18-2145 Amending Chapter 1A, Section 1A.02(B) City's Personnel Policies and Procedures ManualORDINANCE NO.18-2145 AN ORDINANCE OF THE CITY OF LONGWOOD, FLORIDA, AMENDING CHAPTER 1A, SECTION 1A.02(B.) OF THE CITY OF LONGWOOD PERSONNEL POLICIES AND PROCEDURES MANUAL; PROVIDING FOR CONFLICTS, CODIFICATION, SEVERABLITY AND AN EFFECTIVE DATE. WHEREAS, the City of Longwood adopted Personnel Policies and Procedures pursuant to Ordinance No. 89-955 on December 18-1989 and such as been amended via ordinance from time to time; and WHEREAS, the City of Longwood desires to amendment the policies concerning the City Manager's authority and responsibilities as set forth in Chapter IA, Section 1A.02 of the City of Longwood Personnel Policies and Procedures Manual to clarify the City Manager's authority concerning employee raises in between the budgeting process. NOW, THEREFORE BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LONGWOOD, FLORIDA, AS FOLLOWS: SECTION 1. Amendment. That Chapter IA (Authority and Responsibility), Section 1A.02(B ) be amended by as follows: (striraken dff words are deletions; underlined words are additions, provisions not included are not being changed) 1A.02 — Authority and Responsibility of the City Manager B. The City Manager shall have the authority and responsibility for equitable and effective implementation and general administration of these personnel policies and procedures within their respective scope or organization as follows - Select, employ, and supervise all personnel and fill all vacancies, positions, or employment with final administrative authority to suspend, discharge, or remove any employee of the City Commission except these se for the City Clerk and the City Attorney which ealled iff the City Charter provides for City Commission appointment and removalSection 4� 2. Obtain confirmation of the City Gemmissien en the of Department Directors by the Cily Commission as set forth in the City Charter 3 Review and recommend to the City Commission all staffing position addition or elimination ehaege requests outside of the budget process for City Commissioners approval. Recommend inter -fiscal year budget Ordinance No. 18-2145 Page 1 of 3 amendments to the City Commission as may be necessary to accommodate staffing position changes or employee compensation changes. 4. Has final administrative authority in the following: a. All actions which involve any City employee, including employment, promotion, transfer, suspension, termination, performance evaluation., recognition meF4 awards and other related actions, where appropriate. b. Authorize dual encumbrance of a position when regular incumbent is still being paid, or receiving paid leave from the City h. Authorize temporary appointment of individuals to established full or part-time positions, after paid leave of regular incumbent has been exhausted. i. All employee/applicant appeals and employee/applicant grievances. j. Request for payment in lieu of vacation. k. Training and development programs for City employees. SECTION 2: Severability If any section, subsection, sentence, clause, phrase, or portion of this Ordinance, or application hereof, is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion or application shall be Ordinance No. 18-2145 Page 2 of 3 deemed a separate distinct, and independent provision of such holding shall not affect the validity of the remaining portion thereof to the extent practicable. SECTION 3: Conflicts. To the extent this Ordinance or any provisions thereof, conflict with any previously enacted Ordinance of the city of Longwood, Florida, this Ordinance shall control only to the extent any such conflicts(s) exists. SECTION 4: Codification. This Ordinance shall be incorporated into and made a part of the City of Longwood Personnel Policies and Procedures and such provisions may be renumbered or relettered to accomplish such intention, and the word "Ordinance", or similar words may be changes to "Section", "Article", or other appropriate word. The City Clerk is a granted liberal authority to incorporate the provisions of this Ordinance as contemplated herein and to correct typographical errors. SECTION 5: Effective Date. This Ordinance shall take effect immediately upon adoption. FIRST READING this 5th day of September, A.D 2018. SECOND READING AND ADOPTION this 17'h day of September, A.D 2018.
