A RESOLUTION OF THE CITY OF LONGWOOD,
FLORIDA, REQUESTING THE GOVERNOR TO VETO
CS/SB 2282; RELATING TO FIRST RESPONDER
SERVICES, PROVIDING INFORMATION ON IMPACT TO
LOCAL GOVERNMENT, CITIZENS PROPERTY TAXES,
AND AVOIDANCE BY INSURANCE COMPANIES TO PAY
LAWFUL CLAIMS FOR SERVICES RECEIVED BY
INSUREDS; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Longwood, Florida (the "City
Commission") has reviewed the substance of CS/SB 2282 relating to First Responder
Services in full as passed by the 2009 Florida; and
WHEREAS, the costs resulting from the negligent actions of a few should not be
borne by innocent and responsible taxpayers; and.
WHEREAS, the language of CS/S13 2282 is ambiguous and could be interpreted
by a court to prohibit recovery of expenses from a broad range of activities including
building inspections, and public education efforts like CPR classes that are critical to the
promotion of public safety; and
WHEREAS, the desire of the City Commission is to keep property taxes as low
as possible for home and business owners; and
WHEREAS, under Florida Law, at fault motorists, tort feasors and/or their
insurance companies currently reimburse local government for services provided under
response to a traffic accident where the motorists insurance industry receives crash
reports, drawings, and other assistance to the industry and to the policy holder; and
WHEREAS, dependent and independent special districts would still be able to
receive to seek recovery of expenses from negligent actions and CS/S132282 would
provide a patchwork of different standards for the recovery of the expenses resulting
from negligence around the State; and
WHEREAS, the , City Commission has determined that adoption of this
Resolution is in the best interest of the citizens and residents of the City of Longwood,
Florida.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City
of Longwood, Florida, as follows:

SECTION 1. That the recitals and findings contained in the Preamble of
this Resolution are adopted by reference and incorporated as if fully set forth in this
Section.
SECTION 2. The City Commission formally requests that Governor
Crist carefully review the adverse impacts of CS/SB2282 on property owners in Florida,
and the adverse impact that this Bill will have on local government's ability to LOWER
property taxes.
SECTION 3. The City Commission formally requests that Governor
Crist also review the relief provided to the; insurance industry without any corresponding
reduction in rates for the policy owners, and the patchwork of regulations for types of
response provided by local government, based on ambulance response, fire response,
police response, or hazardous material response, as well as what type of local government
is responding to the incident.
SECTION 4. This Resolution shall be transmitted to the Governor
effective immediately upon adoption.
BE IT FURTHER RESOLVED that a copy of this Resolution, fully executed as
an original, duly attested by the City Clerk, be furnished to members of our local
legislative delegation.
