7. APPROVAL OF THE MINUTES FROM THE MARCH 24, 2009 MEETING:
The minutes from the March 24, 2009 meeting were presented. Member Tolos moved to
accept the minutes, seconded by Memk~er Kubec. Minutes carried by a unanimous voice
vote.

Code Officer Bonnie Howington spoke in regards to this case. This is a repeat vio!afio+.:~~:~~
case was originally brought to the board on 09/27/05 and the Board found the respondent.
guilty and imposed a fine and an administrative fee.
This case is being presented to you as a repeat violation. The violation was for a~wall sig-i
installed at Country Kitchen without a permit. A NOV was issued on 4/20/09 for instal!i^g.a...
-sign prior to obtaining a' permit, cited under LIJC, Art. VI; 6.3:.3 with no compliance date
required per FS 162. Upon re-inspection on ~f/27/09 the sign was still up and at that time no
application had been sukimitted for the sign permit. The application was submitted on May
20th and approved and picked up on May 22"'i; a fine was paid to Community Services of
$150. A Notice of Hearing was mailed first class to the property owner and posted at the
property and also at City;Hall on May 1~~, 2009. The City is asking that the Board find the -
respondent guilty as a repeat violator of violaf:ing LDC, Art. VI, 6..3.3. The violation existec: fr~::
32 days and a fine of $250 per day for each clay the violation existed be imposed. Also
asking for an Administrative Cost of $280 be imposed and paid within 30 days of receipt of
Final Orders.
Board asked questions of Code Officer Howington.
Member Tolos moved to 'close the public hearing. Seconded by Member.Kubec and carri~e~
by a unanimous voice vote.
Atty. Goodblatt made two points of information and discussion took place.
Member Austin moved based on the evidencE; seen and testimony heard to find the
Respondent guilty of a repeat violation of LDC, Art. VI, 6.3.3. Member Austin moved ro fi^~ .

receipt of Final Orders. Seconded by Membe!~ Tolos.

Member Tolos made a motion, to re-open the case for Mr. Tran the President of Westlake
Property Group Inc. to speak.
Atty. Goodblatt swore in iMr. Tran.
Mr. Tran the respondent;spoke in regards to this case.
Member Tolos moved to~close the public hearing. Seconded by Member Dolan and carried
by a unanimous voice vote.
Member Austin moved based on the evidence seen and testimony heard to find the
Respondent guilty of a repeat violation of LDC, Art. VI, 6.3.3. Member Austin moved no fine
be imposed and a $280 Administrative. Cost be assessed and be paid within 30 days of
receipt of Final Orders. Seconded by Member Tolos and carried by a unanimous roll cal;
vote.
Atty. Goodblatt explained ruling and order to Mr. Tran.
10. UNFINISHED BUSINESS:
Atty. Lamarre spoke in regards to the rE~hearing of the Runge case (CEB case #06-05-55'1,
Repeat offender). The City Attorney, Mr. Roper feels this case should be placed on a future .
agenda to allow the respondent time to speak in regards to his. case.
Atty. Goodblatt briefed the board.
Questions were asked and answered.
Member Dolan moved to! place the Rurnge care on the agenda for the July 28, 2009. meeting;.
