1. CALL MEETING TO ORDERf ROLL CALL:
Chair Vanatta called the meeting to order at ~j:00pm. The Recording Secretary called the roll.
2. APPROVAL OF THE MINUTE=S:
The minutes from the January 27,, 2009 meei~:ing were presented. Member Tolos moved
to accept the minutes of the January meeting, seconded by Vice-Chairwoman Putz. Minutes
carried by a unanimous voice vote.
Mayor Sackett presented appreciation tiles to the Cade Enforcement Board members.

Code Officer Bonnie Howingtcm spoke in reg:~rds to this case.. On 09/10/09 a Repeat Notice
of Violation was issued for CC, Chap.. 38, Se~~. 38-141 High Grass & Weeds with no
compliance date per FS 162. IJpon multp a ne-inspections, the property was still not in
compliance & the case was scheduled for thE~ Code Board.. Property was brought into
compliance as of 10/02/08 ho~Neverthe City is asking that the respondents be found guilty as
a repeat violator of CC, Chap. 38, Sec. 38-1-41 High Grass & Weeds and requesting that a
$500.00 per day fine be imposed for 22 days of non-compliance. They are also asking that
an Administrative Cost of $151).00 be assessed with both fines to be paid within 30 days of
service of the Fiinal Orders.
Board asked questions of Cocle Officer Howiington.
Mr. Barry Revels spoke in regards to this cage and answered questions from the Board.
Member Tolos motioned to close the public Hearing. Seconded by Vice-Chair Putz and
carried by a unanimous voice vote.
Member Kubec moved based on the evidence seen and testimony heard to find the
respondents guilty as a repeat violator of CC, Chap. 38, Sec. 38-141 High Grass & Weeds.
Member Kubec further moved to impose a p~~nalty of $250.00 per day for 22 days of non-
compliance. In addition, Merriber Kubec monied that: an Administrative Cost of $150.00 be
assessed and that both fines be paid within :30 days of receipt of Final Orders. Seconded by
Member Tolos; discussion ensued and Vice-Chair Putz amended the motion to include the
elei~nents of offence. Amendrnent seconded by Member Tolos and passed by a unanimous
roll call vote. Further discussion ensued ands Member Rebello made a second amendment to
reduce the fine from $250.00 per day to $101).00 per day; seconded by Vice-Chair Putz and
carried with a 4-~3 roll call votes with Member ~rolos, Member Kubec and Member Dolan voting
nay. Original motion carried lay a unanimou:~ roll call vote.
Atty. Goodblatt explained ruling and orderto Mr. Revels.

Code Officer Robyn Winters spoke in regards to this case. Property is vacant and has been
in violation 3 times since 200(7. On 01/28/0~~ a Notice of Violation was issued for CC, Chap.
38, Sec. 38-121 Trash & Debris; CC, Chap. 3$, Sec. 38-141 High Grass & Weeds; and CC,
~ Chap. 86, Sec. 86-83 Boats., Trailers & RVs with a compliance date of 02/04/09. Upon re-
inspection on 0?/06/09, the property was noi: in compliance and a Notice of Non-Compliance

was issued to comply by 02/10/09. Upon further re-inspection on 02/10/09, the property was
still not in compliance & the case,was then scheduled for the Code Board. A Notice of
Hearing was served on 02/11/09. The property is now in compliance however the City is
asking that the respondents bE~ found guilty of violating CC, Chap.. 38, Sec. 38-121 Trash &
Debris; CC, Chap. 38, See. 38-14,1 High Gra:~s & Weeds; and CC, Chap. 86 Sec. 86-83
Boats, Trailers & RVs. They a,re also asking that an Administrative Cost of $100:00 be
assessed to be paid within 30 days of servicE~ of the Final Orders.
Board asked questions of Code Officer Winters.
No respondents present for this ease.
Vice-Chair Putz motioned to close the public hearing. Seconded by Member Kubec and
carried by a unanimous voice vote.
Member Dolan moved based on the evidencE~ seen and testimony heard to find the
respondents guillty of violating CC, Chap. 38, Sec. 38-121 Trash & Debris and CC, Chap. 86,
Sec. 86-83 Boats, Trailers & F;Vs however not CC, Chap. 38, Sec. 38-141 High Grass &
Weeds. Member Dolan further moved that an Administrative Cost of $100.00 be assessed
and be paid within 30 days of receipf of Final Orders. Discussion ensued regarding a higher
administrative cast. Motion sE:conded by Mei~nber Talos and carried by a unanimous roll call
vote.
5. UNFINISHED BUSINESS: None
6. OLD BUSINESS:
Atty. Goodblatt spoke in reference to the Michelle Bridle case and the Chairman's request to
draft a letter the City Commission; she passed out her draft letter and discussion ensued.
Commissioner Holt and Commissioner Bundy spoke and answered questions from the
Board. Chairman Vanatta then withdrew his request for a letter to be sent to the City
Commission.
7. NEW BUSINESS:
Atty. Goodblatt suggested the members meet to have. a seminar to go over the procedures of
the Code Enforcement Board. It was decide~~ that the seminar would be held on Thursday,
March 19th at 7pm if the chambers were available.
