Ms. Bower said they have found some inconsistencies in the Codc,. She stated
they have identified some areas that can only be corrected Ly Code changes. S.he
said they have also identified Somme areas that could use Conunission
determination as far as policy goes and, if staff was interpreting the Code
correctly. She advised one area they did identify in the Historic District Code
Book was the picket fence issue.'She said if it was the Commission's intent to
have. picket fences in the Historic District., they need to change the Code Boolc so
that it is either required or not required. She stated as far as the Historic District
Code Boolc goes, they could tallc'about t)aat issue today, but it really needs to be a
part of loolciilg at all of the City Code and see where they want to go with it.
Ms. Bower said they have the Coinprehe~nsive Plan Work Session. scheduled for
January 12t1i and a :rot of the big questions, especially with t:he Design C7uideboolc
and how they apply it will fall obit i:rom. i:hat Worlc Session. She stated once the
Comprehensive Pl~uz changes were made: to institute the mixed. use firture land use
categories throughout the City, then the ~Juideboolc follows more closely.
Mayor Maingot. said the Commission needs to hear both sides with presentatio~is
so they can be better informed in order to make a more educated decision.

Commissioner Bundy said if staff wants to have input as to what the
Commission's intent was, he was all for that. However, if they were loolciiig at
making any major changes, they just went tluough this aad spent money on it less
than twelve (12) months ago. He said they brought the conununity into this
process and it was not just the Commission's vision, it was the community's
vision.
Commissioner Cortes said he has been asking for this and it was more of an
interpretation issue. He stated it was not his intent to go through the whole thing
and change it. He inquired if the Guidebook was just to guide or was it supposed
to be Code, or both: He said there were some properties in various areas that
became non-conforming and automatically the use was changed to mixed-use so
-the owner can no longer use the property for what. they intendeel.
Commnissioner Bundy said the whole Historic District was mixed-use.
Ms. Powell said the main issue was that it was coirflicting for staff to try and
figure out when they should use the Design Guideboolc or when. it should revert to
the Longwood Development Code. Slle stated it depends on what happens in the
process. She said what Commissioner Cortes was alluding to was a property
owner who did not have a tenant in their building for 1 ~ 0 days.: She stated
according to the Code, once that happens it automatically reverts to the Design
Guidebook. This individual went before the Board of Adjustment for a variance,
then it went before the Commission and they approved what staff presented. S11e
said it was staff's intention to understand when they should apply the Longwood
Development Code or the Design Guidebook when it refers to redevelopment.
She stated there were issues with redevelopment of these buildings. with using the
Design Guidebook. .
Commnssoner Bundy said he was confused because she was talking about the
Longwood Development Code. He stated if it was not within the Historic District,
the Design Standards for the Historic District don't apply.
Ms. Powell said they were not talking about the Historic District. She stated they
were talking about the Design Guideboolc.
Conunissioner Sackett said the Design.Guidebookwas just a guide and-was
talking about new buildings and things like that. He said the Longwood
.Development Code would kick in with any redesign. He stated when they did the
Design Guideboolc they felt as though for someone new eonung in, they would
use it for the suggested best place.
Ms. Bower said it was a Guidebook, but the way it was adopted and the fact that it
is referenced in the Longwood Development Code, and the language in it, staff
reads tlus as requirements and not just guidance.
Ms. Powell referenced an electronic mail sent to the Commission. where on the
second page it states that based on Section 9.1.3 of the Longwood Development

Code, "All new development and redeveaopment within the City must be
consistent wi h the requirements of the Longwood Design Guidebook, including
the Long~~vood Platuiing Districts and use requirement."
Commissioner Bundy said that vas not i:heir intent to approve. He stated he
specifically asked that when putting in for the mixed-use standards, why not set
them all up at that time. He said. they were told no because if someone did not
want to use the iniXed-use .standards or design standards, then it would apply to
the regular Development Code. He stated they could solve it just by changing
that.
Ms. Powell said staff needed some clarixication as to what the Commission
wanted them to do. She used the recent variance regarding a picket fence that was
before the Coirunission and iilgiired if they wanted staff to make that call.
Ms. Bower said their only big issue was what Commissioner Cortes brought up
regarding after a use has gone away for 180 days. She stated if it was Industrial in
the Heritage Village, then should they be applying the Guicieboolc uses or
Industrial uses. .
Commissioner Buricly used the issue of':'he Giimaldi property as an example. He
said the fix for this was to change the language in the adoption ordinance on the
Design Guidebook to say what tla.eir irate;rat was. He said with regards to the matter
of the picket fence, they would always lave issues like that. fIe stated issues with
the Historic District come direct to the (:onunission. He said the intent of the
Historic District Code Boole was a[so the intent of the Cormnunity as they were
also involved. He said the various Villa;;es listed were to apply only if someone
requested it.
Conunissioiler Cortes said he was clear on the Historic District Code Boole. He
stated.from what lZe has read and from bis research, the intent of the Conui~ission
on the Design Guidebook was or:it to serve as a guide on new development or
redevelopment, but the way it was bein€; interpreted and exercised at this time, if
missing 180 days then you have to rede~?elop it under the old mixed-use.
Connnissioner Bundy said there; was a much b eater scope of use and you can mix
residential with retail and office to allow a much moreprofitable utilization of the
same. space. However, in return, if that was what you wanted, you had to follow
the stringent standards set forth. He stated it was an easy fix and they don't have
to spend a lot of time with it.
Ms. Bower said if they were going to go through this Comprehensive Plan Work
Session next month and make some futl~re land use map changes to get the City in
a position where they better understand; they don't need to make changes to the
Design Guidebook at this point if the Comprehensive Plan changes will make all
of those areas mixed-use.

Ms. Powell said staff wanted to bring it to the attention of the Conunission and to
get their intent on the record. She stated they have listened to the audio and read
the minutes, but what was said and the intent is not what was approved. She said
now that they know, they can change the adoption Ordinance and get that in
place. She stated, at the same time, they have to think about whether they want
Longwood to continue to look the way it does, or do they want it to change to
look like the Villages and the Districts. She said they need to think about that as
well.
Conrmzissioner Cortes said with the Heritage Village, they don't have uses for
warehouses and self-storage or industrial facilities that are current businesses
there now. He inquired what was going to be done with theirs when that happens.
Ms. Bower said they would be grandfathered.
Conunissioner Cortes inquired if they lose their Certificate of Occupancy would
they have to change.
Connnnissioner Bundy said they would have to change.
Ms. Bower said that was the problem with only making it optional. She stated she
thought staff got over zealous in unplementing it because they thought this was a
vision and they were trying to move toward implementing that vision.
Commissioner Sackett pointed out that page V of the Design Guidebook states,
"For specific design parameters such as landscape buffer widths, required number
of parking spaces, drive aisle width, etc., refer to Article III of the Longwood
Development Code. Where a conflict arises between the standards of this
Guidebook and a provision of the Longwood. Development Code, the standards of
the Guidebook shall control." He stated it goes on to state, "The Longwood
Design Guidebook provides the ultimate vision and patterning for the different
plaruling districts within the City. It is to be used in conjunction with the
Comprehensive Plan and Longwood Development Code to guide development
according to the principles of new urbanism. and smart growth." He declared that
was what it was all for. He said he did not think the Ordinance was saying what
they want it to say. He stated it also says, "It includes specific materials, styles,
orientation, and other design criteria which, when in conflict, override such
elements in the Longwood Development Code. Interpretation of the application of
regulations, performance standards, criteria, definitions, procedures, or any other
provision of this guidebook shall be the responsibility of the City Adriiinistrator or
liis designee."
Ms. Powell said that was where the issue lies. She stated staff wants to be pro-
business and work with development and redevelopment. She stated they can
continue to make those calls, but she does not feel it is appropriate to make people
pay for a variance when they can fix it here.

Commissioner Sackett said they need to rework the Ordinance because they want
things to be consistent with this vision znd pattern. He stated they spent a lot of
money and time on this and it gives Lo?-~gwood a direction. .
Commssioner Coz-tes said with SunIZail. coming to this area, they need to make
sure fliey are completely clear on this so that when developers start coming, it is
clear of what the intent is.
Mayor `Maingot said when they are looking to the consequences of Amendment
IV; they need to use a lot of forethought: and proactive decision making so ziot to
find themselves boxed in or having to g~~ to referendum to make changes.
Ms. Bower suggested they could make i:ewer land use categories, but make them
more flexible and the way one would ge:t the bonus on either density or intensity
would be if doing something Ynixed-use they would do a higher quality
development. She stated one would still have the optiozz of doing something
lesser, but if wanting more density, then. they would give something in return.
Larry Adams, Partner with ACz, ,9~5 North Pemisylyania Avenue, Winter Parle,
said this was a good healthy idea about ~~larifyuig some of the questions. He stated
this doczmient was meant to be a first step toward the flexibility of getting to
where it needs to go.:EIe said the: idea oi.'this Guidebook was really about a
strategic storybook for the vision. ~Ie stated it was meant to setup how do you
understand and how to move forward if .you change something dramatically. He
said they met with Mr. Girznaldi a year :zgo and had meetings on what 11e wanted
to do. Lie was told that he didn't have to do what was in this book, but t11ey
wanted lum to know more about this. LI~~ stated if there was a firture land use plan
that was going to come into play the idea was to get smarter ideas going.. Also,
everything was based on the economic i:uture for Longwood. He advised
everything about this was about the market being able to not only pay for itself,
but to drive ad valorem in the right direction. He said there were some things they
had hoped they could have pushed a little more flexibility into. He pointed out the
Artisan's District.as another example. L):e stated Longwood has about a third of its
area in pure industrial. LIe said the reason you see other things .listed was that in
other ci ies industrial areas are becoming redeveloped because the land is the least
expensive and they try to encourage lanes that are strategically located to be
redeveloped. They wanted to enco~~rage going up in height, they could add
residential, retail, and mixed-use that would make their property more valuable.
He stated, otherwise, they would contin~ze to have dark areas that: are going to
look like they currently do. LIe declared the design standards were all there for
guide aizd not code.
Ms. Bower said in. Mr. Ginnaldi's case, they tried to work with him so he would
get what he needs and the City would get some of what the vision says. He was
told he could do the granite there, but to do retail in front. She said in those cases
where there has been a lapse, they have been trying to work with the applicant.

Ms. Bower said they have been trying to implement the Design Guidebook for
automobile uses because it is very restrictive as to where those types of uses can
be.
Deputy Mayor Durso said the vast majority of this work was done prior to his
beingelected. He stated he had a good deal of respect for the amount of work that
went into this for the tluee Comrriissioners that worked. on it, ACi, and the people
in the comniuiuty that participated. He affirmed that he wanted to see Longwood
be a more proactive and business friendly enviroiunent. He agreed with
Commissioner Sackett ul that this is a good idea as it gives direction, vision, and a
place to go.
Ms. Bower said she believed in incentive based regulations when it comes to
moving things up.
Mayor Maingot said he agreed .and stated they needed to depend oii the expertise
before them. He said the Corrunissioil was here to facilitate the City moving
forward.
Deputy Mayor Durso said the relationship between the Commission and staff ui
general has improved by means of conununication. He stated if there is a
cbiissterit problem, then the Connnission needs to know. .
Cornmissioner.Bundy said they do want to be proactive, but there was a fine line.
I=Ie stated he was looking forward to staff making recommendations and
presenting reasons for those recoiinnendations. He said the corilments he has been
' hearing from people wlio Have met with staff-have been very positive and he
appreciates that.
Connnissioner Cortes said there were some industrial areas that have been there
for twenty (20) years or more and he did not want to see these people lose what
they had if something. like a natural. disaster occurs.
Ms. Bower said they were looking at the .inconsistencies with the Code and
suggested they could look at the Non-Conforming Use acid Structure Section and
come up with something that protects existing businesses.
Mayor Maingot said they embrace recommendations coming from staff as to how
they can do it better, yet stay within the vision they have created, but at the same
time look forward for future oppoi-tlulities to enhance what they have already
done.
Ms. Bower said where she needed direction was if she were to apply the use
tables to properties where the use has ceased for over 1~0 days. She stated this
was the one item that was rather ambiguous in the Boolc and they leave been
applying to further the vision created in this document. She said that does not
mean they heed to keep applying it that way. She stated the. pros were that you
move forward with implementu7g the vision, the cons are that somebody might

have to look for different uses than what they had previously done. Ville said it was
a grey area within. the Guidebook.
Conunissioner Cortes said this was a guide so if the property owner wanted to
move forward and go with the future, tl:~en they had that option. I3owever, if he
wanted to stay in the realm. of what lie wanted to do, then they were. forcing him
and this is a guide and not something they should be forced to do.
Commissioner Bwidy said when you. st,rrt to talk about a major renovation like
the Girrnaldi property, they could probably rebuild. new for less than what i.t
would cost to renovate. He stated he didn't :leave a problem with changing the 180
days to 12 months. IIe said there needs to be a cut-off point.
Ms. Sower said t11ey m.ay also wa~lt to look at the number that triggers leaving to
bring the site into compliance which was ten (10%) percent of the floor area. She
advised most municipalities do substantial improvement which is foi-ly-nine
(~9%) percent.
Commissioner Cortes inquired if they were going to continue with a property in
the event of damage of fifty (50%) percent or greater becoming rion-conforming.
Commissioner Bundy said they do that with signs. He stated they receive
insurance money or F'EMA money in tb.e case of a natural disaster and. it could be
handled on a case-by-case basis.,
Co~nini:ssioner Sackett inquired if they ].iad a list of some of those businesses
within that. timeframe and are they aware of it so there are no sui~~rises.
Ms. Bower acivise.d they were iii the process of making a list for their o~vn benefit,
but they could reach out~to the property owner arid- let them know.
Comini.ssioner Cortes inquired if the East District woulcl have ai~.y affect with the
Community Redevelopment Agency (CRA).
Deputy Mayor Durso said the goal of t:l-:_e CRA was to create a uniform process,
not necessarily a uniform look. Ike stated it was to streamline the process to
facilitate more growth along Highway ] /-92.
Commi:ssioiler Bundy said the CRA designs are very similar and he saw very :Few
conflicts with the Longwood Development Code.

Commissioner Bundy said he knows they have been working, on Reiter Par1c for
eight years and he blows there is $500;000 iii the. Budget' for it, but they have
issues with the fire trucks and a Conunufer Rail Station to build that the City will
have to pay for the upgrades on. He inquired if they were sure we had the money
~ to consider moving forward at this time.
1VIs. Powell said they have a temporary resolution by bridging the old .fire trucks
online and taking t11e new fire truck offline. She stated they were looking at their
options. She said they don't know when construction will start on the Conunuter
Rail Station. She stated the last meeting she attended as Finance. Director, prior to
her current position, they were looking at abouf $150;000 in upgrades to the
station. She said she understood his concern.
Commissioner Bundy said they don't have the margin for error and $500,000 is a
want to. He stated these. were things they were committed to.
Ms. Powell said the reason they were bringing this to the Conunission now was
because they are getting ready to start construction on Ridge, Oalc, and Talmo.
Mr. Peters has worked with the contractor to move the dirt from those roads to
Reiter Park for $10,000 and do the grading. as well .for the proposed amphitheater.
She stated that in itself was a huge cost savings. She said nothing was saying they
Have to do this entire project now.
Mayor Maingot said what Commissioner Bundy has stated bears a lot of thought.
He stated people were looking forward to some :activity at Reiter Park and he
agreed we did not need to do the whole thing. He said from lus point of view they
do need to be tight in spending, but at the same time try to address this to the
extent that some use can be made of the Park. -

Mr. Peters said they tried to produce a palette. He stated there were basic things
they need to build.before the rest can happen. He said a lot of the areas they have
the capability of building in-house, such as sidewalks. He stated this project
. requires about 12,500 cubic .yards of dirt and 6,500 of it will come from the Oak,
Ridge, and Talmo paving project. The contractor has offered this at $1.50 a yard
and normally this would cost $10 a yard. He aff rmed this was a great
opportunity. He declared the City has a staff of which has a lot of pride in this
coin~nunity, many of whom live in the conlmuiuiy and want'to see something that
makes the conununity stand. He said they discussed earlier how do they attract
businesses and part. of the. whole process here was not just the Park. He stated
there was very little parking on the plans and there was a reason for this. He said
the City has an incredible document on the Historic District and District plans.
The problem is the engineering details are not there such as stonnwater
management and parking. He declared they had some outstanding opportunities in
this area to create community parking that not only helps with the Park, but helps
with the ability to develop at a higher density than what we cure€;ntly have. He

discussed parl~ing standards being used nationwide. He said this was part o:E an
overall program and the way they have :l~eiter Park conceptualized was a village
green and a gathering place for the com~nuiity. He stated they could Bold
coininunity events that bring people into t11e Historic District. He said l1e
appreciates their comments with, regard:. to the cost and other matters the City has
going on. IIe stated Ms. Powell, Manag~~nlent, and staff understand the financial
situation. I-Ie statedthey would lie doing; some things and had some opportunities
where financially theywill be in much better shape.
Mr. Peters said t11e original plan for Reiter Park wa.s what he would call a
traditional neighborhood Park with some active parts and some passive parts. He
stated he has tried to create a Pailc that i~ more relaxing.
Conunissioner Bundy said eve seem to lie eli.ininating all of our active recreation
areas such as the tennis courts, basketball courts, ancL skate park IIe stated the
people were sold on a much more active: concept with an amphitheatre. He
inquired if we had adequate facilities fox those kinds of activities. He said VIr.
Peters mentioned parking and inquired where people were going to park with a
3,000 seat amphitheatre.
Mr. Peters said the one thing the Conunission znay have been misled on the most
was the geotecluzical report. He uffirmed this was an old landfill. He stated the
basketball ants tennis courts were fallint; apat-t because the geology wasn't
appropriate. IIe said they have concrete trails because they have i:he ability to
make it withstand the conditions. The o~ie major structure will have pilings placed
for a solid foundation. Ike stated that he has had a lot of conversations with the
Leisure Services Director, Ms. Fran Meai in regards to other facilities tluoughout
the City and how to address therm. They made a decision to go with a passive
village green concept rather than an active Park next to the Downtown. He said
there was a very huge Church in the coi:amunity that coidd support parlcng and
they could have shuttle bus servic€: for the few large events that would be held. IIe
stated there were options for how to handle parking for lar2;e events.
Conunissioner Bundy said one of the major issues :for the ~-ts and Crafts Festival
was parking and he discussed how this was handled.
Commmissioner Sackett inquired where people aild children. that live on this side of
town were going to play basketball, temis, or handball. He said those have been
available in the twenty-one (21) years h~~ has lived here. Ho inquired why that
can't be there.
1VIr. Peters said at this point they would have to rebuild it with much more
substantial work on the soil iii ordc,r.to slave a facility.
Commissioner Coates said the I Iistoric Downtown District was underutilized
because we don't have anything that brings people to the Downtown other than
the Ai-t l~'estival. He stated SunRail will open that door. I=Ie declared we need to
have something like this that will make people. come to the area and waist to spend

tinge here. L-Ie said walking has become very active for people and the walking
paths will be,something our City has never had, He stated there would Hopefully
be parking on t11e other side of the railroad tracks with SuiiRail that could be
utilized during events.
Ms.. Powell said with the Conunuter Rail and the parking facility we will have
there will encourage people to walk tluough our Downtown to get to Reiter Parlc.
She stated they realize there are parking issues and they need to find an
alternative.
Mr. Peters said oils of the new concepts with parking was shared parking where
you would look.at the area as a whole. He gave the area of the ClZUrch and land. by
the lift station as an example for shared parking. Ike stated they could come up
with standards where there would be less parking on a lot and use the community
parking area. He gave several examples that could be utilized. and various tivays
for communty involvement.
Deputy Mayor Durso discussed parking issues. He said he felt like we were
plamling for right now, but not plamling for what they all hope will happen in the
future.
Mr. Peters said the whole idea was to create a place for people to come and draw
people to the Historic District: He stated twenty five (25) .years of his professional
career 11as been spent in economic development. Ike said they need something to
bring people to this community and they Have to create an environment where
people feel like we want them to develop here. He affirmed part of that. was an
active stonnwater management program, an active transportation program, and
standards to reduce the cost of development..
Ms. Powell said the have been discussilz6 the arlcin~ issues and the need to '

Commissioner Bundy said he was going to be very reluctant to spend a lot of
money on this until they get some resolution to some of the other issues. He stated
parking was an issue and he would like to see a solution prior to building this. He
said another thing was the fact that they needed more active recreation. He stated
the hospital probably would not be averse to partnering with us on some of the
expense as .long as it meets their needs.
Ms. Powell said there were several walks within this and they had talked about
making the one on the outside of the amphitheatre as the fitness walk.
Commissioner Sandy said we cannot forget the kids either. He ,stated there were
no insurmountable problems that he sees with the concept. Iie said before voting
on this he would like answers to some of the questions raised.

Comrriissioner Sackett said in concept it was beautifiil and seems to be personal
and. meet tl~e vision. FIe stated he has die.cussed this since their July meeting and
there lias to be a need for some active play. He said he did ~ZOt notice restroom
facilities. IIe stated the shared parking c,ui be worked out; but tlu"s heeded to be
done up front.
Mayor Maingot said there have bec,n a lot of constructive, continents. He stated
there were a number of organizations th;it are always loolting for a place where
they can put on a performance. He declared there was a definite need. He
suggested, if need be, it could be scaled down to 2,000.
Ms. Powell advised they have the capability of using only portions of it when
needed.
Mr. Peters said the design was for a sidewallc every ten rows anal they could
define the space. He stated the entire sidewallc system was American Disabilities
Act (ADA) compliant. He said they don't want to do what everybody else has
already done. He declared we have an opportunity to have something that is truly
unique. IIe said with SunRail coming here, we can draw people from other
communities without a lot of traffic. He stated if we have the events that bring
people to this area it will support other businesses such as restaurants. IIe said a
commuluty needs to be vibrant and we want people to stop in this commuiuty and
stay in the coimnunity to spend their money.
Mayor Maingot said there have been co;.nments regarding activity. IIe suggested
they could probably do some modifications a,1d iizcoiporate that.
Deputy Mayor Durso said he would like to see us reach out to the Hospital since
they are about to go tluough a huge renovation and determine whether there is a
feasible plan to work out a parking garage, or a joint use facility. He stated if we
have the opportunity to work something out, we'll have parking on the Commuter
Rail side and parking on the Hospital side with the Historic, District in between.
This would provide easy access to the reads and walking access to what we hope
will become a vibrant Historic District.
Mr. Peters said Commissioner Btuidy ~.ade a very.good point about the parking
and he will take a map of the entire area. and show where there are parking
opportunities. He stated it was a st~u-tin~; point and we can limit the.events
according to parking.
Cormni.ssioner Cortes said he woulcL lile~ to see some cost figures of what the City
would be paid for these events aild activities.
Mr. Peters said they were starting to do~,ument actual costs and in the future this
will allow them to be able to estimate b~°ttei• what the cost of aT.i event will be.
