LF acey, City Administrator M1larvin Rooks, Li ty Rttorney 1. Mayor Hepp called the meeting to order. Invocation followed by Pledge of At te9 fiance. 2. Approval of Minutes 9/26/81 regut ar meeting and 10/9/81 workshop on final adjustment of 1980-1981 budget, Motion by Commissioner Lormann, s conded by Cormni ssi oner Uskert that mi nUtes of 9/28/81 and 10/9/81 be approved as submitted. Motion carried by unanr moos roll call vote. 3. Resolution No. 463 - amending budget for £i scal year 1980-1981. Mr. Rooks read by title only. Mr. Lhacey said that the resolution ora required to make final adjustments n the 19W-1981 budget. Commissioner Grant asked that Mr. Chacey brief the audience on the changes and Mr. CFaceY did so. 4. Motion by Cortni ssi oner Uskert, s conded by Commi er O'Leary that Resolution Np. 463 be adapted. Motion carried by unanimous roll ca lir ~ote. 5. Mr. Richard tJal lsh, Chairman o£ the Codes Enforcement Board addressed the Conmi ssi on and stated that the terms of Mr. B. H. Farrell and Mr. Robert Thomas expired in October and stated that 5 e they desired to s and Fad done a good job, he r ended that they be reappointed. Li ty Administrator's Report: Mr. Chacey asked the Coimni ssi on to approve joi ni n9 other cities in having a study done in Longwood to de teimine ar s of double taxation. Mr. Chacey said the cost of the study would be $2,000.08. Cemmi ssi oner Lormann said that Mayor SFeppard Fad indicated to her that price would be 54,200. Commissioner Lormann said that Palm Beach County was aDPeali ny su and she asked if taxes would be reduced Oendi ny any appeal and Mr. Rooks said he wa not sure but that normally there would not be a reduction r~iFi le any appeal was pen di n9. Simpson reminded the Lomni ssi on that vwhen the County as umed di spate hi n9 duties For Longwood it relieved the City of paying 540,000 in salaries. 9. City Attorney's Report Mr. Marvin Rooks briefed the Lanmi scion on the procedures for condo cti n9 heart n9s on [he Land Use Plan and said that ft must be treated in two parts, the future land se plan and the re ni n9 that goes with it. Mr. Rooks said that the land use plan not be in nsis tent with the zoning map. Lomni ssi oner O'Leary said that a rork- shop was needed and [he Comni ssi on seta workshop to discuss the land use plan for Tuesday, October 2G, 1981 at 3:00 p.m. Mr. Rooks stated that the fine imposed by the Lodes Enforcement Board on Mr. John Ya mall had reached Che maximum fee possible of 55,000.00. Mr. Rooks said that he had been approached by Mr. Ned Julian asked for cam compromise. Mr. Rooks said he would not ask the Cpmmi ssi on or en present such aereq uest until Mr. Yamall na n Fu11 compliance and as ofe0ctober 12, 1981, Yie still was not in ompli antes s Mr. Rooks stated that there w e possible problem with the lien s e Mrs. Varnail w not officially li stedaonothe papers but that he had re archedcthe matter andsread the most recent Attorney General's report and he did not bet ie ve that it wa required. Mr. Rooks said he re omnende0 that the City write Mr. Yamall a letter stati n9 what the fine was and saying that a lien would be Levied if it not paid. Mr. Rooks said the City had a legal basis for the lien, the wife esepresent duri nq ail heart n9s and had recei ptetl fora letter advf si n9 Mr. Va rnali about hearings. Plr. Richard Wall sh said he thought the lien could be placed against the property. Comm ssi oner Uskert said he was in favor of going ahead with lien. Commissioner Grant said he knew that Mr. Yamall had some financial problems. 10. Motion by Lomni ssi oner Uskert, seconded'by Comm ssi oner O`Leary that a lien be placed on the property of John and fl oria Yamall in the amount of $5,000. Motion ried by a vote of 4 to 1 with Comm ssi ~~ers Lornrann, O'Leary, Uskert and Mayor Hepp voting Aye and Loneni ssi oner Grant voti n9 Nay. 11. Mayor and Commissioners' Reports: Comm ssioner Uskert presented a petition wf th 19) na s from residents of Wi nsor Manor protesting the billboard being erected ac ss 434 from their hares. Comm ssi oner Uskert said he had advised Mr. Alexande r,rpers on who contacted him about petition, and said that if the ar s properly zoned and the City had sued a pe nni [, the City could not stopathe boil di nq. Mr. 8iii Mitchell w present and said he did not agree with having any billboards in Longwood. Comm isioner Loimann said the question of having on officer in the County esponsi ble for training fire fighters. Nr. Lhacey sa itle he thought it had been tied ce but that it did not work. Coimni ssi oner Uskert said he raa n favor of a ounty wide training program for the police as well. Mr. Chacey statedr that both fire and police officers are trained at a standard training facility and are certified upon graduation. 1J.
