Hon E+ayor and Town Council

G=}~tl emen:
There has been submitted to cue for my opinion. abstract

as recorded in Plat Book 3, page 60', Fub1i~ Records of
Seminole County, Florida, and copy of the Pls.t of the'plan

It would appearfrom a study of these papers that one F.F?.
Holeman secured a patent from the United States Government!
on August 30,1875 to Lot l,of Section 5,Township 21 South,
Range 3~D East.whic~ includes the lands in the amended platabov:e
mentioned,.the 4ve'st line of which runs througia La.s~e 'Vlildmere.
F.R.Fiolemac~ then .platted this land into the map of ~V'ildmere
on Deoembcr 6; 1877.TY:e original plat of VG:ildmere shows a road
called Oxford Street-around t:1e north and $~t silos of thy'
1'ake.The abstract shoves no cor_veyanc~ out of F.R.Holeman to
:anyone for any lahd lying between the west boumdaries'of the
~~ platted lots on the east side of.Lake ~iid'r~ere and the west
line of Government lot 1 in the middle of the lake,Therefore,
the record title t.c~ so much of tris property as is dot in "" '
Oxford Street still remains in F.R.Holeman or hi.s heirs..
There is no width shown on Oxford Street„nor is there army
showing that there is any land 1_~ing betwae.n Oxford Street! ;
and Lake`wildmere.The shore of Lake ~'ildmere shown ors the ~;
plat is an irregular line and the distance between the shore ~
of La'.~e `a~ildmeffie: acid the west aoundary of the platted lots
varies in distance. It is Fe~uliar for a road to be so dediC,ated
.but there is nothing on the plat to shoVa anything to the con-
teary,
~i
The amemaed plat of k3'ildmere s'hows' the ~sar~e state of ~F
facts in re~;~r~ to the lake and Oxford Street. This amer_ded
plat was recorded by' .1.A.Bistlire ar_d rife and Emma Er_tsmixger
and ~N.S.Entsminger and the Lake Jessup land Company Inco
Horrzver., they'claim no property rights from the west boundary of
the platted lots to the west boundary of goverr_ment lot l,,j,
Oxford street and the lake shore beining delineated on thi4
plat the same as on the orginal plat.
~~i~ BJ .~
There has also. been left ~Jith rye a proposed new p~.at called
~ildmere Heights,This plat shows;Oxford Road as being ~0 fe
in width and $~~e land be~.ween the:- west' boundary of.<Oxford Ro
shore of Lake ~Jildmere. The rpea-e platting of land will not ch
the ownership thereto;,however,it-would serve to v~cate~,such.
of ®xford Road=as may lie outside the 20 foot width shown- in
the proposed n-w plat.
There-has als~a been brought to [ey-attcntinr a motion passe
-~!at -a 'meeting of the Town Council `on December3.,1-9b3 establis
the width of'Oxford Avenue as-20`fcet..'Lt is my opinion this.
motion is not sufficient to vacate any part of Oxford Road.
I bElieve the _formalirties of an o: ~inace would be irecessary
to vacate a gublic roadway. .
'tr -
The Council h~.s the power to approve and adopt the new pia
if it so desires .The result of 'such adoption would not vest
the owncrsYiip in t}ie land lying beti~een .the new proposed
Oxford Road~and Lake ~`ildmere in .any ~erso:n.The title would
remain for the present as it naw exists.The- approval. and
• adoption of the new plat-vJould effectively close-and, vacate
suc~i part of Oxford Road as may 1i=er ~ a=utside the ZO foot
"~ ~'~~' ~:idth of Oxford Road as shown on the new plat. The= approval
and adoption of the new phat is a matter lying wholly wi.~thi
!' the discretion of the To~:~n Council and ~•rayor of Longwood.
Very truly yours, .
