CALL TO ORDER: Chair Revels called the meeting to order at 7:00 P.M. 2. PLEDGE OF ALLEGIANCE: .Chair Revels led in the Pledge of Allegiance. 3. APPROVAL OF MINUTES: A. Regular Meeting, Apri125, 2007 B Member Henitz made a motion to apj7rove the minutes with corrections. Vice Chair McLarnon seconded the motion and carried by a unanimous voice vote. 4. PUBLIC HEARING: Chair Revels opened the Public Hearing;. A. VAR 06-07 Variance Setback Reduction 1025 1 sTP'lace Property ID#: 32-20-30-506-0500-0150 Applicant: Rafael Colon BOA 0'6-28-07/1 MOTION/RECOMMENDATION: Mr. Sizemore stated that this is item 4A.. That the Community Development Division of the Community Services. Department recommends the Board of Adjustment (BOA) review the requested Variance (VAR 06-07) to reduce the minimum setback requirements. The project for this evening is a single family residence located on 1St Place the address is 1025 1St Place. Here is a survey of the property you can see the road way 1St Place and here is the existing building. The property is designated low density residential and is listed so, on the future land use map according to section. The minimum required front setback of 25 feet. Chair Revels asked if the Applicant would like to address the Board. ' Rafael Colon: 1025 ls~ Place. Stated that: he needed to change the front entrance of his residence change the front of the building so that it no longer looks like a hospital and. that because of a safety issue. That the fi~ont door is not right next to the basement door. He is concerned because it being a safety hazard for his grandchild in case of a fire That • he has tried to upgrade the property from the time that he purchased it. He is requesting that he be able to add 2 to3 feet to the fr~~nt of the building but it would not reach the circle driveway. He would like. to eliminate the safety hazard and upgrade his property and the neighborhood. ~ Chair Revels questioned if it was 48.3 fe;et? Is that going to be the width? Rafael Colon stated that that would be the width. It would be on the front porch, he said it would give the look of old Longwood a balcony type of thing. Chair Revels asked if it will be an enclosed porch with screen or an open porch. Rafael Colon discussed with the board that he was looking for a country style porch and that his property drops quick in the back yard, that he had purchased the. house because his last son who is 17 years old and is into martial arts he is a third degree martial art and this has more space for him to practice. 'The entrance will be extended so that the doors don't bump .There is no Home Owners Association Chair Revels opens then, closes the public hearing. Member Doulong made a motion to approve VAR 06-07. Member Heintz seconded the motion and carried by unanimous roll ccxll vote. B.VAR 07-07 Variance Setback Reduction 600 Fallsmead Circle ~ Property I:D#: 31-20-30-506-0000-0880 Applicant:. Robert & Amy :Kamos BOA 0~5-28-07/2 This is item 4 B That the Community Development Division of the Community Services Department recommends the Board of Adjustment (BOA) review the requested Variance (VAR 07-07) to reduce the minim setba~~k requirements. This variance request is for the property at 600 Fallsmead Circle which you see on the Future Land Use Map that was being shown to the board. The property is designated as Medium Density Residential on the Cities Future Land Use Map. As you can see from the survey that the proposal is to construct a 14 x 25 covered lanai as it is positioned on the survey. The house is already located pretty much right on the property line. This would encroach into the required side 7 foot setbacks to less than a foot.and to reduce the rear setback to less than 6 feet to make a covered lanai. There is also an existing wood deck which is supposed to be removed and replaced with mulch. So the applicants request is for a variance to reduce the side set back to less than a foot. Plus reduce the rear setback to just over 6 to 6 feet with construction of the covered lanai. The property is located in a subdivision that has a Home Owners Association. The City has approval from the Architectural Control Board in the Has well as the adjacent property owner notification. Chair Revels asked for confirmation that the house did sit on the property line. Mr. Sizemore commented that was correct. He stated that you could see from the survey. This subdivision was or7ginally built as ,a PUD. From the time period when the City had zoning. There is a consistency throughout the neighborhood of situations like this where you have buildings that are constructed much closer than what the current set backs would require since the zoning layers or.~ the map were eliminated. Chair Revels asked Mr.,Sizemore if there have been other issues and other applications from this area in the past. . Mr. Sizemore stated that he did not recall any specifically. He was willing to venture a guess and state that in this. subdivision there are one or two back patio's that were ether were developed as a PUD and the house was built close to the property line that the existing house makes to a porch or a lan.ai.on the back. Chair Revels and Mr. Sizemore discussed the fact that the property backs up to West Lake with the retention pond on one side; and the lake on the other. Member Doulong questions where on the Land Use Map it is going to be located The applicant was not in attendance. . Vice Chair McLarnon & Member Boni mention the wood deck and that there was no issue with The Home Owners Associ`atian Member Doulong commented on the neiighbors receiving notification. Motion to approve by Member Heintz with a second by Vice Chair McLarnon. Carried with a unanimous roll call vote BOA 0~5-28-07/3 C.VAlla 08-07 Variance Setback Reduction 981 & 977 Wildflower Way Property LD#: 31-20-30-509-0000-24A0,31-20-30-509- 0000-24B~D Applicants: Cheryl Harmon & Mary Jane Judge Mr. Sizemore stated that this is item 4C.The Community Development Division of the Community Services Department recommends the Board of Adjustment (BOA) review the requested Variance (VAR 08-07) to reduce the minimum setback requirements. The project for this evening is a joint application with the property located at 981 977 Wildflower Way. The applicants own these two properties. They have worked together to file a joint application on two adjacent properties and they share the same issue. By resolution of a single variance it can solve. both problems. This is one halfof a duplex, . which is one of the addresses the properties mirror image each other with a concrete pad and a doorway that accesses the back yard. They axe proposing to construct a screen room. Under the previously existing zoning duplexes were allowed to share a lot line so there was a 0 foot side set back. When the zoning layer was eliminated the future land use designation. Created a nonconforming situation the two property owners would construct their screen rooms so they come together and almost touch the property line which is straddled by the duplex and so they have; submitted this variance request to come before the Board of Adjustments request that the side yard setback be reduced down to 0 feet. So, they can construct a.screen room addition. The applicants are present. Chair Revels asks if the Applicant wouL3 like to come forward. Cheryl Harmon: 977 Wildflower. She is at lot 24B and Mary Jane Judge is at lot 24 A. Basically Mr. Sizemore covered everything: If they come in the required 7 feet then it would start the porch over half way over the sliding glass doors. She stated that the porch would be consistent with what is currently in the neighborhood. They have notified the neighbors. They are asking for approval of their project. Chair McLarnon wondered why it was c?nly one request. Cheryl Harmon stated that it was only o:ne project. Member Heiritz asked about the porch size. Cheryl Harmon commented that it will cover from the back of the house at the property line and it is 28 feet so the slab, and the roof would be 28 Feet, but the screen section should be 24 feet because of the out door facet. Because if it came to the end of the house it will cover that facet and extended out'12 feet. Chair McLarnon closed and reopened the Public Hearing Motion to approve VAR 08-07 by Member Boni with a second by Member Doulong carried by a unanimous roll call vote BOA 06-28-07/4 ' 5.
