AN ORDINANCE OF CITY OF L,ONGWOOD, FLORIDA,
RESI~~RVING SECTION 34-34 IN CHAPTER 34 ARTICLE II;
CREATING AR'T'ICLE III SECTION 34-35 OF THE CITY CODE
OF ORDINANCES WHICH EST~~BLISHED AND IMPLEMENTS
A PROGRAM TO IMPOSE AND COLLECT USER FEES FOR
THE DEPLOYMENT OF EMERIsENCY SERVICES RENDERED
BY THE CITY OF LONGWOOD FOR MOTOR VEHICLE
ACCIDENTS; PROVIDING D,IRI~CTIONS TO THE CODIFIER;
SEVF'.RABILITY AND AN EFFECTIVE DATE.

WHEREAS, demands on the City of Longwood Fire and Police Departments
to respond to vehicular accidents continue to increase due to .growth; and
WHEREAS, the City of Longwood Fire and Police Departments
have investigated different methods to maintain a high level of quality for fire and police
emergency services throughout times of constantly increasing service demands, and maintaining
an effective respon;;e by the fire and police departments decreases the costs to insurance
companies by saving lives, preventing serious injury and minimizing vehicular damage by fire;
and
WHEREAS, raising the real property tax t~~ meet the increase cost for service demands
would be inequitable to property owners when~a majority of motor vehicular accidents involve
individuals who neither own property nor pay property taxes in the City of Longwood; and
WHEREAS, the City Commission desires to implement a procedure by which to recover
the cost for motor vehicle accidents and establilsh a billing system in accordance with state and
federal laws, regulations, and guidelines;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
LONGWOOD, FLORIDA:
Section 1. Reserve
Chapter 34, Article II section 34-34 is hereby reserved.
Section 2. Creation ~
There is hereby created Article I[I section 34~-35 of City of Longwood Code of
Ordinances, which is to read as follows:

Article III Cost Recovery
Section 34-35. User Fees for Deployment of Emer~ency Services.

(a) The fire and police departments shall initiate user fees for the delivery of fire
and police department services, personnel, supplies, and equipment to the scene of motor
vehicle accidents which occur within the corporate limits of the City of Longwood or to
which the fire and/or police department respond in the unincorporated areas of Seminole
County pursuant to mutual aid agreements. The rate of the user fees shall be the usual,
customary and reasonable costs, which includes any services, personnel, supplies, and
equipment and which may vary based on the needs of the accident.
(b) The user fees shall be initially filed to the responsible motor vehicle insurance
carrier, representing anadd-on-cost of the. claim for damages of the vehicles, property,
and/or injuries. The claim costs shall also be filed to the owner of the vehicle, the owner
of responsible property, or other responsible parties.
(c) Any vehicle(s) that is registered to any person, business, corporation or entity
whose address is within the incorporated limits of the City of Longwood is exempt from
user fee assessment. Also exempt are registered government vehicles of political
subdivisions that have provided reciprocity to the City of Longwood.
' (d) The city administrator may make rules or regulations, and periodically may
amend, revoke, or add rules and regulations, not inconsistent with this article as may
deem necessary or expedient with respect to billing for these fees or the collection ~
thereof.
(e) All amounts collected as a result of this ordinance shall be placed into the ~
general fiord budget.
(f) The rate schedule for the calculation of user fees for the delivery of fire and
police department service, personnel, supplies and equipment to the scene of motor
vehicle accidents are listed in exhibits A and B.
(g) The rate schedule attached to this ordinance is made a part of this ordinance. ~
Section 2. Directions to Codifier.

It is the intention of the City Commission of Longwood that Section 1 of this
ordinance shall become and be made part of the City of Longwood Code of Ordinances,
and that the sections and paragraphs of this ordinance may be re-numbered or re-lettered
in order to accomplish such intentions.
Section 3. Severability.
If any subsection, sentence, clause, phrase, or portion of this ordinance is for any
reason held or declared to be unconstitutional, invalid, or void,. such holding or invalidity
shall not affect the remaining portions of this ordinance, and the unconstitutional, invalid
or void provisions shall be deemed to have been severed here from, and the remainder of '
this ordinance, after the exclusion of such part or parts, shall be deemed to be valid, as if ~
such part or parts has not been included herein. If this ordinance or any provisions hereof
shall be held inapplicable to any person, group of persons, property, or kind of property, ~

circumstances, or set of circumstances; such holdings shall not affect the application
~ hereof to any other person, property, or circumstances.
Section 4. Effective Date.
This ordinance shall become effective upon adoption.
