a unanimous voice vote with Member Randy Porter, Member Luis Alvarado and Member Les Simmonds absent. Longwood, FI 32750 Code Compliance lnspector Howington reported she cited this property on June 26, 2004 under FL Bldg. Code, Sec. 104.1 .I No Building Permit and FL Bldg. Code, Sec. 105.6 Inspections. She revisited the property on July 03, 2004 the property was not in compliance, Notice of Hearing was served on January 05,2005 by an officer of the Longwood Police Department. The city request that an Administrative fee of $100.00 be imposed and give the respondents 5 days from the date of service of final orders to come into compliance or a fine of $200 a day be imposed for each and everyday of noncornpliance. Code Inspector Howington answered questions from the Board Members Ken Gallimore, Son of the Property Owner of 1002 2"d PL, spoke in reference to this violation. Member Tolos moved to close the public hearing. Seconded by Member McGarry and carried by a unanimous voice vote with Member Randy Porter, Member Luis Alvarado and Member Les Simmonds absent.. Member McGarry moved, based on the evidence and the testimony, to find the respondents guilty of violating FL Bldg. Code, Sec. 104.1 .I No Building Permit and FL Bldg. Code, Sec. 105.6 Inspections. In support of this motion he asked the board find the following facts occurred. The screen porch has been enclosed into living space, desk and steps added, possibly an alc unit and electrical work done with out first obtaining a permit. He further moved to impose an Administrative fee of $100 and to give the respondents 5 days from the date of service of final orders to bring the property into compliance or a fine of $200 a day will be imposed for each and every day of non compliance. The property owner has to obtain a building permit to be in compliance. Seconded by Member Greenhalgh and carried by a unanimous roll call vote with Member Randy Porter, Member Luis Alvarado and Member Les Simmonds absent. CEB MEETINGOlRSIOS B. Church Ave Longwood, FI 32750 Code Compliance lnspector Price reported she cited this property on November 23,2004 under CC, Chap. 22, 22-33 Storage of Boat, RV, and Trailer, CC, Chap. 12, 12-2(2) Trash, Debris, etc. and CC, Chap. 22,22-28 lnoperable Vehicle. She revisited the property on December 09, 2004 and the property was still not in compliance. Notice of Hearing was served on January 4,2005 by an officer of the Longwood Police Department. Notice of Hearing was sent Certified mail to the property owner. The city requests the respondents be found guilty of violating City Code Chap. 22, 22-33 storage of Boat, RV and Trailer, CC, Chap. 12, 12-2(2) Trash, Debris, etc. and CC, Chap. 22,22-28 lnoperable Vehicle. The city request that an Administrative fee of $100.00 be imposed and to give the respondents 10 days from the date of service to come into compliance or a fine of $200 a day be imposed for each and every day of noncompliance. Seconded by Member Greenhalgh and carried by a unanimous voice vote with Member Randy Porter, Member Luis Alvarado and Member Les Simmonds absent. Member Greenhalgh moved, based on the evidence and the testimony, to find the Hauser the property owner guilty of CC, Chap. 22, 22-33 Storage of Boat, RV, and Trailer, CC, Chap. 12, 12-2(2) Trash, Debris, etc. and CC, Chap. 22,22-28 Inoperable Vehicle. In support of this motion he askedthe board find the following facts occurred. There was miscellaneous trash lying all around the yard, furniture, fence sections, auto parts, and tires. There were several inoperable vehicles in the back yard and a trailer in the side yard and one parked in the front of the garage. He further moved to impose an Administrative fee of $100 and to give the respondents till February 15' to bring the property into compliance or a fine of $200 a day will be imposed for each and every day of non compliance. The property has to keep the yard clean and maintained, trash disposed of, trailers and inoperable cars need to be screened or fenced in. Seconded by Member McGarry and carried by a unanimous roll call with Member Randy Porter, Member Luis Alvarado and Member Les Simmonds absent. C. CEB 05-01-429 SCHUTTE 102 Bearss Cir Longwood, FI 32750 -Code Compliance Inspector Howington reported she cited this property on October 25, 2004 under, CC, Chap. 12, 12-2(2) Trash, Debris, etc. and CC, Chap. 22,22-28 lnoperable Vehicle, CC, Chap. 12: 12-2(1) Grass and Weeds over 1 O", CC, Chap. 12.5 Outdoor Storage. Member Andrew McGarry moved, based on the evidence and the testimony, to find the respondent guilty of City Code , CC, Chap. 12, 12-2(2) Trash, Debris, etc. and CC, Chap. 22,22-28 lnoperable Vehicle, CC, Chap. 12, 12-2(1) Grass and Weeds over lo", CC, Chap. 12.5 Outdoor Storage. In support of this motion he asked the Board find the following facts occurred. The grass and weeds exceed 10" in back yard; damaged fencing lying in the ROW at the rear of the property; ladder, ice chest, roll of carpet, post hole diggers, boxes, etc stored on the outside. He further moved to impose an Administrative fee of $1 00 and to give the respondents 10 days from the date of service to bring the property into compliance or a fine of $250 a day will be imposed for each and every day of non compliance. Seconded by Member Tolos and carried by a unanimous roll call with Member Randy Porter, Member Luis Alvarado and Member Les Simmonds absent. D. CEB 05-01-431 HERNANDEZ1 GROETZNER 749 E. Church Ave Longwood, FI 32750 Code Compliance lnspector Price reported she cited this property on November 13,2004 under CC, Chap Chap 22, 22-28 lnoperable Vehicle. She revisited the property on December 09, 2004 the property was not in compliance. Notice of Hearing was sent certified mail to the property owner. Notice of Hearing was served on Catherine Availes by an officer of the LPD. On January 10" Notice of Hearing was sent Certified Mail to the property owner. We received confirmation of the green card back on January 06, 2005. The city requests the respondents be found guilty of violating CC, Chap 22, 22-28 lnoperable Vehicle. Property came into compliance prior to the meeting. The city request that an Administrative fee of S1OO.OO be imposed. Code lnspector Price answered questions from the Board Members. Member Greenhalgh moved based on the evidence and the testimony to find the respondent guilty of violating CC, Chap 22, 22-28 Inoperable Vehicle. In support of this motion he asked the board find the following facts occurred there was a red Mazda parked on the property with flat tires and an expired tag. He further moved an Administrative fee of $1 00.00 be imposed. Seconded by Member McGarry and carried by a unanimous roll call vote with Randy Porter, Member, Luis Alvarado, Member and Les Simmonds, Member absent. E. CEB 05-01-432 HANSON 1224 Hamilton St Longwood, FI 32750 Code Compliance lnspector Price reported she cited this property on October 27, 2004 under CC, Chap. 22, Sec.22-33 Boats, RV, Trailers. She revisited the property on October 30, 2004 m and the property was not in compliance. Notice of Hearing was served January 5, 2005 by an officer of the Longwood Police Department. The city requests the respondents be found guilty of violating CC, Chap. 22, Sec .22-33 Boats, RV, and Trailers. The city recommends that an Administrative fee of $100.00 be imposed. Code lnspector Price answered questions from the Board Members. Toby Hanson, Property Owner of 1224 Hamilton St, spoke in reference to this violation. Member Tolos moved to close the public hearing. Seconded by Member Greenhalgh and carried by a unanimous voice vote with Member Randy Porter, Member Luis Alvarado and Member Les Simmonds absent. Member McGarry moved, based on the evidence and the testimony, to find the respondent guilty of violating CC, Chap. 22, Sec.22-33 Boats, RV, Trailers. In support of this motion he asked the board find the following facts occurred there was an RV parked in the driveway in front of of the house and a camper on the side of the house but not screened. He further moved an Administrative fee of $50.00 be imposed and to give the respondents 5 days from the date of service to bring the property into compliance or a fine of $25 a day for each and everyday of non compliance.
