23-2237 Amending Future Land Use Designation at 250 North Street SPA 01-23 - P23-00156 ORDINANCE NO. 23-2237 AN ORDINANCE OF THE CITY OF LONGWOOD, FLORIDA, AMENDING ORDINANCE NO. 1019, SAID ORDINANCE BEING THE COMPREHENSIVE PLAN FOR THE CITY OF LONGWOOD, FLORIDA; SAID SMALL SCALE PLAN AMENDMENT (P23-00156; SPA 01-23) CHANGING THE LAND USE DESIGNATION ON THE FUTURE LAND USE MAP OF THE COMPREHENSIVE PLAN FROM CITY OF LONGWOOD INDUSTRIAL TO CITY INFILL AND MIXED-USE AND THE ZONING DESIGNATION FROM CITY INDUSTRIAL CORE TO CITY INFILL AND MIXED-USE FOR THE PROPERTY WITH PARCEL ID 06-21-30-300-031E-0000; PROVIDING FOR CONFLICTS, CODIFICATION, SEVERABILITY AND EFFECTIVE DATE. WHEREAS, on July 20, 1992, the City of Longwood adopted its Comprehensive Plan (Ordinance No. 1019) pursuant to the requirements of Chapter 163, Part II, Florida Statutes and Chapter 9J-5 Florida Administrative Code; and WHEREAS, WP South Acquisitions, LLC on behalf of property owner Thelma E. Tice has requested a small-scale land use and comprehensive plan amendment for the parcel; and WHEREAS, Thelma E. Tice is listed as the owner of a parcel of land consisting of ±8.7 acres (Parcel ID 06-21-30-300-031B-0000), designated as Industrial ("IND") pursuant to the City's Comprehensive Plan; and WHEREAS, WP South Acquisitions, LLC indicated in their application a desire to develop the parcel project consisting of 244 multi-family residential units; and WHEREAS, consistent with the foregoing, the applicant requested an amendment to the Future Land Use Map of the City's Comprehensive Plan as follows: Changing the "Tice" Parcel (Parcel ID: 06-21-30-300-031B-0000) from City of Longwood future land use from "Industrial (IND)" to City "Infill and Mixed Use (IMU)" and zoning designation from City "Industrial Core" to City "Infill and Mixed Use (IMU)" WHEREAS, Chapter 163.3174 (4) (a), Florida Statutes requires the Land Planning Agency (LPA) to make recommendations to the governing body regarding amendments to the Comprehensive Plan; and WHEREAS, the LPA held a public hearing on April 26, 2023 to consider the Small-Scale Plan Amendment request; and recommended the proposed Small-Scale Plan Amendment (P23- 00156; SPA 01-23) be approved by the City Commission; and Ordinance No.23-2237 SPA 01-23 Page 1 of 5 WHEREAS, the City Commission held an initial reading on May 15, 2023 and a public hearing on June 5, 2023 pursuant to the requirements of Chapter 163.3187, FS. WHEREAS, the Small-Scale Plan Amendment adopted by this Ordinance is internally consistent with the City of Longwood Comprehensive Plan and its goals, policies and objectives. BE IT SO ORDAINED BY THE CITY COMMISSION OF THE CITY OF LONGWOOD, FLORIDA, AS FOLLOWS: SECTION I: The following portions of the Future Land Use Map of the Comprehensive Plan are hereby amended to change the land use designation of the property described as: Parcel ID: 06-21-30-300-031E-0000 as depicted in EXHIBIT A, CHANGING THE LAND USE DESIGNATION ON THE FUTURE LAND USE MAP OF THE COMPREHENSIVE PLAN FROM CITY OF LONGWOOD INDUSTRIAL TO CITY INFILL AND MIXED-USE AND THE ZONING DESIGNATION FROM CITY INDUSTRIAL CORE DISTRICT TO CITY INFILL AND MIXED-USE attached hereto as though fully contained herein. SECTION II. Codification: It is the intention of the City Commission of the City of Longwood, Florida and it is hereby ordained that the provisions of the Ordinance shall become and be made a part of the City of Longwood, Florida adopted land use and zoning map. SECTION III Conflicts: If any Ordinance or part thereof is in conflict herewith, this Ordinance shall control to the extent of the conflict. SECTION III. Severability: If any section or portion of a section of this Ordinance proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other section or part of this Ordinance. SECTION IV. Effective Date: The effective date of this Ordinance shall be 31 days after its adoption unless the Comprehensive Plan amendment set forth herein is timely challenged in accordance with general law. If timely challenged, this Ordinance shall become effective in accordance with general law.
