Recordiing Secretary Absent: Joe Durso., Member 1. CALL MEETING TO ORDER/ ROLL CALL: Chair Lomax called the meeting to order at 7:CIOpm. The Recording Secretary called the roll. 2. APPROVAL OF THE MINUTES: The minutes from the May 27, 2008 meeting v~rere presented. Member Tolos moved to accept the minutes of the May meeting,, seconded by Member Putz. Minutes carried by a unanimous roll call vote with Member Durso albsent. 3. REPORT CASE UPDATES: None 4. NEW BUSINESS: None 5. PUBLIC HEARINGS: ~ Code Enforcement Board Atty. Ozim conductE;d the swearing in of witnesses and Chair Lomax announced the case docket to see who was present. CEB 06-24-08-1 A. CEB 08-04-707 PEARSON, Brian 8~ Lisa 130 Slade C~rive Longwood, FL 32750 Code Officer Bonnie Howington spoke in regards to this case. On 2/15/08 a Notice of Violation was issued for CC, Chap. 86, 86-83 13oats, Trailers, & RVs. Compliance was to have been met by 2/22/08. Upon re-inspection on 2/27/08 a Notice of Non-Compliance was issued to comply by 3/04/08. On 3/06/08 another inspection was done and nothing had changed. On 6%01/08 Lt. Cohen mailed a letter asking for voluntary compliance. On 6/10/08 the Notice of Hearing was prepared and served on Brian Pearson on 06/10/08 at 6:45pm by Officer Price of the Longwood Police Dept. Thie City is asking that the Board find the respondents guilty of violating CC, Chap. 86, 86-83 Boats, Trailers, & RVs. The City asks that the respondents be given 5 days from the date of service of final orders to bring the property into compliance or a penalty of $100 per day be imposed until they comply. Also asking for an Administrative Cost of $1D0 be assessed and paid within 30 days of receipt of Final Orders. Board asked questions of Code Officer Howinl~ton. The respondents, Brian & Lisa Pearson were present to testify. Board asked questions of respondents. Member Tolos moved to close the public hearing. Seconded by Member Putz and carried by a unanimous voice vote with Member Durso abbsent. Member Vanatta moved based on the evidence .seen and testimony heard to find the Respondents .guilty of violating CC, Chap. 86, 86-83 Boats, Trailers, & RVs. Member Vanatta moved to give the respondents 15 days from receipt of Final Orders to bring the property into compliance or a penalty of $100 per day be imposed until the property is in compliance and an Administrative Cost of $100 be assessed and be paid within 30 days of receipt of Final Orders. The respondents should contact Code Enforcement. and Building Department for inspections when the work has been completed. Seconded by Member Tolos and carried by a unanimous roll call vote with Member Durso absent. B. CEB 08-06-724 VELA, Laura 159 Sheridan Avenue Longwood, FL 32750 Code Officer Bonnie Howington spoke in regards to this case. On 4/16/08 a Notice of Violation was issued for CC, Chap. 38, 38-141 High Grass & Weeds, and LDC, Art. V, Sec. 5.3.1 Swimming Pools. Compliance was to have been met by 4/23/08. Upon re-inspection on 4/24/08 a Notice of Non-Compliance was i:~sued to comply by 4/28/08. On 5/06/08 & 5/29/08 inspections were done and nothing had changed. On 6/03/08 Lt. Cohen mailed a letter asking for voluntary compliance. On 6/10/08 the Notice of Hearing was prepared and sent certified to the respondent which was unclaimed and notice left. On 6/13/08 the Notice ~ of Hearing was posted at the property and also at City Hall. An affidavit was introduced evidencing that the property was posted and that first class mail had been sent to the CEB 06-24••08-2 respondent. As of today, 6/24/08 the grass has been mowed.. The City is asking that the Board find the respondent guilty of violating CC;, Chap. 38, 38-141 High Grass. & Weeds, and LDC, Art. V, Sec. 5..3.1.. Swimming Pools. The City asks that the respondent be given 5 days ~ from the date of service of final orders to bring the property into compliance or a penalty of $250 ,per day be imposed until they comply. Also asking for an Administrative Cost of $10.0 be assessed and paid within 30 days of receipt of Final Orders. Board asked questions of Code Officer Howinclton. The respondent's attorney Kelly Cary was' present to testify. Board asked questions of respondent's attorney. Member Tolos moved to close the public hearing. Seconded by Member Putz and carried by a unanimous voice vote with Member Durso at~sent. Member Dolan moved based on the evidence seen and testimony heard to find the Respondent guilty of violating CC, Chap, 38, 38-141 High Grass & Weeds, and LDC, Art. V, Sec. 5.3.1 Swimming Pools. Member Dolan moved to give the respondent 5 days from. receipt of Final Orders to bring the property into compliance or a penalty of $250 per day per violation be imposed until the property is in compliance and an Administrative Cost of $100 be assessed and be paid within 30 days of receipt of Final Orders.
