Subject: Proposed Ordinance No. 91-1024
I have requested that the proposed ordinance No. 91-1024 be pl acetl on the
agenda for Monday, August 5, 1991 for your consideration.
TFe purpos of the ord inane is to clarify the e in9 of which items
n be distributed to private r si deuces unless theta ob$ects. Outing
as prev taus election. it was determined that political materials were unlawful
and could not be delivered without the express permission of the owner/occupant.
Our City Attorney has s ce determined that political materials would be consistent
with the other items listed in Section 9-10 of the City Code that may be
distributed wless the owner/occupant requests CFat they not be distributed -
ucM1 as real ars, handbills, political materials, newspapers, maga xines. o
rchandi se. Our present attorney, Becky Vose agrees that the change would r
clarify the code.
Since another election i approaching, I believe CFat the section be amended
to re any confusion as to whether pol'i tical materials can be di strf bated
to residences unless the owner/occupant objects. The City Clerk's office
in to ins a list of owner/occupants who Fave regoested that certain materials
not be distributed to their homes.
