Resolution 08-1200 RESOLUTION NO. 08-1200 A RESOLUTION OF THE CITY OF LONGWOOD, FLORIDA DECLARING RESOLUTION 06-1140 NULL AND VOID AND ESTABLISHING A SINGLE FAMILY AND DUPLEX DRIVEWAY ACCESS POLICY WHEREAS, orie of the biggest eyesores on dirt streets is the accumulation and storage of junk or the operation of a conunercial business behind someone's home; and WHEREAS, without defined boundaries on city streets, it was convenient to enter one's property from any direction; and ' WHEREAS, the City developed and implemented a residential street paving prototype for paving dirt streets; and WHEREAS, regulating the driveway access from any paved road to one's property will improve the overall appearance of city neighborhoods. NOW, THEREFORE, BE IT RESOLVED that the City Commission of the City of Longwood do Hereby declare Resolution 06-1140 null and void and adopt the following Single Family' and .Duplex Driveway Access policy: ~ 1. Residential lots shall have a driveway access from one right of~way: ~ Once the designated driveway entrances have been established, no access .shall be grantted_ to another adjacent right of way. ~ - - - - , 2. If a property owner builds a detached mother-in-law suite-and cannot access. the structure for parking purposes from the property's designated driveway; right of wav; then a driveway access can be granted on an adjacent right of way as long as it,does not create a safety Hazard as deternlined by the Police Chief.. The property. owner shall be responsible for the full cost of the new adjacent driveway access constructed to city standards and be required to sign a driveway access agreement. The property owner shall also be responsible for the full cost of closing the driveway access; if found in violation of the agreement. 3. Two way access driveways that connect two city streets to a rear driveway shall be allowed provided that all design standards for residential infill development are met. 4. A circular driveway shall be allowed on the front right of way,, provided that the impervious surface ratio for the underlying land use district is not exceeded. If a property owner desires to use their rear yard and cannot access the rear yard from the property's designated driveway right of way; then a driveway access can be granted on an adjacent right of way as long as it does not create a safety hazard as Resolution No. 08-T200 Page 2 of 2 determined by the Police Cliief. 'The property owner will be required to sign a driveway access agreement stating that the intended use will be in compliance with all applicable codes for the use and will forfeit the driveway access for violating the ~ agreement. The property owner shall be responsible for the full cost of the adjacent driveway access constructed to city standards. The property owner shall also be responsible for the full cost of closing the driveway access, if found in violation of the agreement. 6. A property owner can submit a request for a variance to this policy to the City Commission. The property owner shall be responsible to demonstrate and provide any necessary materials to justify to the City Commission that the variance should be approved. The City Commission has the right to approve, approve with conditions or deny the variance. 7. No property owner shall have more than one additional driveway access on any adjacent right of way PASSED AND ADOPTED by the City of Longwood, this /day of ~ b~c- 2008. Brian D.
