ARTICLE II OFFENSES; MISCELLANEOUS SECTION l: Abandoned Property - The chief of police is hereby authorized and directed to confiscate any and all aban- Boned personal property and motor vehicles within the corporate limits o.f the City; and if th.e owner of same cannot be located after diligent search of not less than sixty (60) days,. the City d shall be authorized to sell same at public sales held for such 0 purpose at the City Hall following Notice of Intent to sell given 0 LL N in three. (3) public places in the City. " If the owner of the: abandoned personal property or W - motor chicle can be found such ro ert or vehicle shall be v ~ P P Y Y Q W released to him upon the payment of the reasonable costs of such a search and inquiry, fees, fines, damages and expense due the. 0 city. 3 SECTION 2; Affrays and_Riots Generally - All persons d guilty of an affray or riot shall be punished as provided in Sec- W Z tion 2, ,4rticle I of this Collie. a N SECTION 3: Assault and Battery - It shall be unlawful o I r z for any person to commit assault or assault and battery upon ~,.~1 ~ ~ a another person in the City. I, O I o SECTION 4: Assault with_a Deadly Weapon - It shall be II F unlawful for any person to assault another person with a deadly II N weapon in the City. SECTION 5: Begg~i.n~ - It shall be unlawful for any person in the streets or public places of the City to beg or solicit gifts or money or to exhibit his person for the purpose of obtaining gifts or money. SECTION 6: Bicycles; Stealing or Destroying - It . -2 shall be unlawful for any person to steal or attempt to steal, to destroy or attempt to destroy, to mutilate or attempt to mutilate a bicyclEv or any part thereof, that is the property of another. SECTION 7: Curfew - It shall be unlawful for any .person under the age of sixteen (16) to remain or be found upon the streets, avenues, alleys, public ways or parks of the City after 11 p.m., unless accompanied by his parent, guardian or a a member of his family over the age of twenty-one (21). It shall 0 J obe unlawful for any parent or guardian of any person under sixteen 0 d (16) years of age to knowledgely permit such person to remain or y N W be found upon the above-described public premises after 11 p.m., N unless accompanied by either himself or by a member of his family Y Z m over the age of twenty-one (21). w a N SECTION 8: Dance Halls - It shall be unlawful for any a 0 o person to operate. for profit in the City any place where dancing LL . ~ is engaged in, without a permit for such activity being first ob- a ~ tained from the City Council. W Z o SECTION 9: Dance Halls; Orderly Conduct triereof - It r a Nshall be unlawful for. any owner or lawful operator of a dance hall 0 Ito allow or permit disorderly conduct within such premises. i ~~a~~' ~ i SECTION 10: Disorderly Conduct - Any person endangering a 0 ~ or disturbing the public peace or violating public decency by usin 0 F W any abusive, obscene or profane language, or making any threats of violence to or against any other person or by being noisy and disorderly in or upon any street or other public place in disturb- ance of 1.he public tranquility shall be punished as provided in Section Article I of this Code. SECTION 11: Disorderly Places; Generally -Any owner or keeper_ of any public or private house,~who shall allow or permi -3- _ _ _ -'~J F ii r . any persons who may resort to~ their houses by day or night to dis- turb the peace of the community, shall be adjudged in violation ~ of this Code. SECTION 12: Disorderly Places; Inmates of Disorderly Houses - It shall be unlawful for any person to be an inmate of a disorderly house within the: corporate limits of the City. SECTION 13: Disturbing Lawful Assembly - It shall bye a unlawful for any person to disturb or willfully interrupt any 0 o lawful assembly of people within the City. 0 SECTION 14: Drunkenness - It shall be unlawful for any N " person to become drunk or to be drunk or intoxicated by the volun~'~ • m ,i nary use o-f intoxicating liqulors or beverages . Y Z W SECTION 15: Improper Exposure of Person - It shall be. a 4 unlawful for any person to make an indecent exposure or exhibit of 0 g his sexual.organs in any street or public place or on the private W a 3 premises of another or so near thereto as to be seen from the H Q ~ public or private premises of another. w z SECTION 16: False; Alarm of Fire - It shall be unlaw- a N ful for any person without reasonable cause, by outcry or the 0 ringing of bells, or by turning in through the fire alarm boxes, ~ ;'or othex-~aise, to make or circulate or cause to be made or circu- • a 0 o lated, a false alarm of fire. W SECTION 17: Gambling;. Generate - It shall be unlaw- F ful for any person to engage in any game of cards, keno., roulette, afro ar other dame of chance at any place in the City by any device whatever, for money or~ other thing of value, or to sell, offer to sell, or possess any ticket, coupon, share, paper, symbol or device of any kind, which had, at any time of its sale, or offer of sale., a value in money or pr-operty of any kind, to ~be -4 - determined by chance. SECTION 18: Gambling; Keeping Gambling House. or Gamb- ling Apparatus - It shall be unlawful for any person or his agent to keep, exercise or maintain a gambling table or room or gaming implement or apparatus or houlse, booth, tent or other place for the purpose of gaining or gambling, or in any place of which he ma directl or indirectl have charge, control or management, Y Y Y a to procure, suffer or permit any person to play for money or other 0 J o valuable thing at any game whatever. 0 SECTION 19: Gambling; Frequenting Gambling House - N W It shall be unlawful to frequent any gambling or gaming house. g; Possession of Lottery Tickets - SECTION 20: Gambl.in y - - Z a ' W It shall be unlawful for any person to have in his possession in a F a the City any ticket, share or~ coupon in any lottery for money or o a other thing of value. 3 SECTION 21: Gambling; Sale of Lottery Tickets - It J F Q ;shall be unlawful for any person to sell in the City. any ticket, w z share or coupon in any lottery for money or other thing of value. a i N SECTION 22: Gambling; Authority of.Police to Enter ~I ~ i z i ~ Gambling Houses -Any policeman having good reason to believe that ~ . gambling is being carried on in any house or other place, may ente d o o the same forcibly, after obtaining a written warrant, and may w arrest any person .violating the provisions of Sections 17,.18, 19, I N 20 or 21 hereof.. SECTION 23: Gambling; Disposition of Gambling Appar- atus - The chief of police, when any of the implements, devices or apparatus commonly used for ;ambling purp oses, are found in any house or other place used for the purpose of .gaming, shall seize the same. and hold the same for uses as evidence. in the trial of 1 -S- the person in whose possession the same are found and charged with keeping a gambling house: or gambling apparatus. Upon convic~ Lion of such person, the municipal judge shall order such gambling apparatus destroyed or otherwise disposes of by the chief of police. SECTION 24: Iceboxes and Refrigerators; Leaving Aban- Boned, Unattended or Discarded in Places Accessible to Children - It shall be unlawful for any person to leave or permit to remain 0 J o outside cif any dwelling, building, or other structure, or within 0 a any unoccupied or abandoned building, dwelling or other structure N " under his control, in a place: accessible to children or others w " under disability, any abandon~.ed, unattended or discarded icebox, Y Z W refrigerator or other container which has a door or lid equipped a a with snaplock or other locking device which may not be released , 0 from the inside, without first removing such door or lid., snap- g lock or other locking device from such icebox, refrigerator or a coma ine:r . W Z o SECTION 25 : Indecency - It sha 11 be unlawful for any a N person within the corporate limits of the City to exhibit, sell 0 or offer to sell any pornographic book, picture or other thing; ~ or to exhhibit or perform any lewd play or other representation; a 0 0 or to be guilty in any way of: indecent and lewd behavior. w SECTION 26: Loud and Unnecessary Noise Prohibited - N It shall be unlawful for any person to make., continue, or cause ,to be made or continued any loual, unnecessary or disturbing noise which either annoys, disturb", injures or endangers the comfort, repose, health, peace or safE:ty of others within the corporate limits of the City. :SECTION 27: Loud and Unnecessary Noise.; Enumerated - -6- Except as otherwise provided in this Section, the following acts among others are declared to be loud, disturbing and unnecessary noises in violation of the preceding Section, but such enumera- tion sha:11 not be deemed to be exclusive; namely: Horns, signaling devices, et cetera. The soL~nding of any horn or signaling device on any automobile, motorcycle or other ve}.zicle on any street or public place of the City, except as a danger warning, the creation of any unreasonably loud or 0 o harsh sound by means of any such signaling device and the sound- 0 a ing of a~zy such device for an. unnecessary and unreasonable period N W of time. The use of any signaling device except one operated b;y hand or electricity, the use of any horn, whistle or other device Y Q ' W operated by engine exhaust and the use of any such signaling de- a a vice when traffic is for any reason held up. 0 g Radios, phonographs3 et cetera. The using, operating or permitting to be played, ulsed or operated any radio receiving 4 set, musical instrument, phor,!ograph or other machine or device W Z for the. producing or reprodue:ing of sound in any such manner as a N to disturb the peace, quiet a.nd comfort of the neighboring 0 r inhabitants or at any time with louder volume than is necessary ~ for convenient hearing for the person who is in the room, vehicle a 0 0 or chamber in which such macrrine or device is operated and who is W a voluntary listener thereto. The operation of any such set, in- I strumen•t, phonograph, machine or device between the hours of 11 p.m., and 7 a.m., in such a manner as to be plainly audible at a distance of fifty (50) feet from the building, structure or vehicle in which it is locatE+d, shall be prima facie evidence of a violation of this Section. Sound trucks. No ~~ound truck or other device or medium 'i -7- for ampl:Lfying sound shall be operated or permitted to operate within the City for advertising purposes or to attract the atten-' tion of 1~he public, where the sound therefrom is transmitted from, to., in or over any public thoroughfare, park, or other public p:Lace. This Section shall not prohibit the use of such sound amplification for disseminating religious or political mes- sages, or information concerning civic, recreational and other a matters of general public interest; provided permission for same 0 obe obtained from the chief of police, who is hereby authorized, 0 a directed and empowered to make and enforce reasonable rules as 'to N W such use with reference to time, place and volume. Yelling., shouting, et cetera. Yelling, shouting, hoot- Y Z i Q Wing, whistling or singing on the public streets, particularly a a between the hours of 11 p.m., and 7 a.m., or at any time or place ° so as to annoy or disturb the quiet, comfort or repose of persons a in an office dwellin hotel or~other t e of residence or of Y ~ g~ yP a } any-persons in the vicinity. ° Animals and birds. The keeping of any animal or bird a o which by causing frequent or long continued noise shall disturb Z the comfort or repose of any persons in the vicinity. ~n ~Stea~m whistles. Th.e blowing of any train whistle or a' 0 o steam whistle attached to any stationary boiler except to give F notice of the time to begin or stop work or as a warning of fire N ~ or danger_ or upon request of proper City authorities. Exhausts. The discharge into the open air of the ex- ~I haust of any-steam engine, stationary internal combustion engine, I motor boat or motor vehicle except through a muffler or other device which will effectively prevent loud or explosive noises therefrom. , -8- Defect in vehicle or load. The use of any automobile, motorcycle or vehicle so out of repair, so loaded or in such manner as to create loud and unnecessary grating, grinding, rattling or other noise. Loading, unloading, opening boxes. The creation of a loud and excessive noise in connection with loading or unloading any vehicle or the opening anal destruction of boxes, crates and d a containers. 0 J LL o Construction or repairing of building. The erection 0 a (includi~ig excavating), demolition, alteration or repair of any " W building other than between the hours of 7 a.m., and 6 p.m., on h "weekdays, except in case of urgent necessity in the interest of Y Z Q W public health and safety, and. then. only with a permit from the a ' a building inspector, which permit may be granted for a period not 0 to exceed three (3) days or less while the emergency continues k and which-permit may be renewed for periods of three (3) days or a ;less whi:Le the emergency continues. If the building inspector W Z should determine that the public health and safety will not be a N impaired by the erection, demolition,.alteration or repair of 0 ~ any building or the excavation of streets and .highways within t:he , hours of 6 p.m., and 7 a.m., and if he shall further determine 0 o that loss of inconvenience would result to any party in interest, W he may grant permission for such work to be done within the hours " of 6 p.m., and 7 a.m., upon application being made at the time the permit for the work is awarded or during the progress of the work. Schools, courts, churches, hospitals. The creation of any excessive noise, on any street adjacent to any school, insti- tution o:f learning, church or~ court while the same are in use, or adjacent to any hospital, which unreasonably interferes with the * -9- working of such institution, or which disturbs or unduly annoys patients in the hospital; provided that conspicuous signs are disc=-~ played in such streets indicating that the same is a school, hospital or court street. Hawkers., peddlers,. et cetera. The shouting and crying of peddlers, hawkers and vendors which disturb the peace and quiet of the neighborhoodo a Noises to attract attention. The use of any drum or 0 0 other instrument or device for the purpose of attracting atten- 0 a tion by~creation of noises to any performance, show or sale. N ' Transport ion of metal rails, et cetera. The transpo:r-,_\~ W 5 tation a:E rails, pillows or columns of iron, steel or other mater- s Y Z m sal over and along streets anal other public places upon carts, W a N drays, cars, trucks or in any other manner so loaded as to cause a 0 g loud noises or as to disturb the peace and quiet of such streets for other public places. a ~ Pile drivers, hammers, et cetera. The operation between W Z oche hour: of 10 p.m., and 7 a.m., of any pile driver, steam shovel, d ypneumati<: hammer, derrick, steam or electric hoist, dredge, or 0 ~ _ other appliance, the use of which is attended by-loud or unusual ~ . ~ ~ noise. a i ~ Blowers. The operation of any noise-creating blower or ~ o ~ I Wpower faYi or any internal combustion engine, the operation of whic causes noise due to the explosion of operating gases or fluids, unless the noise from such blower or fan is muffled and. such ~I engine is equipped with a muffler device sufficient to deaden such noise. The provisions of this and the preceding Section sha1:1 not be enforced unless a complaint is submitted by a citizen to r r~~ -10- ~ I the police department nor be construed to prohibit music being made upo~Z streets or sidewalks by brass bands or other bands no:r to prohibit religious organizations from conducting reasonable services. SECTION 28. Officers; Obstructing or Opposing - It shall be unlawful for any person to obstruct, interfere or oppose any officer of this City, or legally authorized person, in the a execution of legal process, or•in the lawful execution of any 0 J LL o legal duty, 0 a SECTION 29: Petit. Larceny - It shall be unlawful fo;r l~ W ,any -person to coitunit or attempt to commit within the corporate limits ~:E the City, petit larceny by stealing or attempting to Y a W steal the property ~of another', any money, goods or chattels, or r a r- aany ban).c notes, bonds, promissory notes, bill of exchange or other 0 bill, order or certificate, or any book of account for or-concern- LL a inQQ mone~J or ¢oods due or to become due or to be delivered or J b .7 O > > H d } any, deed of writing containing a conveyance of land, or-any other ~ W Z valuable contract in force, ar any writ, process or public record a o if the property stolen or attempted to be stolen is of the value _ ~ ~ of ONE HUNDRED DOLLARS ($lOQ-.00) or less. a SECTION 30: Polic:emep~ Right to Summon Aid in Making 0 o Arrest - The chief of police, or any police officer of the City, shall have the power in making the arrest of any person for violat ing any of the Ordinances of the City, where such person refuses t submit to arrest, to summon t.o his aid in making such arrest a pos e of the citizens of the City., consisting_of a suff icient number to enforce ~~the law; and it shall. be unlawful for any citizen, excerpt persons physically incapacitated, to fail or refuse promptly to -i respond to this summons of the chief of police or other police -11- officer. , SECTION 31; Prisoners; Escape - It shall be unlawful for any prisoner in the City jail or on a work gang or in the custody of a policeman or guard, to escape or attempt to escape therefrom. SECTION 32: .Prisoners; Aiding in Escape - It shall be unl'aw:Eul-for any person to aid or ~assistc~.a prisoner in escap- ing or attempting to escape from an officer of the City or the 0 k o person wlzo has lawful custody of such prisoner, or from the jail ° a or other place of confinement. N • Injuring, Defacing or Destroy_ W SECTION 33: Property, Y ~ - No person shall .either negligently or willfully and maliciou - Z W ly injure, deface or destroy within the City any property of a Q another, either real, personal or mixed, public or private. 0 a ° SECTION 34: Property; Taking or'Using Temporarily i 4. Without Authority - Whoever willfully, mischievously and without right takes or uses any property of another, without the consent W Z of the other person having the legal custody, care of or control 0 of same, shall be punished as provided in Section 2, Article I Z of this Code. ,,.c '~i ~ Nothing in this Section shall be construed as to apply a ~ o o to any case where the taking of the property of another is with ~ F intent to steal the same, or when it is taken under a claim or right, o:r with the presumed consent of the owner or other person 'i having the legal control, care or custody of the same. SECTION 35: Prostitution; Commission, Aiding ,'and Abetting Unlawful - It shall be unlawful for any person to commit any act of prostitution, or t:o aid or abet others in the commis- ~ sion of any act of prostitution. ~ ~I -12- I' SECTION 36: Prostitution; Definition of Aiding and Abetting.- Any person who takes another to a place where prosti- tutes can be found,. or gives out or~offers to give o.ut any.infor- maton a:~ to a place where prostitutes may be found, shall be ' guilty o:E aiding and abetting; others in the commission of prosti- tution. SECTION.37: Prostitution• Owner et cetera.- Permit- . d ting~ on lzis~ Property - It shall. be unlawful for any owner, lessee, 0 J 0 or o~ther~person having charge of any property in the City knowing- a ly to permit any act of prostitution to be committed on such N W property.. Proof that any property has been used for the purpose ~ of prostitution for a period of sixty (60) days or longer shall Y Z W be prima facie proof 'of the fact that such use was with the a knowledge of the owner, lessee, or-other person having charge of 0 such property. Any building or other property that is found to LL have been used for the purpose of prostitution with the knowledge ~ a Nof the owner, lessee, or other person having charge of such W Z property„ may be closed and padlocked by order of the municipal a Njudge for a period not exceeding six (6) months; and it shall be 0 z unlawful for any person to enter such building or other property ~ ;while it is closed and padlocked. a o o SECTION 3.8: Prostitution; Taxi Drivers - If any taxi i W driver is found guilty of violating any of the provisions of N Section 36 of this Article IL, the identification card o:f such ~ person~to drive a taxi in the City may be suspended for any I period, or permanently revoked, by order of the municipal judge. Such suspension or revocation. is in addition to the other punish- ~ ment provided in this Code.. II SECTION 39: Prostitution; Frequenting Houses of I11 -13- Fame - I~t shall be unlawful for any person to frequent any house of ill fame within the corporate limits of the City. SECTION 40: Prostitution; Inmates of Houses of Prosti- tution - It shall be unlawful. for any person to be an inmate of a house of prostitution within the corporate limits of the City. SECTION 41: Rummage Sales; Licenses Required.; Fee - No sale of goods, wares or merchandise commonly known as a o ii - - rumma e sale shall be conducted prior to the obtaining of a pier g 0 J o mit or license for such purpose and the payment of a permit or 0 w d license :Eee therefor. ' N " SECTION 42 : Shade. Trees ; Cutting, Inj using, et cetera ~ ~ ' N It shall be unlawful for any person to cut down, cut, bruise or Y z W otherwise injure any municipally owned .shade tree within the a a corporate limits of the City. Q g SECTION 43: Sp itt:ing, et cetera, upon Sidewalks and LL Other Public Places - It shall be unlawful for any person to spit ~ or throw hulls, peelings or other litter upon the streets, side- W z o walks or upon the floors of churches, public halls, theatres, or ~I a N other public places. ~I o SECTION 44: Stolen Property; Buying, Receiving or • a Concealing- It shall be unlawful for any person in the City to II ~ bu receive ossess or conceal an stolen ro ert or aid in the Y~ ~ p Y P P Y I~ W concealment of any such property, knowing the same to have been stolen. SECTION 45: Summonses and Notices; Failure to Obey - It shall be unlawful for•any~person to willfully disregard or fail to obey any notice or summon" lawfully served upon such person by ~ any police officer of the City. II SECTION. 46: Tampering with ,S cales - It shall be ~i -14- unlawful for any person to tamper with or adjust any. scale for the ice. purpose of weighing commodities for sale in the City, so as to make the same weigh less than sixteen (16) ounces to the pound. Itinerant Solicitors General- o W ly; Perm;its Required; PreregL+is ite to Issuance -The City clerk is hereby authorized to issue a permit to any person or individual, upon proper application, to solicit orders from the citizens of th. City but only upon exhibition to him of proper credentials. SECTION .51: TresP~ass - It shall be. unlawful for any person to commit any trespass upon the property of another with a malicious or mischievous intent within. the corporate limits of -15- the City. .f SECTION.52: Unlawful Assemblies, Riots, et cetera; Duty of 1"'hief of Police, et cetera, to Disperse - Three (3) or more persons meeting together to commit a breach of the peace or to do any other unlawful act shall be guilty of unlawful assembly within the purview of this Code. If any number of persons, whether armed or not, are unlawful:y, riotously or tumultuously assembled in the City, it 0 J o shall be the duty of the Chief of Police or any member of the o police department to go among the persons so assembled, or as N W near to them as may be with safety, and in the name of the City ~ N to command all the persons so assembled immediately and peaceably Y Z m to disperse.
