Corey Cohen, Longwood Firefighter, said that recently Mr. Dan McCoy
spoke and gave inspiring words about helping to assist needy families at
Christmas. He stated that he did a lot of inspiration that night because
almost every employee in the City of Longwood by diverse groups has
taken on at least one family. He said the Fire Department was looking for
one family and ended up with three families. He stated City Hall tools the
third family and helped them. Firefighter Cindy Carbonell placed that
fanuly's name in a nationwide contest with hhgregg and won. He advised
hhgregg will be delivering over $3.,5.00 in electronics to this family for
Christmas. He thanked Mr. McCoy for his words and wanted to make sure
the Commission was aware that through the help of Deputy Mayor
Durso's guidance and employees getting together we have helped multiple
families tluoughout Longwood.

givii7g the Commission the ability to waive the fees. He said he didn't see
it in the Ordinance and stated there were times the Conunission waives the
fees.

provision that the City Commission, at its determination, may

Mayor Maingot said he was discussing this with the City Administrator
prior to'the Meeting. He s"fated there were a number of elements in the
Resolution he liad some concern with. He suggested pulling tlus Item from
the Agenda in order to provide a little more time to rethink the Fee
Schedule.
Ms. Powell said she would prefer to get some feedback from the
Commission so that she will k~iow what to bring forward. She stated she
has spoken with Commissioner Cortes, Deputy Mayor Durso, and Mayor
Maingot, but has not talked with Commissioner Bundy or Comniissioiier
Sackett concerting this Item. She said she would share with the
Conunission a discussion she had. earlier today wifh Commissioner Cortes
in regards to the nLUnbers. She distributed information based on the .
financial muinbers on the Coiizmunty Building. She stated it was
imperative to understand that all of the taxpayers in Longwood were
subsidizing this Building for the 106 residents that rented it this past year.
She advised we were currently spending $'10,566 a month in personnel
which is the maintenance of the Building, cleaiung fees, ~iside from the
pass through cost, utilities, repair and maintenance, and operating
supplies. She said we were currently operating at a monthly loss of
$5,79. She stated overall for the year the loss was $70,54 with the
cui~-ent rate structure for the Cozminuiiity Building. Slie affirmed the
General fund was subsidizing this Building. She said the number of
people who rented the Building that was considered "residents" were one-
hundred and six (1.06) and non-residents 19. She said. clearly we laiow
many of these were not residents, but a resident came in and rented the
Building for someone because of the up-charge for non-residents. She
affirmed they looked at our costs and set the daily fate based on our costs.
She stated there was a difference of $539.
Mr. Roper read Resolution No. 0.9-1240 by title only.
1VIs. Powell said they also had discussions regarding an Attendant in lieu
of a Police Officer. The Attendant would watch over and clean the
Building.
Coirunssioner Sackett said this was a major increase on someone from
Longwood. He stated he didn't realize there was that much bloodletting
fiom that Building, but he also understands it is for our residents to use as
much as possible.
Ms. Powell said this was in line with what other cities were charging for
their buildings.

Commssioner Coates inquired what was the origill,~l purpose and
'intention of the Conununity Building when it was built.
Commssioner Bundy said exactly what it was being used for ilow, for the
Cotrununit:y to be able to utilize it to hold events. I~:e stated before the
Community Building they had the Ed Myer Building that was actually a
group of picnic tables that they put a roof over and eventually closed in the
sides. He said it zvas to serve as a focal poinf or center piece for the
Historic District and it has done that. He stated he didn't have a problem
with it not paying for itself. He said it was hunt with non-tax dollars for
the most part.
Commissioner Cortes said the rc>ason lie asked the question was that it was
safe to say the Commission's in-`ent at that time they k~iew it was not
going to be self-sustaining and would be subsidized by the City. He
inquired if this was correct.
Commissioner Bundy responded ul the affirmative and said that was a~i
assumption that was made.
Ms. Powell said with all due respect, she completely understands that.
However, we are in business together and this is our bed and breakj:ast we
are renting out. She asked if we were going to take a $70,000 hit. She
stated she was in favor of cuttin;; the rates for the residents and businesses,
but to not change the rate at all ~NOUId be detrimental..
Corimlussioner Comes said he does Lulderstand, but they did change this
from an Ordinailee to a kesolution. He stated a kesolution gives more
leeway to be able to tweak and ~NOrk oil this. He said there was room to
work on this and suggested it be brought back.
Conmissioner Bundy said he was fully aware that we do need to raise the
rates. He stated at the time they set the differential for residents versus
non-residents it was stated at that time they would :have a problem i.n
enforcing it. He said they would. have the same thing with the fifteen
perce~it (15%) discount. Iqe stated he wasn't necessarily in favor of any
reduction if you can't ei~l=orce it. He said there were two things that
bothered him. One was that a $1.,000 increase to rent it on a Saturday
versus what the old rates were vvas kind of setting them up for a severe
case of sticker shock. He stated if he wanted to rent the Building for
something on Saturday or Sunday, he would have 1:o rent it for eight hours.
He said the next Item was the Catering Services. If they wanted to have an
event, the kitchen would be off limits unless they used a caterer contracted
by the City. ~Ie stated they were going to increase the fees and reduce the
availability. He suggested increasing the security deposit and if things
were damaged they would beheld liable. He said they were going into the
stratosphere from ground zero and they maybe need to take it
incrementally.

Deputy Mayor Durso said he had a lot of the same concerns. He stated if
they want. average citizens to use the. Conununity Building, it was going to
be very difficult to do that. He said he thought they should try and work
these numbers a different way.
Mayor Maingot said a lot of the concerns his colleagues have expressed,
he had expressed this when he met with the City Administrator. He .agreed
they need to have some rate adjustment, but a lot of things need to be
looked at in terms of the differential. He stated there was more homework
to be done on this and suggested it be brought back on January 4~, 2010.
Ms. Powell said staff looked at the history of the rentals and the Building
is used on weekends primarily for weddings and/or receptions which is
why they used the eight hour block of time. She advised the Building was
rented out for the entire year and these fees would not go into effect until
2011.

Ms.,Powell said they needed to address numbers one; two, and three
within this Agenda Item. She inquired if they wanted those accounts not

Acting Chief Hickson advised they receive fourteen percent (14%) of what
they collect.
Ms. Powell inquired if they wanted National Recovery Agency (NRA) to
refer an account for legal proceedings on behalf of the City.

Acting Chief Hickson said that this was normally a clause put in for

Acting Chief Hickson said. with the company working on a commission
rate, they will try to obtain fiill collection prior to offering a discotuzted
rate.
It was the consensus of the Commission that the discounted rate be
approved by the City Administrator.

Mayor Maingot said when loot<:ing at the rate sheet two things come to
mind. One is that the majority of our medical transports historically have
been provided outside o::f the City of Longwood. Therefore, his
recorrunendationwould bethat our current rate structure continues to
apply to medical transport for fhe people within the City of Longwood and
the new rate structure is applie.cl to medical transport outside of the City as
per the Medicare rate.
Ms. Powell said we were not c}urging above the Medicare rate. She stated
this has not been addressed since 2006.

Deputy Mayor Durso said he sees a disturbing trend in that we keep seeing
fee increases. He agreed with everything Mayor Maingot just stated, but
inquired if that put the City in trouble with the Legislature and the Courts
after what just happened with the fees for car accidents in billing people at
different rates.
Commmissioner Cortes reiterated the last time this was raised was in 2006.
He said they were changing this by Resolution now so next year they can
address this automatically based on COLA.
Ms. Powell advised it should be based on the Medicare rate.
Commmissioner Cortes inquired how many of these were being paid by
insurance.
Deputy Mayor Durso left the meeting at 7:58 p.m. and returned at 7:SS
p.m.
Acting Chief Hickson said a lot of their medical transports were from the
assisted living facilities within the City of Longwood which are going to
be paid one hundred percent (100%) by Medicare at this new rate.
However, currently as we are charging them less, Medicare will not pay
their maximum rate if we are charging less.
Commissioner Bundy said we heed to be very cautious when talking about
medical billing or transport rates. If you start setting up different
classifications you run into State and Federal Laws that govern that. He
stated it has been over tluee years since it has been addressed. If we don't
make this increase acid if we set it for the residents, we are setting up two
separate classifications and this would be a logistical nightmare to track
that. He said the Medicare rate was fair and equitable.
Connnissioner Sackett said people were struggling this day and age. He
stated this was the Medicare national number and he did not want to see
separation of whether you were Longwood or not.

Seconded by Corrunissioner Cortes.
Ms. Powell explained that basically in Article 31.2 it talks about what
happens in the case of a layoff reduction in staff. Apparently there have
been discrepancies in how employees are treated with regards to seniority.
She said this Addendum clarifies an employee moving to a lower job
classification will be paid the highest wages for that classification or

current wages, whichever is lov~rest. She explained it provides the
employee an option to go to a lower pay grade. She said wider number
two, they have reduced the ame~urlt of overtime compared to years past
and gave more options to work with the employees. She stated the law
provides i:hat flex-time has to b~~ used within that work week. She said it
has been very difficult to do the-.t and they were giving them this option
with the comp-time, giving them no more than ninety-nine (99) hours of
comp-time ever. She stated this provides for a little more leeway in
scheduling employees so that there are not four employees off in one
department in ogle week,
Deputy Mayor Durso inquired if it was correct to say this means that the
employee will have the option to go down if they tape a different job, or a
lateral move, but they will not be malting more.
Ms. Powell responded in. the afj:rrnlative.
Deputy Mayor. Durso inquired iNhat the previous amount of comp-time
was that people were allowed to accrue.
Mr. Peters said by having coml:i-dine, it, allows taking the time outside of
the normal pay period aild pcovicles another tool to allow the employee to
take time.. He stated the comp=t:{me provides another tool to be able to
worlt with the employee'.
Ms, Powell said the employee clid not cLU-rently receive comp-time.
Conunissioner Cortes inquired :if flex-time was at time and a Kali.
Mr. Peters said flex-time was h~nu for hour and comp-tune was time and a
• half. He stated 11e would use flex-time whenever possible.
Conuuissioner Bundy said he understands the flexibility, but what was
going to happen when the employee is coaxed out with their comp-time.
• He stated when the City used it in the past, they were forced to come in
and buy it back. Ike expressed concer7ls about the af~plication and logistics
of t1us.
Mr. Peters said according to the: Persomzel Handbook for rai~lt and :file
employees we currently allow np to two hundred forty (240) hours of
comp-time. He stated ninety-nine (99) hours was consdc;rably less. He
said they try to control the over~ime, flex-time, and now the comp-time.
He stated they were getting ready to go into union negotiations this
coming year. He said they were looking for ways to better utilize f7.ex-
time, comp-time, and overtone.

Commissioner Bundy said the. two hundred .forty (240) hours was vacation
time which is a totally different concept. IIe stated comp-time was in lieu
of overtime pay and vahied at the overtime pay.
1VIs. Powell. said that was. correct. and every contract the City has was
different.
Commissioner Sackett said these. employees were hourly employees. He
stated they had to be paid or flexed for the number of hours worked within
that week. He said he wasn't sure what they were talking about with
comp-time ~as they could not legally comp-time for hourly employees. .
Mr. Roper advised according to the Collective Bargaining Agreement you
can if they are a member of that uiuon.
Commissioner Sackett inquired since switching to this method of flex-
time, how much has been deci:eased in overtime. pay.
Mr. Peters said the entire Budget this year reduced the overtime in half.
He stated up until just a few weeks ago they have not used any overtime
because they have been flexing.
Commissioner Sackett said it seems like. the flex-time was working and it
did not seem like comp-time was necessary.
Ms. Powell said it was unless they have a Saturday event and the
employee was going. to work six hours over,. they would not be able to flex
that time. It would be paid as overtime or could be comp-time.
Deputy Mayor Durso inquired if we had any options with altering the flex-
time policies.
Ms. Powell advised that was the Labor Laws.
Commissioner Cortes said it was up to the Department Head as to whether
the time is taken as flex-time or comp-time. He inquired how they can be
assured this will be used effectively to help and not ineffectively to hinder
budgetary issues.
Mr. Peters said he was stringent and lus goal was cost containment. He
stated his employees understand that. He said they track overtime use and
there are many weeks they went with zero hours of overtime. In the past,
there were times where they had fifteen to twenty (15~to 2Q) hours in a
week.
Conunissioner Bundy said we were two and a half months into a twelve
.month Budget period. He inquired where they were in regards to the
average percentage in the utilization of overtime.

Mr. Peters advised they were below.
Conn~ussioner Bu~.idy said the major usage seems to be in emergency
situations and stated he did not have a problem with payi~lg overtime for
those situations. He said if someone was scheduled for an event on Friday,
Saturday, or Sunday, it would behoove whoever was in charge of the event
to make sure they do the flex-tir~ze ahead o:I~ time.
Mr. Peters said he and Ms. Meli both have people involved in this Union.
He stated w11en Ms. Meli had people working Babe P~uth Baseball on the
weekend, she hacl people flexing; on Monday and Tuesday of that week so
they would have the hours to work that weekend. He affv-med they have
been doing exactly what Conuliissioner Bundy was talking about. He
explained the problem and :part of the reason for the comp-time was if
something happens that is unplanned, it gives them the ability to do
something besides paying overtime.
Connnissioner Bundy said we urere below the Budget predictions for
overtime now and asking to fix something that was not. broken. He stated
comp-time was overtime anyway, they wottld be paying i.t at a future date
and at a higher rate. He said the City has been bitl:en by comp-time in the
past and audits forced the~City to pay it off. He stated they were doing a.
good job with the flex plan and :it seems to be accomplishing what was set
out to do in reducing the need for overtime.
Mr. Peters said one ofhis goals was to have sixty percent (60%) old
overtime left when hurricane se;zson starts.
Connnissioner Bundy said he understands that,. but said in the event of a
hurricane additional overtime would be authorized. He stated the reserves
were for those types of situations.

utilizing the flex-time situation was the exception rather than the rule. He
said his reconunendation would be to stay with the. flex-time and not go
into the comp-time..He stated with regards to the Addendum to Article
31.2, it would appear that there is a consensus oii that. He said in ills way
of tliii~lciig, if a person was at mid-range in a higher job classification. and
they were moving to a lower job classification, they should tnovc> to the
mid-range of the lower classification and not at the highest range.
Deputy Mayor Durso said lie made the motion and it see~.ns what staff was
trying to do with section two was to figure out a way to increase flexibility
for Department Heads to try anti work out. He stated if it would be the
pleasure of the Cormni lion, sir.~ce it seems that :number two has some
problems with questions regarding flex-time hours, in order to not kill it

and allow staff to work with it and present a new option he will amend his
motion.
Deputy Mayor Durso amended his motion to move discussion

come back with a more suitable option for flexibility. Seconded by

Deputy Mayor Durso said that during the process he had raised a few
concerns both an the record and with the City Administrator with the way
the scoring was completed. He stated there~was some misconununication
with regards to the forms. He said his vote has not been counted correctly.
He advised that he had no intention of changing the order in which he
publically said he was ranking the firms. He would appreciate the
opporhinity to recast his scores. He explained his reason was after making
a public records request and receiving the tallied forms, the numbers were
not what he was originally presented and inverted his intended result. PIe
stated he was not looking to redo the process. He said he believed this was
an honest mistake, but he would like the opporhulity to recast his vote. He
reiterated he had no intention of changing the publicly declared order in
which he ranked the fines.
Mr. Roper inquired if Deputy Mayor Durso had checked ~uiy of the other
calculations.
Deputy Mayor Durso advised all of the other calculations came back
correct. He said the scratched through numbers were numbers he saw only
after making the public records request. '
Ms. Powell advised that basically what happened was under the fee
proposal line, when staff started calculating thesis, she did not take into
consideration that Deputy Mayor Durso had two of the same numbers
under the fee proposal and you can only have one tluough five there. Two
firms cannot have the same number. She stated Deputy Mayor Durso's
sheet was the first to be calculated and she crossed out where those
numbers had been calculated out, as well as the total based on those
numbers. She stated this was where they went back and gave everyone
their forms to look at again and recalculate. She said Deputy Mayor
Durso saw his numbers before they were crossed out and that was what he
based his ranking on.
Deputy Mayor Durso said he was more concenzed with lus vote being
counted and recorded correctly and requested he be allowed to recast his
fonn.

Mr. Roper said at the very least :it should be clarified as to what the
numbers accurately are. Isle stated he did not see any contraindication to
re-tallying the vote and having done correctly.
Mayor Maingot asked Mr. Roper how lie would propose they address this.
Mr. Roper said a recount would be in order and appropriate whether they
take a break tonight or do it later.. .
Ms. Powell advised all other calculations were correct. the said Deputy
Mayor Durso was tinder the impression where his numbers were crossed
out that it was somethin ;that it wasn't.
Deputy Mayor Durso said it was an incorrect interpretation of his vote and
asked for the Co~runission to take this into consideration and allow him to
redo lus vote. He reiterated that he was not asking to tamper with the final
rai~lcing.
Ms. Powell advised this would depend on the numbers Deputy Mayor
Durso presents. If he.presents members that change the average score then
that could change the final ranking as it is an accumulative total.
Commissioner Bundy said the decision was based on the rankings. He
stated if the numbers change, th;.s puts them in.a dilerruna. He said he
waists everybody's vote to be accurately reelected.
Mayor Maingot said they have been tluough the process and even though
lus first preference did not rome. out that way, it was a matter of the
balance of the Conunission.
Deputy Mayor Durso saicl there were errors on his foi7n and he was much.
more concerned with doing it ri~;lit and leis vote was severely mis-
represented on t11is fon~~i. He staled if the concern was that it was going to
change the outcome, then he would. ask that lle be allov~~ed to submit the
form and see if that actually occurs. He reiterated h.e was more concerned
with leis vote being counted correctly.. .
Mayor lYIaingot asked the City f~ttorney if :it was in order to do it this ~vay
and hear the consensus of the re.~t of the Commission.
Mr. Roper said l1e did not see arty legal contraindication to that being
done. He reiterated at the very least there needs to be a clarification as to
what Deputy Mayor Durso meaJit for lus vote to be because there were
• clearly errors on the forn2 that «~ere crossed out with new numbers put
clown. He has explained on the record that the slumbers were inadvertently
inverted.

evaluation foam with numbers he wanted reflected. She advised the final

Ms. Powell said she had received some .goals from. the Commissioners and
said this was a good grotuidwork. She stated she would read what she has
received thus far that inchides: Reiter Park, Relationship with the Business
. Community, aggressive Economic Development, Annexations, Citywide
sewer, reduced expenditures in anticipation of reduced revenues, Land
Development Code changes or amendments, and Corrunuter Rail.
Deputy Mayor Durso said he would like to become clot only more active
with business owners within the City, but business owners throughout our
area tluough cooperative efforts with the Chamber of Co~mnerce. He
stated one of those efforts was the Commuiuty Redevelopment Agency
(CRA). He said he was a true believer in the CRA, whether it is the
Seminole County CRA or a CRA we create. He stated it provides us with
an additional economic tool and the. ability to partner' cooperatively with
our sister Cities and the County. He said it was incumbent. upon us to go
get those businesses trying.to expand.
Commissioner Bundy said they also needed to come up with a way of
measuring these goals. He stated one of the items he had goes along with
fostering a better relationship with our business commututy. He suggested
doing links to our businesses that have websites, even if we charge an
annual fee.
Ms. Powell said we can provide links to the. utility companies or to people
that provide services, but to her lc~lowledge we .cannot promote businesses.
Commissioner Bundy said he has looked for statutes that prohibit that and
he has not been able to come u~ with anything. He stated all we would be
doing was to provide an alphabetical list to the people who have a
business license within the City. He stated it would be easy to set it up if
they paid a fee to click on that businesses name to link to their website to
obtain more information on that company.

Ms. Powell inquired how we would solicit that information.
Commissioner Bundy said at thy, time they obtain their business license
111ey would be asked if t17.ey would like to be linked to the City's website
i:or an aru~ual fee. He stated he felt this needed to be explored.. I-Ie said if
there was a statutory prohibition, provide that information.
Commissioner Cortes said this could easily be done and it would be
optional.
Conunissioner Bundy said we needed to come up with a more effective
means of cojsununicating ~~vith our residents. He stated Deputy Mayor
Durso had touched on this sonic-time ago, but we needed a true marketing
plan for the City. H€ stated there were a loi: of partnerships we could do to
come up with a marketing plan to get our message out.
Commissioner Sackett said his. priority would be cost control, Commuter
Rail, and more positive ways with businesses. I-Ie stated it was the
Conunission's job to do the verbiage for the goals and~the City
Administrator would write the objectives.

around seeing the list of goals and objectives so that they can Have a tool

Conunissioner Comes said sonic; of these goals were long-term, but they
would like to be informed of the; progress.
. Mayor Maingot said his first goal was to reduce E~~penditures. He
reviewed lus written goals he provided to the City Administrator. IIe
stated the goals need to lie brok~,n down into long and short-term goals.
Conunissioner Sackett suggested the City Administrator cra:Ft a document
to show the goals with long-term and short-term objectives. >=-Ie said it
would then be the Coiml~.ission's responsibility to say how these would be
measurable.

couple of letters she received from people recognizing the Police Deparhnent and

recognizing the Building Official, Bob Pike for a positive working experience.

aniiouncemeirt that Commuter Rail did pass. He said their effoi`ts and the efforts
of the. Chamber of Commerce were not in vain. He affirined'this was probably the
single most important piece of legislation for Central Florida since Disney. He
inquired if the City has had any contact with the Florida Department of
Transportation (FOOT) regarding their contract.
Ms. Powel-1 advised that FOOT will not be contacting the City until January to
discuss any of the acquisition.
Con~il~issioner Bundy said it was his Lulderstandingthe City was also looking at
properties to replace Public Works. I-Ie stated to have as many options as possible
and'have the pros and eons fairly and equitably evaluated.
~nsi~~°ec~ Commissioner Sackett said they did announce the passing of Mrs.
Nadine Tolos and stated it was a very nice ceremony held for hex and she would
be missed. He thanked Mayor Maingot for the Christmas Caroling and having the
older population enjoy that music.

Longwood Carolers and said this was their l Otl' anniversary. He reported a
Proclamation was read in honor of Mrs. Nadine fiolos at her burial. He said with
regards to Commmuter Rail, he introduced the City Administrator to Ms. Noreen
Down and s11e indicated that they would be moving ahead in January with the
acquisition of our property.
~istrneg Deputy Mayor Durso said he would echo the sentiments of the
previous Commissioners. He.statedthe Longwood Caroling was an interesting
experience and he understands the profound effect this has on people. He thanked
the City of Longwood as a whole and recognized and. thanked the people at City
Hall, Fire Department, Police Department, and Public Works for helping families.
He thanked Cormllissioner Sackett for coordinating some trees, Ms. Putz for
donating dolls, and Commissioner Cortes for gift card donations so some of their
fanulies will have a Chistmas diriler.

by Mr. Corey Cohen, Mr. Dan McCoy's words did. touch a lot of people who got
involved to try to malee this Holiday season better for a lot. of people. He reported
he attended the SuiRail signing with the Mayor and City Administrator and said
this was a historic event. He said the toy drive by the Police Department, Fire
Department, and Public Works was what it is all about and shows we are here to
help t11e residents in our community. He, said he enjoyed the Longwood Caroling

Coininissioners received a letter from the Seminole County Chamber of
Conunerce saying that due to the recent election they no longer have a
representative from the City o:ELongwood serving in the Bx-Officio capacity.
They requested the appointee submit t11e, expression of interest form. She advised
their meetings are held the second Monday of every month at 8:.00 a.m.
Mayor Maingot said to advise them that he would attend.
Ms. Mires said in the past she has served as the Central East Director for t11e
Florida Association o:E City Clerks. Her tei7n is coming up in JLU1e and she would '
like to seek reappointment. She stated she would need the (commission's approval
with the Mayor's signature on a letter st,~ting the Commission has approved. this.
Conunissioner Sackett moved to approve. Seconded by Conmlissiorier
Cortes and carried by a unanimous voice vote.
Mayor 1Vlaingot thanked the Con~nlission and said they attempted to resolve all
issues implacably this evening. He said ~~his was the spirit that they should move
forward.
Commissioner Bundy said since they approved the contract for the new City
Attorney, it appears this will be Mr. Roper's last o:Eficial meeting here. He stated
he has enjoyed their association over the;se several years and looked forward to
continuing as the litigation specialist for PRM.
