Resolution 06-1140RESOLUTION NO. 06-1140 A RESOLUTION OF THE CITY OF LONGWOOD, FLORIDA ESTABLISHING A SINGLE FAMILY AND DUPLEX DRIVEWAY ACCESS POLICY WHEREAS, one of the biggest eyesores on dirt streets was the accumulation and storage of junk or the operation of a commercial business behind someone's home; and WHEREAS, without defined boundaries on city streets, it was convenient to enter one's property from any direction; and WHEREAS, the City developed and implemented a residential street paving prototype for paving dirt streets; and WHEREAS, regulating the driveway access from any paved road to one's property will improve the overall appearance of city neighborhoods. NOW, THEREFORE, BE IT RESOLVED that the City Commission of the City of Longwood do hereby adopt the followin;) Single Family and Duplex Driveway Access policy: 1. Residential lots shall have a driveway access from one right of way. Once the designated driveway entrances have been established, no access shall be granted to another adjacent right of way. 2. If a property owner builds a detached mother-in-law suite and cannot access the structure for parking purposes from the property's designated driveway right of way; then a driveway access can be granted on an adjacent right of way as long as it does not create a safety hazard as determined by the. Police Chief. The property owner will be responsible for the full cost of the new adjacent driveway access constructed to city standards. 3. Two way access driveways that connect two city streets to a rear driveway shall be allowed provided that all design standards for :residential infill development are met. 4. A circular driveway shall be allowed on the front right of way, provided that the impervious surface ratio for the underlying :land use district is not exceeded. 5. If a property owner desires to park vehicles in the rear yard and cannot access the rear yard from the property's designated driveway right of way; then a driveway access can be granted on an adjacent right of way as long as it does not create a safety hazard as determined by the Police Chief. The property owner will be required to sign a driveway access agreement stating that the intended use will be for parking vehicles and will forfeit the driveway access for violating the agreement. The property owner shall be responsible for the full cost of the adjacent driveway access constructed to Resolution No. 06-1140 Page 2 of 2 city standards. The property owner shall also be responsible for the full cost for closing the driveway access, if found in violation of the agreement.
