ORDINANCE NO 398
WHEREAS, the City of Longwood, Florida, created a
Zoning Commission by Aesolut ion No. 180; and,
WHEREAS, the city o£ Longwood, Florida, created the
Land Planning Agency by Ordinance No. 394; and,
WHEREAS, the membership of both agencies is the same
and the membership of one comprises the membership o£ the other;
ana,
WHEREAS, it is desirable to consolidate the agencies
under one title and to provide for the tra nsfes of authority
of the Zoning Commvss von to the Land Pla nninq Agency and to
prow ide for the contr nuity of Zoni nq Commrss ion functions;
NOW, THEREFORE, 8E IT ORDAINED BY THE CZ TY COUNCIL OF
THE CITY OF IANGW00-, FLORIDA, AS FOLLOWS.
8£CTZON 1: That Aesolut ion No. 180 of the City of
Longwood, Plor ida, be, and the same rs hereby repealed.
S£CTZON 2: That the present membership of the Zoning
Commrss ron as crea <ed by Resolution No. 180 shall coot roue as
the px esent membership of the Land Planning Agency as created by
Ordinance No. 394 For such terms as they now hold and until their
successors in office axe selected and qualified.
SECTION 3: That upon the expiration of the present
terms o£ the members of the Land Planning Agency or xes igna[ion
by the City Council of the City of Longwood, Florida, Co.r terms
of two (2) years. Further, that the Land Planning Agency,
annually, shall elect a Chairman, Vrce-Chairman, and Secretary
from among its members. The Mayor, City Engineer, City Attox ney,
Drrector of Public Works, Building i sp ctor and Director of
Public Safety shall hereby be deemed advisors to the Land Planning
Agency and shall advise the Land Planning Agency when so requested
by the Land Pl.a nn ing Agency.

Planning Agency by Ordinance No. 394, the Land Planning Agency
sha 11 rev rew all applications for rezoning, all srte plan
applications, all pzopos ed plats under Ordinance No. 23], and
make recommendat cons regarding same rn wr iting with supporting
seasons to the City Council.
All meatings of the Land Planning Agency shall be held
as follows:
(a) Regular meetings of the Land Planning Agency shall
be held on the second and fourth Wednesdays of ea cF month at
]:30 p. m. rn the City Council Room or other designated meeting
place.
(b) The Land Planning Agency shall be authorrz ed <o
cancel any regularly scheduled meeting upon three (3) days
wrrtten notice to each in ted party to matters scheduled to -
be heard at the meeting to be cancelled at the front door of the

(c) The Chairman of the Land Planning Agency shall cal

20 official act cons and shall record the vote on all actro ns. All
21 inures and records shall be Filed in the office of the City
r~ ZZ Clerk and shall be a public record. upon receipt and filing o£
23 mutes and recommendations o£ the Land Planning Agency, the
2q ity Clerk shall forthwith transmit a copy thereof to the Mayor
~y nd each Council member.
36 (g) An Agenda of all meetings of the Land Planning
Agency shall be posted at the front door of the City Hall of

2q the date of the meeting. Matters not on the agenda will not be
30 ons idered at the meeting.
31 SECTION 6: Review of Applications for Change in Doing

regular meeting of the Lana Planning A4ency subsequent Co the
date of the filing of the application with the City Clerk. in
the event the above t>me requirement can not be met, the
application shall be considered at the next subsequent regular
or special meeting.
(b) Notice of i,a nd Planning Agency meetings whereat
an application Eor change in zoning will be considered shall b
given by posting notvice of the meeting upon the subject property
and posting of notvice at tnree (3) public places within the City
o£ Longwood, Florida. Notvices snail be posted for not less than
five (5) working days prior to the date of the meeting and not
more than ten (10) wozki ng days prior to the meeting.
SECTION >: Advisors or Ass vs to nts.
Should the Land Planning Agency feel tna[ it requires
the advise oz assistance f professional zoning personnel with
regard to any matter referred to the Land Planning Agency for
consideration, rt may request that the City Council engage the
required persons to assist and advise the Agency in the perfor-
mance o£ its assigned duties with regard to the mattez referred.
SECTION 8: Appointment of Co;mnrLtees to Assist in
Aes ea rch Work.
Should the Land Planning Agency Eeel that any matter
before it requires investigation by the ~La nd Planning Agency
vtse lf, the Chairman of the Land Planning Agency may appoint a
commvttee to conduct the investigation and make a report to the
Land Planning Agency.

Expenditures.

the authority of the City Council shall be made by vouches
submitted by the Chairman of the Land PLanning Agency to the
City Council and upon approval of the voucher by the City Counci
at a regular meeting.
(b) A report of monthly expenditures shall be
submitted by the Land Planning Agency to the City Council at
the first regular Council meeting following the month for which
Lhe report is submitted or at such tome as the Council ehall
othesw ire set.
ECT ION L0: Submission of Proposals foz Zoning Changes
ox Studies by the Land Planning Agency to the City Council.
The Land Planning Agency may on its own mot aon submit
to the City Council those proposals for zoning changes or zoning
studies as the Land P1.a nning Agency in the execevse o£ its
general or assigned duties deems to be necessary Eor the accom-
pl ishme nt of the purposes for which the Agency was established.
TION 11: 4uorum; report to Council.
(a) A quorum shall consvst of three (3) members o£
the Land Planning Agency present at any regular or spacial
meeting.
(b) A favorable report to the Council on any matter
cons vdered by the Land Planni nq Agency shall require a majority
vote of the members of the Land Planning Agency present and
voting at the Bess von wherein a matter >s voted upon.
SECTION 12: Vacancy.
Any member of the Land Planning Agency who shall muss
three (3) cons ecutvve re9 ular meetings shall cause said posvty
to be vacated and the City Council immediately thezeafter may
appoint a new member to Fvll said vacancy.

TION 13: Ordinance No. 143, as amended and supple-~
me nted, and all other Ordinances of the City of Longwood, Florid ,
heretofore enacted using the term "Zoning Commvs sro n" be, and ih
are hereby amended to read "Land Planning Agency" each and every
place wherein the tezm "Zoning Commission" was used.

this Ordinance proves to be invalid, unlawful, or unrons titut ion
al, vt shall not be held to invalidate or impair the validity,
force or effect of any other sectvon or part o£ this Ordinance,

SECTION 16: This Ordinance shall become effective
vmmed iately upon its final passage and adoption.
