Ordinance 05-1785 t~~,~-~- G4~- ®~~NANCE N®. 05-175 AN ORDINANCE OF THE CITY OF LONGWOOD, FLORIDA, A1VI:ENDING ORDINANCE 1`10. 1019, SAID ORDINANCE BEING THE COMPREHENSIVE PLAN FOR THE CITY OF LO~NGW00D, FLORIDA; SAID SMALL SCALE PLAN A1VI:ENDMENT (SPA 07-OS) CHANGING THE LAND USE DESIGNATION ON THE FUTURE LAND USE MAP OF THE C.O:MPREHENSIVE PLAN AT THE SOUTHERN RESIDENTIAL PORTION OF 'THE PROPERTY LOCATED AT 601. SOUTH GRANT STRI~ET FROM LOW DENSITY RESIDENTIAL (LDR) TO 1VIE]®IUM DENSITY RESIDENTIAL (MDR) PROVIDING FOR COPIFLICTS, SEVERABILITY AND EFFECTIVE DATE. WHEREAS, on July 20, 1992, the City of Longwood adopted its Comprehensive :Plan (Ordinance No. l Ol 9') .pursuant to the requirements of Chapter 163, Part II, Florida Statutes and Chapter 9J-5 Florida Administrative Code; and WHEREAS, on November 19, 1993 the Florida Department of Cormnunity Affairs determined the City's Comprehensive Plan was in compliance with the requirements of Chapter 163, Part II, Florida Statutes and Chapter 9J-5, Florida Administrative Code; and WHEREAS, Chapter 163.3174 (4) (a), Florida Statutes requires the Land Plaruling Agency (LPA) to make reconunendations to the governing hody regarding a~.nendments to the Comprehensive Plan; and WHEREAS, the LPA held a public hearing on December 14, 2005 to consider the Small Scale Plan. Amendment request; and Ordinance No. 05-1785 SPA 07-OS Page 1 of 3 WFIEREAS, the City Commission held a public hearing January 9, 2006 and again on January 16, 2006, pursuant to the requirements of Chapter 163.3187, FS; BE IT SO ORDAINED BY TIIE CITY COMMISSION OF TH[E CITY Ok' LONGWOOD, FLORIDA, AS FOLLOWS: SECTION 1: The following portions of the: Future Land Use Map of the Comprehensive Plan are hereby amended to change the land use designation of the properties described as: The southern portion identified as LDR on the FLUM of 601 Souf11 Grant Street Property ID 32-20-30-510-0800-0000 " as depicted in EXHII3IT A, from LOW DENSITY RESIDENTIAL (LDR) TO MEDIUM DENSITY RESIDENTIAL (1VIDR); attached hereto as though fully contained herein. SECTION 2: Pursuant to the requirements of Chapter 163.3187 (3) [c], Florida Statutes, this Ordinance shall not take effect until thirty-one (31) days after City Commission adoption, unless an appeal has been filed within that time. SECTION 3: If any section or portion of a sectio~i of this Ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to invalidate or impair the validity, force or effect of any other section. or part of this Ordinance. CONCU:RRENCY: There are no outstanding concurrency issues to be addressed at this time. STAFF ANALYSIS: The property is a single parcel with two existing Land Use Designations- LDR and GC. The LDR land use designation begins approximatel;~ 200 feet south of the SR 434 right of way line. The City of Longwood Comprehensive Plan, Future Land Use Element, provides a number of policies and objectives intended to retain conunercial and industrial uses in their current locations. There; are not specific policies that would prohibit or encourage the conversion of one residential designation to another. The City Conunission should consider existing development patterns, protection of community identity,. environmental and aesthetic concerns, and proper land use applications in snaking its decision. Increases in residential density in urbanized areas sire also a matter of community and regional goals regarding Smart Growth and urban sprawl. RECOMMEN:®ED ACTION: The Community Development. Division reconunends that. the City Commission analyze the ~ proposed Land 'Use Change for consistency with the Comprehensive Plan and the City's planning goals.
