WHEREAS, the Florida Legislature has adopted revisions to Section 101.657 of
the Florida Statutes, said section relating to early. voting; and
WHEREAS, State Law allows the City of Longwood. to "opt out" of the
provisions of Section 101.657, the early voting requirements,. by adopting an ordinance
stating such intenl'; and
WHEREAS, on October 18, 2004, the City of Longwood adopted Ordinance No.
04-1723, which allowed the City of Longwood t~~ opt out and contract with the Seminole
County Supervisor of Elections to conduct early voting for the City of Longwood at the
Office of the Supervisor of Elections; and
WHERE~~S, the City of Longwood desires to conduct early voting at both the
Office of the Supervisor of Elections and at Lon~;vvood City Hall, Commission Chambers
and establish a tunefraine to conduct, early voting for the municipal election of 2005;
WHEREAS, Section 101.657, Paragraph (1)(b) of the Florida Statues, enables
early voting to be utilized but does not expressly ;apply to municipalities.
NOW, TB[EREFORE, BE IT OItDAI1vED BY THE CITY COIVIMISSI01v
OF THE CITY OF LONGWOOD, FLORI[DAu, AS FOLLOWS:
. Section 1. Chapter 7, Elections, Section 7-1, When election held, of the
Longwood City Code shall be amended to read as follows:

Regular city elections shall be h~;ld on the first Tuesday after the first
. Monday in November and shall be in the manner provided for in section 7-~11.

. the Floriida Statutes by adopting, ~in ,addition to the .regular voting date, the
following earlYvoting .days:
Friday, November 4th from 8:00 a.m. unti14:00 p.m.
Saturday, November 5th from fi:00 a.m. until 12:00 p.m.
Siunday, November 6t from 12:00 p.m. unti14:00 p.m.
M[onday, November 7t from 8:00 a.m. unti14:00 p.m.
Thhis ~ provision shall only apX~ly to the election of November 2005
unless readopted by the City Commission.
When any regular, special, or run-off city election is held on the same :day
an election is being conducted by the Seminole County Supervisor of Elections,
the term "city clerk," as stated in section 7-6 and 7-8, shall denote the "Seminole
County Supervisor of Elections." For all other elections the term "city clerk"
shall stand as written.
When any regular, special, or run-off city election is held on the same day
an election is being conducted by the Seminole County Supervisor of Elections,
the term "canvassing board' shall mean the: Seminole County Canvassuig Board
and the canvassing shall be conducted in accordance with the Florida. Election
Code. Four all other city elections, section 7-10 shall stand as written.
Section 2., Conflicts. Any and all ordinances or parts of ordinances in conflict
herewith be and the same are hereby repealed to the extent of the~conflict.
Section 3.. Severability. If any provisions of this ordinance or the application
thereof to any person or circrunstances are held invalid, the invalidity shall not affect
other provisions or applications of the ordinance which can be given effect. without.
. invalid provision or application, and to this end the provisions of this ordinance are
declared severable;.
Section 4. Effective Date. This ordinance shall take effect immediately upon its
adoption by the Ciity Commission of the City of Longwood, Florida.
