21-2211 Approving Rate Increase for Waste Pro Residential Solid Waste & RecyclingORDINANCE NO. 21-2211 AN ORDINANCE OF THE CITY OF LONGWOOD, FLORIDA, AMENDING EXHIBITS A, B AND C OF THE WASTE PRO OF FLORIDA, INC. RESIDENTIAL SOLID WASTE AND RECYCLING COLLECTION SERVICES CONTRACT, PROVIDING FOR A RATE INCREASE; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. WHEREAS, Section 9 of the Solid Waste and Recycling Collection Services Contract, as amended ("Contract") between the Cityof Longwood and Waste Pro of Florida, Inc. adopted by Ordinance 17-2130 provides for a rate review and adjustment upon request; and WHEREAS, Waste Pro of Florida, Inc. has provided an operating Revenue and Cost Statement (Exhibit A), a Disposal Cost Formula (Exhibit B) and Collection Services Rates (Exhibits C) in accordance with Section 9 of the Contract; and WHEREAS, Waste Pro has requested a rate increase for residential collection services for cart costs, rear load, semi- automated and fully automated systems collections as detailed in Exhibit C; and NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LONGWOOD, FLORIDA, AS FOLLOWS: - SECTION 1. That Exhibits A, B, and C, attached and made part of this ordinance are hereby'. amended. SECTION 2. That Exhibits A, B, and C, as amended be made part of the Solid.AA/aste and - Recycling Collection Services Contract. SECTION 3. That the residential billed rate for collection and disposal -of Solid Waste -and Recycling be amended as follows: Rate Change Current New Rear Load Curbside $16.80 $20.40 Semi Automated Curbside $17.86 $21.46 Fully Automated Curbside $17.63 $21.23 Back Door Pickup $26.70 $30.74 Cart Replacement $55.35 $58.94 Ordinance No. 21-2211 Page 1 of 2 SECTION 4 . CONFLICTS. This Ordinance shall control in the event of a conflict with any other ordinance or resolution of the City. SECTION 5. SEVERABILITY. If any section, subsection, sentence, clause, phrase, word, or provision of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, whether for substantive, procedural, or any other reason, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions of this Ordinance.
