WIIEREAS, on July 20, 1992, the City of I~oilgv~~ood adopted its Comprehensive Plan
(Ordinance No. 1019) pursuant to the requirements of Chapter 163, Part II, Florida Statutes and
Chapter 9J-~ Florida Administrative Code; and
i~IIEREAS, on November 19, 1993 the Florida Department of Conununity Affairs
deternlined the City's Comprehensive Plan was uz compliance with the requirements of Chapter 163,
Pa~•t II; Florida Statutes and Chapter 9J-5, Florida A.dnunistrative Code; and
WIiEREAS, Chapter 163.3174 (4) (a), Florida Statutes requires the Land Planning Agency
(LPA) to make recommendations to the govenung body regarding amendments to the Comprehensive
Plan: and
V6j>rIEREAS, the LPA held a public hearing on May 10, 2006, to coizsider the Small Scale
Plan Amendment request; and reconunended the proposed Small Scale Plan Amendment (SPA 04-
O6) be approved by the City Conunission; and

SECTION B: Pursuant to the requirements of C1lapter 163.3187 (3) [c]„ Florida
Statutes, this Ordinance shall not take effect until thirty-one (31) days after City Conunission
adoption, unless an appeal has been filed within that time.
SECTION 3: If any section or portion of a section of this Ordinance proves to be
invalid, unlawful or unconstitutional, it shall not be held to invalidate or impair the validity,
force or effect of any other section or part of this Ordu1a~~ce.
