Ordinance 08-1868ORDINANCE N0.08-18b8 AN ORDINANCE OF THE CITY OF LONGWOOD, FLORIDA, AMENDING ORDINANCE NO. 08-18b1 AND PROPOSING TWO ADDITIONAL AMENDMENTS TO THE CHARTER OF THE CITY OF LONGWOOD, FLORIDA, PURSUANT TO ARTICLE III, SECTION 3.01 (e} AND ARTICLE VIII, SECTION 8.03, PROVIDING THAT SAID PROPOSED AMENDMENTS BE SUBMITTED ON THE BALLOT TO THE VOTERS AT THE NEXT GENERAL ELECTION ON TUESDAY, NOVEMBER 4, 2008, PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. WHEREAS, the City Commission of the City of Longwood adopted Ordinance No. 08-1861 on March 3, 2008 that approved three amendments to the Charter of the City of Longwood to be submitted to the voters of the City of Longwood at the next General Election on Tuesday, November 4, 2008; and WHEREAS, the City Clerk and City Attorney have deemed it necessary for the City Commission to consider submitting two additional amendments to the Charter of the City of Longwood in order to comply with Florida Statutes; and WHEREAS, if the City Commission approves the two additional amendments, the proposed amendments to the City Charter of the City of Longwood will be submitted to the voters of the City of Longwood at the next General Election on Tuesday, November 4, 2008. NOW, THEREFORE, BE TT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LONGWOOD, FLORIDA, AS FOLLOWS: SECTION 1. The following amendment to the Charter is submitted to the voters as follows: CHARTER AMENDMENT #4 Article III, Section 3.01 (e), Oath of Office is amended to read as follows: The oath of office shall be as follows: City of Longwood Ordinance No. 08-18b8 Page 1 of 3 ~~ I, DO SOLEMNLY SWEAR (OR AFFIRM) that I will support, protect and defend the Constitution and Government of the United States and of the State of Florida; that I am duly qualified to hold office under the Constitution of the State. and that I wilt well and faithfully perform the duties of (Office) on which I am now about to enter, so help me God. Key: Delete, Bold & Strikethrough Insert, Bold & Underline CHARTER AMENDMENT #5 Article VIII, Section 8.03, Form of Ballots, is amended to read as follows: A Charter amendment to be voted on by the City shall be presented for voting by ballot title and shall be a clear, concise statement describing the substance of the measure without argument or prejudice. u ." Immediately below such _... question shall appear, in the following order, the word "Yes" and also the word "No" with a sufficient blank space thereafter for the placing of the symbol "X" to indicate the voter's choice or with a lever opposite "Yes" or "No" if voting machines are used. The proposed amendments to the Charter of the City of Longwood as set forth above shall be individually placed on the City ballot and submitted to the voters at the next General Election on Tuesday, November 4, 2008. The voters shall have an opportunity to vote on the proposed amendments to the Charter, which proposed amendments shall be placed on the ballot individually, and the Charter of the City of Longwood, Florida shalt be amended pursuant to the proposed amendments receiving a majority of votes cast and shall become effective upon passage of the specific amendments. SECTION 3. The provisions of the Ordinance are declared to be separable and if any section, sentence, clause, or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clauses, or phrases of this Ordinance but they shall remain in effect, it city of Longwood Ordinance No. 08-1868 Page 2 of 3 being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. SECTION 4. All Ordinances or parts of Ordinances in conflict herewith be and the same are hereby repealed. SECTION 5. This Ordinance shall become effective immediately upon its passage and adoption.
