WHEREAS, the City Clerk's Office receives requests for outstanding lien searches on individual parcels within the City boundaries to determuie if City liens, special. assessments, utility balances, fees or fines exist on certain parcels of real property; and . WI~REAS, each individual outstanding lien search entails searching for, duplicating, E faxing, and providing a letter describ°ng the records found, if any; and ~ WHEREAS, staff time exceeds over thirty minutes for each individual request requiring extensive use of clerical or supervisory assistance to fulfill each request; and WHEREAS, the City Commission of the City of Longwood desires to amend the City's Code of Ordinances to provide for a special service fee for outstanding lien se~axches; and WHEREAS, Florida Statute § 166.201 authorizes a municipality to raise fees an amount of money which is necessary for the conduct of municipal government; and WHEREAS, Florida Statute §.119.Oi'(4)(d) authorizes an agency to charge a special service fee, in addition to the actual cost of dupplicatinn, if the nature or volume of public ,records requested to be inspected or copied is such as to require extensive clerical or supervisory assistance by personnel of the agency involved. Such special service fee shall be reasonable and shall be based. on the cast incurred for suchh extensive use of the labor cost of Ordinance No. 07-1832 Page 1 of 3 the personnel providing the service,. that is actually incurred by the agency or attributable. to the agency for the clerical and supervisory assistance required; and - . ' ~ WHl~REAS, the City Commission hereby finds that the special service fee is reasonable and is. based on. the cost actually incurred by the _ City -for such.' extensive use of staff and resources. - - - _ - SNOW, • ~THEIZEFORE BE IT .ORDAINED SY 'fHE CI'T'Y C~1VIlVIISSION Og' THE CTIY OI+' I,~NGWOOD, FLORID, AS I+'(~~LOWS: ~ ~ SECTI®N 1: In Article VII, "Administrative Costs and Fees", Section Z-425, Special Service Fees is hereby added to read as follows: Special Service Fees: A fee of $15.00 shall .be charged per research•request for each parcel of real property requiring a search of the City's off cial records a12d production of a City Lien Report . • identifying, any .outstanding;~liens,, special -assessments, ,utility balances, fees and fines v that are reasonably ascertainable, .a The,form of-the report shall be in the manner pre- scribed by the City Clerk and copy shall be filed with the City Clerk's Office. SECTION~2: Conflicts.. Any and all. Ordinances or parts.of Ordinances in conflict herewith be and the same are hereby repealed. SECTION- 3:. 5everaUility. In the event that any ,portion or, section of this Ordinance is determined to be invalid, illegal or unconstitutional by a court of competent jurisdiction, such as decision- shall• in brio manner affect the remaining portion's or sections of this' Ordinance, which shall remain infull force and effect. ~ ~ ~ ' - SECTION 4: Effective. Date.
