21-2200_Failed -Small Scale Plan Amendment SPA 01-21 ffQ1 \ea 0 irs 3av _.t/ !1ah G ,,, 0 ORDINANCE NO. 21-2200 AN ORDINANCE OF THE CITY OF LONGWOOD, FLORIDA, AMENDING ORDINANCE NO. 1019, SAID ORDINANCE BEING THE COMPREHENSIVE PLAN FOR THE CITY OF LONGWOOD, FLORIDA; SAID SMALL SCALE PLAN AMENDMENT (SPA 01-21) CHANGING THE LAND USE DESIGNATION ON THE FUTURE LAND USE MAP OF THE COMPREHENSIVE PLAN FROM COUNTY INDUSTRIAL (IND) TO CITY OF LONGWOOD INFILL AND MIXED USE (IMU) AND COUNTY ZONING FROM SINGLE FAMILY (R-1) TO CITY OF LONGWOOD LYMAN PLANNING DISTRICT TO THE PROPERTY WITH PARCEL ID 06-21-30-508-0000-0630; AND CHANGING THE LAND USE DESIGNATION ON CITY OF LONGWOOD'S FUTURE LAND USE MAP FROM INDUSTRIAL (IND) TO CITY OF LONGWOOD INFILL AND MIXED USE (IMU) TO THE PROPERTY WITH PARCEL ID 06-21-30-300- 031B-0000; PROVIDING FOR CONFLICTS,SEVERABILITY AND EFFECTIVE DATE. WHEREAS, on July 20, 1992, the City of Longwood adopted its Comprehensive Plan (Ordinance No. 1019) pursuant to the requirements of Chapter 163, Part II, Florida Statutes and Chapter 9J-5 Florida Administrative Code; and WHEREAS, Elevation Longwood, LLC on behalf of property owner JLR & Car Holdings, LLC has requested a small-scale land use amendment pursuant to annexation of the property with Parcel ID 06-21-30-508-0000-0630 now located within the City of Longwood, described in Section I; and WHEREAS, Elevation Longwood, LLC on behalf of property owner JLR & Car Holdings, LLC has requested a small-scale land use amendment to amend the City's future land use map for Parcel ID 06-21-30-300-031B-0000 already located within the City of Longwood, described in Section I; and WHEREAS, such properties should be consistent with land uses of neighboring parcels to allow for the most appropriate future development of the site; and Ordinance No.21-2200 SPA 01-21 Page 1 of 5 WHEREAS, the proposed future land use and zoning classification (IND and Lyman Planning District) for the properties is consistent with City of Longwood Comprehensive Plan and its goals, policies and objectives; and WHEREAS, Chapter 163.3174 (4) (a), Florida Statutes requires the Land Planning Agency (LPA) to make recommendations to the governing body regarding amendments to the Comprehensive Plan; and WHEREAS, the LPA held a public hearing on May 12, 2021 to consider the Small-Scale Plan Amendment request; and recommended the proposed Small-Scale Plan Amendment (SPA 01-21) be approved by the City Commission; and WHEREAS, the City Commission held an initial reading on June 7 and a public hearing on June 21, 2021 pursuant to the requirements of Chapter 163.3187, FS. WHEREAS, the City Commission of the City of Longwood, Florida has held a public hearing with due public notice to consider the future land use and zoning map amendments of the property hereinafter described and at such hearing, interested parties and citizens for and/or against the proposed establishment of the City of Longwood future land use and zoning designation were heard; and WHEREAS, the Small-Scale Plan Amendment adopted by this Ordinance is internally consistent with the City of Longwood Comprehensive Plan and its goals, policies and objectives. BE IT SO ORDAINED BY THE CITY COMMISSION OF THE CITY OF LONGWOOD, FLORIDA,AS FOLLOWS: Ordinance No.21-2200 SPA 01-21 Page 2 of 5 SECTION I: The following portions of the Future Land Use Map of the Comprehensive Plan are hereby amended to change the land use designation of the property described as: Property ID#s: 06-21-30-508-0000-0630 and 06-21-30-300-031B-0000 as depicted in EXHIBIT A, CHANGING THE LAND USE DESIGNATION ON THE FUTURE LAND USE MAP OF THE COMPREHENSIVE PLAN FROM COUNTY INDUSTRIAL (IND) TO CITY OF LONGWOOD INFILL AND MIXED USE (IMU) AND COUNTY ZONING FROM SINGLE FAMILY(R-1) TO CITY OF LONGWOOD LYMAN PLANNING DISTRICT TO THE PROPERTY WITH PARCEL ID 06- 21-30-508-0000-0630; AND CHANGING THE LAND USE DESIGNATION ON CITY OF LONGWOOD'S FUTURE LAND USE MAP FROM INDUSTRIAL (IND) TO CITY OF LONGWOOD INFILL AND MIXED USE (IMU) TO THE PROPERTY WITH PARCEL ID 06-21-30-300-031B-0000 attached hereto as though fully contained herein. SECTION II. Codification: It is the intention of the City Commission of the City of Longwood, Florida and it is hereby ordained that the provisions of the Ordinance shall become and be made a part of the City of Longwood, Florida adopted land use and zoning map. SECTION III Conflicts: If any Ordinance or part thereof is in conflict herewith, this Ordinance shall control to the extent of the conflict. SECTION III. Severability: If any section or portion of a section of this Ordinance proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other section or part of this Ordinance.
