SecondN by Deputy Mayor Miller and cartied by a
Con er Maingot refarredm Pnge S, roploca it fdand or dmoagedmmurlnl. At
e prey' us Work Sessiors he suggested a time frame be establiahW for the replacement of
dead material Ne passed out photos of a property ne r the Historic District which
showed plain material that had died over 6 weeks ago and had not been replaced.
Presently, there is a requirement to replace dead mmerial but no time tame has been
give t. Hesaid ifthe Gty was going to nlargea tof money into the Hist
Dismct, then he would like to see something put in place to protect the citys investment
Commissioner Maivgot suggested giving the residvnts30 days to mplace most of the
plan material, with the exception ol'a very large t e_ 4te said this does not have to be

Mayor Anderson said sometimes it might not always be the right growing season to
replae meshing right awey_14o believed since the Code stales that it mull be replaced r
then Code Enfroreoment can approacfi the resident at the appropriate time.
Ms Nance asked how the City Commission would like to dellne what should be replnced
and if they wanted to include requirements to replace only required malerizl or to include
everything mclie se bushes She suggested the replacement be limited to what
required by the Codo end then to seta 30 to 45 Oay time frame to replace dead plant as
materiel and that it irqu¢e plane manorial that is not cold sensitive.
Deputy Mayor Miller said the only reawn he would be against sating a time Game was
es Florida expen ces hmd free and replacingalargn amount ofplanting
materiel can impose a linancixl hnrdship on somo residents or busivess owners
Con er Mningot snid 99.9%of plant materials used by landscapers in Central
Florida ante cold hardy-
Ms. Nance said the Codo mould state, A]!p(ams dnt are plnnted /osna~rfy the Mij/rarsd

`Replace rnSdand rn drmraRUdPlnrrv rnatarlnlsrhar era re9nirad by Code eholl be

Mvynr Nrderson explained his approach to the Coda Ho believed people who live vnd
opetatedteir businesses in tho Dietiiu did cat purchase thou property with these
regnilati in plzce and noted that sire Commission is zskingthem to adopt ndditionel
regplatlona in order to move the Diatriot ivaourain d'nemiov. He stated that he does not
impose on the residents mrd thati[takea away theusc ofiheir property. He said
he doe t the w Code to bee me burden e. Mayor Anders said he would
rathor be more concha olive than desuuetive enA would liko ro give the Properly orvrrors
some leeway.
Commissionor Lovastrend said there are too many regriireormns cn the property owners
w_ Ise would likew give peopleelittle more leeway and let them decide how chair
bueiness should look.
Deputy Mayor Miller said a problem he sces is who is going to determine what was
cable and what cable. He believes the Firtoric Distriu nheady is ovu
regulated anU would like roreee~the aty back down a little bit.
Coma uMVingot Bald he wvsnrying oo impos regulations but wants to
sakguard ~hei tot other property ownerx He believ other es hav
citl
imposed similar Codes and it shows. HeFeels that ifthe city door not haventime frame
for ryrlaeemerrt of deed material, Ihen it mould Dome bsok on lire city and hewanted to
voice his concern.
Deputy Mayor Miller said ho has driven through surrounding cities svoh as San[ord avd
Lake Mnry, and he Aoea not think thoseeities are comparable to Lungwood's Historic

Distria. He says the business owners kvow it is to their benefit to keep their properties
matntaived without imposivg further regulations on them.
Cammixsioner I.,ovestrand said when the Master Plan was done for the Historic District
avd sorted there were epproaimntely 30% bumnesses.30% offices, 30% residences. He
said the f livg at the [ was that office ould in and residen ould d~crease-
He asked ifresidence andewmmetcial prop rtms had the same requir menns.
Ms. Nnnce said the mquiremavls were for the ontire Dlshi0.
Com er Maingot they referred to l.lne 6 on page 5 w ninS the type of
rtigati usyste required. He brought to them tinge piece of irriKati tubinK from an
underground system avd said it was good Cor a residential property but not far a
cial property. He said there should be an optiov given as to the type of irrigation
system the property owner may wmtt and suggested a tuned above ground imgation
system.
Ms. Nanoe said the terminology used means that the PVC piping was underground and it
does not mean the properly owner cannot have shrub risers and/or normal irzigation
system. ll means a standard irrigation system.
Commissioner Mnivgot requested rho termivology used there be drevged_
Ms. Nunes said she would change it to read f(b'aurorrraNC infgmlon>ysruv."
Ms. Nnnce refi:rred beck to the issue ofsatting time limits on the replacement ofdead
erinl and asked the Commission if they wanted w keep the language ambiguous or set
time limits.
Mayor Anderson said he would leave it ambiguous and le[ Code Enforcmnent work it out
and thia was the consensus of the Commission
Ms. Nan said e[ the las tivg the Com nsked her to bring back a pia

that ihv poroetrtage should be lowered. Perhaps there should be two diderent percevtages
and rewmmended 42%residential type of use and (iU°/ for wmmercial type of use. Her
ning far those percentages was to give Ilexibility for ({yore parting if ever n
residencewhere to be converted.
Deputy Mayor Miller said he believed the Commission could over regulate (lungs, but
believes a person should be able to use their propery.
Mayor Anderson said he does not like a Distrla where all uses are permitted Ho prefers
single pereemage should be allowed for thcentire District and suggested 6U°/ as long
as the properly owner meets the drainage requir mcnts.
CC 06-09-03/456
Deputy Mayor Miller then asked what if the owner oCBOynton Lawn & Garden
Bquipme,~t wants io pave his Parking IPL Flebelieved that if the percentage were not
rmseA then Ise would nor be able to do so.
Ms. Nan said this particular bus ould be ableto pave his lot because his business
was a storefront and Ihey are al Ioweds80°/ of the impervious coverage.
Mayor Anderson said once more that he world fel comfortable with 60%_
Com er Loveslrand asked what are the impervious requirements for some of the
newer structures within [ho Distn<t.
Ms. Nance said that they are between 50 to 60°/a.
Discussion ensued regarding this maser.
Ms. Nance asked the Commission if they want the Code to say 60% impervious area.
The COn ingreed with this percemage as long es iheather requirements in the
