Mr. Revels called the meeting to order at 7:0:? P.M.

Mr. Heintz made a motion to approve the minutes as presented. Ms. Doloung seconded
the motion. The motion was approved by unanimous voice vote.
4. PUBLIC HEARING:
Mr. Revels opened the Public Hearing.
• A. VAR 03-06 Variance

Applicant: Donald Kleber and Suzanne Hall
MOTIONlRECOMMENDATION:
Ms. Adzima stated that the Community Development Division of the Community Services
Department recommends that the Board of Adjustment (BOA) review the requested
Variance (VAR 03-06) to decrease the rear y,~rd setback from 15 feet to 5 feet at 401 Parson
Brown Way.

Ms. Adzima explained that the applicant desires. to place a l2 foot by 18 foot shed on the
. subject property. The location of a swimming pool centered in the rear yard restricts the
locations available for placement of the shed... In addition, the property is a corner lot and is
subject to higher side setback lines than a :,tandard lot. The proposed shed location lies
within the 15 foot rear setback. Other issues, including the corner lot setbacks and an
easement on the rear property line, will further restrict the available locations for the. shed.
Ms. Adzima added that if the variance is granted it is recommended that the Board place
restrictions on the shed to ensure compliance to City codes and ordinances. The rear setback
should be reduced to 7 1/2 feet instead of 5 feet and the shed should be rotated so it does not
encroach to the corner lot side setback of 25 feet.
Donald Kleber, 401 Parson Brown Way, stated he has no choice than to place the shed on
the corner side and the other side of the pool lie has a swing set.
Mr. McLarnon stated that the provided survey with the shed drawn on is not to scale.
Mr. Kleber responded that he drew the shed o~n for visual purposes but that it was in fact not
to scale.
_ Discussion ensued.
Mr. Revels closed the Public Hearing.
Mr. McLarnon made a motion to approve the rear setback of 7 feet (i~AR 03-06). Ms.
Doulong seconded the •motion. The motion tivgs unanimously approved by a (3-0) roll call
vote.
B. VAR 04-06 Variance
Lighting Desigin Standards

MOTION/RECOMIVIENDATION:
Ms. Adzima stated that the Community Development Division of the Community Services
Department .recommends that the Board of Adjustment (BOA) review the requested
Variance (VAR 04-06) to adjust the design standards for parking lot lighting, poles and
fixtures for the property located at 905 Longv~rood Hills Road.

• Ms. Adzima explained that the applicant is developing the property to include a new
building and parking area. The site plan has been approved and construction is proceeding.
The applicant has provided a lighting pla~i and fixture and pole details that meet the
requirements of the LDC. Due to the number of light poles required, the cost of the
decorative poles will be considerable. The: applicant is seeking a compromise to allow
shoebox style fixtures and smooth poles. '
Dave Nickleson, owner stated he is trying to find something more affordable.
Discussion ensued.
Ms. Adzima wanted to point out to the Board that a variance should not be granted for the
sole purpose of cutting costs.
Mr. McLarnon added that consistency should be kept throughout the City.
Mr. McLarnon made a motion to table (i~A~R 04-06) until City has addressed the lighting
issue. Mr. Heintz seconded the motion. The motion was approved by a (4-0) roll calf' vote.
C. lOAR 05-06 Variance

MOTIONlRECONiMENDATION:
Ms. Adzima stated that the Community Development Division of the Community Services
Department recommends that the Board of Adjustment (BOA) review the requested
Variance (VAR OS-06) to raise the maximum impervious surface ratio from 42% to 47%.
EXPLANAT~ON/BACKGROUND:
Ms. Adzima explained that the applicant proposes to construct a swimming pool and Jacuzzi
as a part of new additions to the existing singlle family residence. A separate building permit
application for a building addition has been submitted... The proposed addition beings the
total impervious surface ratio ~to approximate:ly 40%. The proposed pool and Jacuzzi would
bring the total impervious surface ratio to approximately 47%, a difference of 375 square
feet.
Mr. Miller read a letter which was sent from I~elphia J. Parker in opposition of this item.
James Dordevic, 325 Saddleworth Place, Heathrow, stated he is the contractor for this
project and they are willing to remove a p;~rking space and eliminate the concrete from
around the pool to reduce the ISR.

~ Ms. Adzima pointed out that four parking spaces are required per residence.
Mr. Miller suggested that the Board table this item until revised drawings are submitted with
the new information.
Nicole Badger, 114 Sandalwood Way, stated she empathizes with the situation her neighbor
is in, but she is worried about flooding issues.
Mr. McLarnon made a motion to table (Ij~fR OS-06) until further information is brought
forth. Ms. Doulong seconded the motion. The motion was approved (4-0) by a roll call vote.
