RESOLUTION NO. 07-1161
A RESOLUTION OF THE CITY OF LONGWOOD,
FLORIDA SUPORTING THE SEMINOLE COUNTY
PUBLIC SCHOOL DISTRICT'S INITIATIVE TO
UPDATE SCHOOL ' IMPACT FEES' ' AND
ENCOURAGING THE: ;SEMINOLE : COUNTY
BOARD OF COUNTY COMMISSIONERS TO
ADOPT SAID SCHOOL IMPACT FEE UPDATE;
PROVIDING FOR CONFLICTS, SEVERABLITY,
AND EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Longwood recognizes that
quality public schools enhance the quality 'of life of City residents and the opportunities
of our children to be successful in life; and
WHEREAS, the Seminole County Public School District has *a proven track
record of excellence in the provision of a quality education to children within Seminole
County and the City of Longwood; and
WHEREAS', School impact fees assist the School District in funding its capital
improvements program to construct- the necessary public school facilities to meet the
demands of the County's growing population; am
WHEREAS, School ihipact • fees were -adopted in, 1992 .acid have not been
updated to keep pace with'the impacts of Seminole County's growing population; and
WHEREAS, the School- District retained the firm, TischlerBise Fiscal, Economic
& Planning Consultants, Inc. to study theneed-to update the School District's. existing
school impact fees; and
WHEREAS, the firm TischlerBise Fiscal, Economic & Planning Consultants,
Inc., has prepared a technical report that proposes a school impact fee schedule of $5,342
per Single Family Detached dwelling unit; $2,564 per Town Home dwelling unit; $2,340
per Multi -Family dwelling unit; ankh $2,005•per Mobile Home dwelling unit; and
WHEREAS, the City Commission of the City of Longwood has determined:
1. that the proposed impact fee, schedule is necessary to help offset the costs
to the School District associated. with meeting the necessarypublic school
service and facility demand created by projected new residential
development;
2. that the amount of the proposed school impact fee schedule. bears a
reasonable relationship to the burden. imposed on the School District to
provide the new public school facilities by new residential development;
3. that the expenditure- of .the proposed school impact fees will result in a
beneficial use to such new residential development reasonably related to
the impact fees, per dwelling unit;
4. that an.. "essential nexus exists between, the projectednew residential
development and the need for additional public school facilities to be
funded via the proposed school impact fee schedule; and
5. that. the amount of the. proposed school impact fees is "roughly
proportionate" to the fair share of the additional public school facilities
needed,to :provide adequate service to -new residential development.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF LONGWOOD, FLORIDA, AS FOLLOWS:
SECTION 1. The City Commission of the City of Longwood hereby supports the
Seminole County Public School District's initiative to update school impact fees.
SECTION -2.:.The. City. Commission of the City of .Longwood. encourages the
Seminole County Board .of -County CQn1missioners :to adopt said school impact fee
update. ;
SECTION 3. Conflicts: All resolutions or parts of resolutions in conflict with
any 'of the provisions: of :this resolution are herebycrepealed.
SECTION 4. Severability. If any section or portion of a section of this resolution
proves to be..iiivalid, unlawful; or unconstitutional, it shall not, be held to invalidate or
impair the validity, force, or effect of other' section or part -of tlus.resolution. ,
SECTION .5. Effective Date. This ,resolution.;shall,take effect immediately upon
its passage by the City Commission of the City of Longwood, Florida.,
