16-2108 Amending Future Land Use at 439 W Church Ave, LongwoodORDINANCE NO. 16-2108 AN ORDINANCE OF THE CITY OF LONGWOOD, FLORIDA, AMENDING ORDINANCE NO. 1019, SAID ORDINANCE BEING THE COMPREHENSIVE PLAN FOR THE CITY OF LONGWOOD, FLORIDA; SAID SMALL SCALE PLAN AMENDMENT (SPA 04-16) CHANGING THE LAND USE DESIGNATION ON THE FUTURE LAND USE MAP OF THE COMPREHENSIVE PLAN AND THE ZONING DESIGNATION FROM CONSERVATION (CON) TO LOW DENSITY RESIDENTIAL (LDR) FOR A PORTION OF THE PROPERTY WITH PARCEL ID 31-20-30-300-030P-0000; PROVIDING FOR CONFLICTS, SEVERABILITY AND EFFECTIVE DATE. WHEREAS, on July 20, 1992, the City of Longwood adopted its Comprehensive Plan (Ordinance No. 1019) pursuant to the requirements of Chapter 163, Part II, Florida Statutes and Chapter 9J-5 Florida Administrative Code; and WHEREAS, Alicia Kaufman has requested a change to the future land use and zoning designation for properties located within the City of Longwood, described in Section I; and WHEREAS, such properties should be consistent with land uses of neighboring parcels to allow for the most appropriate future development of the site; and WHEREAS, such designations should ensure that areas of conservation value are protected from development; and WHEREAS, the applicant Alicia Kaufman has provided a survey from a qualified consultant defining the extent of the new conservation boundary; and WHEREAS, the proposed future land use and zoning classification (LDR) for the property is consistent with City of Longwood Comprehensive Plan and its goals, policies and objectives; and Ordinance No. 16-2108 Page I of 6 WHEREAS, Chapter 163.3174 (4) (a), Florida Statutes requires the Land Planning Agency (LPA) to make recommendations to the governing body regarding amendments to the Comprehensive Plan; and WHEREAS, the LPA held a public hearing with due public notice on December 14, 2016 to consider the future land use and zoning map amendment request; and recommended the proposed Small Scale Plan Amendment (SPA 04-16) be approved by the City Commission; and WHEREAS, the Longwood City Commission has held a first reading of the FLU and zoning map amendment; and WHEREAS, the City Commission of the City of Longwood, Florida has held a public hearing with due public notice to consider the FLU and zoning map amendments of the property hereinafter described and at such hearing, interested parties and citizens for and/or against the proposed establishment of the City of Longwood future land use and zoning designation were heard; and BE IT SO ORDAINED BY THE CITY COMMISSION OF THE CITY OF LONGWOOD, FLORIDA, AS FOLLOWS: SECTION I. That the Future Land Use Map of the City of Longwood Comprehensive Plan as established by Ordinance No 1019, is hereby amended by changing the designation of a portion of the subject parcel to the Low Density Residential (LDR) Future Land Use designation as provided in Exhibit A, and that the Official Zoning Map is hereby amended by changing the designation of a portion of the subject parcels to Low Density Residential (LDR) as provided in Exhibit A, said property being more specifically described as: Property ID#: A Portion of 31-20-30-300-030P-0000, AND Addressed 439 W Church Ave, Longwood Legal Description: A portion of SEC 31 TWP 20S RGE 30E FM NE COR OF NW 1/4 OF SE 1/4 RUN W 787.98 FT S 24 DEG 16 MIN 55 SEC E 39.33 FT Ordinance No. 16-2108 Page 2 of 6 SELY ON CURVE 266.84 FT S 40 DEG 09 MIN 41 SEC E 140 FT TO POB RUN S 40 DEG 09 MIN 41 SEC E 60 FT N 49 DEG 50 MIN 19 SEC E 135 FT N 40 DEG 09 MIN 41 SEC W 60 FT S 49 DEG 50 MIN 19 SEC W 135 FT TO BEG. SECTION H. Codification: It is the intention of the City Commission of the City of Longwood, Florida and it is hereby ordained that the provisions of the Ordinance shall become and be made a part of the City of Longwood, Florida adopted zoning map. SECTION M. Conflicts: If any Ordinance or part thereof is in conflict herewith, this Ordinance shall control to the extent of the conflict. SECTION IV. Severability: If any section or portion of a section of this Ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to invalidate or impair the validity, force or effect of any other section or part of this Ordinance. SECTION V. Effective Date: This Ordinance shall become effective 31 days after adoption if no timely challenge is filed. If timely challenged, this Ordinance shall become effective as provided in the applicable provisions of Chapter 163, Part II, Florida Statutes. FIRST READING this 19th day of December, A.D. 2016.
