Ordinance 04-1742 ORDII~IAN~CE NO. ~4-ll7~2 AN ORDINANCE OF THE CI1CY OF LONGWOOD, FLORIDA, AMENDING ORDINANCE, PJO. 1.019, SAID ORDINANCE ~ BE:[NG THE COMPREHENSIVE PLAN FOR THE CITY OF ' LONGWOOD, FLORIDA; SAID SMALL SCALE PLAN AMENDMENT (SPA 16-04) CHANGING THE LAND USE DESIGNATION ON THE FUTURE LAND USE MAP OF THE COMPREHENSIVE PLAN AT THE SOUTHERN ONE HUNDRED FIFTY (150) FEET OF 152 LAKE AVENUE FROM LOW DENSITY .RESIDENTIAL (LDR) TO GENERAL COMMERCIAL (GC) PRCIVIDING FOR CONFLICTS, SE`VERABILITY AND EFFEC~CIVE DATE. WHEREAS, on July 20, 1992, the City of Longwood adopted its Comprehensive Plan (Ordinance No. 1019) pursuant to the requirements of Chapter 163, Part II, Florida Statutes and Chapter 9J-5 Florida. Administrative Code; and WHEREAS., on November 19, 1993 the Florida Department of Community Affairs determined the City's Comprehensive Plan was in compliance with the requirements of Chapter 163, Part II, Florida Statutes and Chapter 9J-5, Florida ~?,dmini trative Code; and WHEREAS., Chapter 163.3174 (4) (a), Florida Statutes requires the Land Plannin Agency (I,PA) to make recormnendations to the governing body regarding amendments to the Comprehensive Plan; and WHEREAS., the LPA held a public hearing on December 8, 2004 to consider the Small Scale Plan Amendment request; and Ordinance No. 04-1742 SPA 16-04 Page 1 of 3 WHEREAS, the City Commission held a public hearing December 20, 2004 and again on January 3, 2005, pursuant to the requirem~>nts of Chapter 163.3187, FS; and WHEREAS, the owners of the. subject lot nave completed a lot split to divide the property into two halves; BE IT SO ®~RDAINED BY THE CITY COMMISSION OF TIKE CITY OF LONGWOOD, FLORIDA, AS FOLLOWS: SECTION 1: The followingportions of thy. Future Land Use Map of the Comprehensive Plan are hereby amended to changf; the land use designation of the properties described as: The south 150 feet of 152 Lake Avenue (lot. 9) Property ID i# 05-21-30-512-OD00-0090 as depicted in EXHIBIT A, from. LOW DENSI'T'Y RESIDENTIAL (LDR) TO C:ENERAL COMMERCIAL ((iC); attached hereto as though fully contained herein. SECTION 2: Pursuant to the requirements of Chapter 163.3187 (3) [c], Florida Statutes, this Ordinance shall not take effect until thirty-one (31) days after City Commission adoption, unless an appeal has been filed within thzit time. SECTION 3: If any section or portion of a section of this Ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to invalidate or impair the validity, force or effect of any other section or part of this Ordinance.
