AN ORDINANCE OF THE CITY OF LO1vGWOOD, FLORIDA,
AMENDI(rTG THE .LONGWOOD DEVELOPMENT CODE, SECTION
8.6.0 lEIVTITLED "HISTORIC ]PRESERVATION BOARD" AND
SECTION 10.3.0 ENTITLED "HI:STORIC OVERLAY DISTRICT";
PROVIDING FOR CONFLICTS, CODIFICATION, SEVERABILIT'Y
AND E1±1?ECTIVE DATE.
WHEREAS, on May 6, 2002, the City Commission of the City of Longwood adopted
the Longwood Development Code (Ordinance 02-1599), as was amended from timE; to time,
pursuant to the requirements of Chapter 163.3202, and Chapter 166.041, Florida Statutes; and
WHEREAS, Chapter 163.3174 (4) (c), Florida Statutes, requires the Land Planning
Agency to reviE;w proposed land development regulations, or amendments thereto, for
consistency with the adopted Plan, as may be arr?ended; and
WHEREAS, the Land Planning Agency (LPA) held a public hearing on March. 16, 2006
~ to consider the arnendment of the Longwood Development Code; made certain findings of fact
regarding said amendments, determined the proposed changes are consistent and recommended
the proposed ordinance be adopted by the City Commission;
NOW, THEREFORE BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF LONGWOOD, FLORA, AS FOLLOWS:
SECTION 1: Longwood Development Code ~~rticle VIII be amended to repeal Section 8.6.0
entitled "Historic Preservation Board" in its entirety, and the remaining Sections be renumbered
to reflect the removal
SECTION 2: Longwood Development Code Section 10.3.0 entitled "Historic Overlay
District" be repealed, and a new Section 10.3.0 entitled "Historic Overlay :District" be added to
read as follows:

10.3.0 HISTORIC OVERLAY DISTRICT
10.3.1 Generally
A. A~~plicabilit
All property within the Historic Overlay District as identified on the adopted Future Land Use
Map shall be subject to the. requirements of the Historic 'District Codebook.
B. Procedure
1 All new construction, additions, altersitions or demolitions in the Historic District
shall be reviewed for compliance with the Historic District Codebook by the Ccmmunity
Services Department.
2 An a ?plicant or substantially affecte~erson may appeal a final .decision of the
Community Services Department directhr to the City Commission b~filing a notice. of
appeal with the Department within fifteen working days of the decision.
3 [n the .event of a variance request to any of the regulations defined in the Lon.~wood
Historic District Codebook for either contributing or su~portin~ structures, the C~
Commission shall hold a hearing on the matter pursuant to the procedures in Section
10.9.0 of this Article
4 The a plication for demolition of any contributing structure in the Historic District
shall be considered by the City Commission and comply with the standards for
demolition of contributing structures as they appear in the Historic District Codebook.
5 All records concerning the Historic District shall be maintained permanently by City
staff.

~ 10.3.2. Hearing by City Commission
In the event of an appeal, a request to demolish. a contributing structure, or a variance request
to the requirements of the Historic District Codeboo the City Commission shall hold a hearing
in accordance with the procedures set forth in SFaction 10.9.0 of this Article.
The decision of the City Commission shall constitute a final action for the City and may,
thereafter, be avpealed to. Circuit Court in accordance with Florida Law.
10.3.3 Notice
A. Hearing by City Commission
The site shall be hosted in accord with Section 10.0.6 of this Article.
- SECTION 3: All Ordinances, or parts thereof in conflict herewith, be and the same are hereby
repealed.
SECTION 4: The provisions of this Ordinance are declared to be separable and if any section,
paragraph, sentec~ce or word of this Ordinance or the application thereto any person or
circumstance is held invalid, that invalidity shall not effect other sections or words or
applications of this Ordinance.
SECTION 5: This Ordinance.shall take effect irnmediately upon its adoption.
