CEB_07-22-03_MinP REPORTS: CASE UPDATES: A. CEB 02-01-96 Manuel Toro & Dora C. De Toro, Prop. Owners 11 1 Pawline St. Longwood, FL 32750 An update of the case was given by Inspector Cathy Price. She advised the Board that this property was in compliance. B. CEB 02-09-268 Gui Lin Liu & Shuang Yu Lau 502 Freeman St. Longwood, FL 37250 This case was first presented at the 5/27/03 mceting at which time it was brought before the Board n ith an Order to Impose. the property owner was unable to present evidence, that the property had been graded and had been restored to its original condition as -required by the final orders. As of this date there has been no contact between the Planning Division. the City Engineer and the respondents, therefore the City requested the Board that the Order to Impose be recorded. Order to Impose to be changed to reflecl the correct amount of the lien. There were two separate fines. one for the slab and one for the grading. The slab has been removed. The amount for the slab which is no\\. in complian?ce would be $5.200.00 and the fine for the grading continues at SjO.OO/day, \vhich to date is S13.150.00. The Order to Continue Lvas served on T. Lau on July 1 1, 2003 at 7:00 PM by Longwood Police Officer Joseph Hasheider. Respondents were not present. A motion to close the Public Hearing was made by Les Sinmonds, seconded by Andrew McGany. Andrew McGarry made a motion to record the lien on the property. seconded by Laura Moehlenkamp. The Board voted 6-0. Luis Alvarado abstained since he was late arriving at 7:05 PM. C. CEB 03-03-298 Ethel E. Schuette Heirs & Jewel1 Ann Schuette, Prop. Owners 899 Lormann Circle Longwood, FL 32750 The City is requesting the Board that the Order to Impose be recorded on this case. The property owner was ordered by the Board on 3/25/03 to remove the weeds and contact -the Code Inspector when in compliance. As of this date the Code Compliance Inspector has not been contacted by the property o\\ner. An inspection of the property was done on 5/12/03 and the property was still not in compliance. Notice of Hearing was mailed on P 7110103 certified mail and a copy first class mail on 711 1/03. the return receipt was received signed by Mr. D. McBrayer on 711 1/03 mailed to 433 W. Crystal Dr. in Sanford. The Ordcr was imposed on 5/9/03 at $1 5.001per day. Mr. Douglas McBrayer stated that Jewel1 Schuette, his sister in law, has been in a nursing home for about 5 years, and he has taken care of the property at 899 Loimam Circle as best as he could but it is a hardship for him due to the driving distance and the rain season. Hc was asked by Laura Moehlenkamp if he was not aware that he had to contact the Code Inspector when the grass was mowed. he stated he was not aware of it. He was also reminded about the Order that was mailed to him and that the issue was about weds not mowing the lawn at which ans~veredth at the lawn is being mowed every couple of weeks and the weeds cleared with a iveed eater. CEB 03-03-299 Dorothy L. Fry, Trustee, FBO Dorothy L. Fry, Prop. Owner 105 Shady Ln. Longwood, J?L. 32750 This case was brought before the Board with a request to record the Order to Impose. C. The respondent was cited for improper screening of an RV, which is a violation of City Code, Chap. 22, Sec. 22-33. The case was taken to the Board on 3/25/03, the respondent was found guilty, givcn 30 days from the date of service to comply and also ordered that the respondent contact the Code Conlpliance Division when con~pliancew as met and no contact has been made by the respondent. The property was inspected on compliance date 5/30/03 and the RV was in the driveway at that time. The Notice of Hearing to Impose the Lien was served on -Mrs. Fry by Longwood PD Officer Joseph Hasheider on 711 1/03 at 8:05 P.M. Mrs. Fry spoke, stated other parking had been arranged in her back yard which is all fenced in for the RV and it cannot be seen from the street. Amy Goodblatt asked Mrs. Fry if she had notified ihe Code Compliance Division within 30 days when she was sewed with the order to come into compliance. She stated she had not accepted the order but rather wrote in the envelope that she was returning the order and that other parking had been arranged. Laura Moehlenkamp made a motion to close the Public Hearing. seconded by Les Simrnonds. Andrew McGarry made a nlotion to record the lien. seconded by Luis Alvarado. Chairman Lomas asked if there was any discussion. Laura Moehlenkamp asked if this property was in compliance. Amy Goodblatt stated that the City would have to inspect the property to deterniine if in fact is in con~pliancea dvising the Board accordingly. All voted in favor. CEB 03-07-322 Wanda L. & Gregory Demas 487 E. Maine Ave. Longwood, FL 32750 Inspector Cathv Price presented this case in\-olring 1-iolations for Work Done n-ithout Permit and Pool Fence. Inspector Price adviscd she received a complaint about an abol-e ground pool in rhe back yard of rhe propcq-as sho\rn in the phorographs taken from Granr Srreet as evidence. This propcrh is not complcrclj fenced in. therefore therc is access to the pool from Granr St. Nonce of Hearing qemce was attempted but, rhc property was posted on 7/11 /03 at 10:29 -4hl and also ar Ciry Hall. l'he Sotice of \Tiolation n-as issued on 6/28/03 to comply by 7/5/03. Kouce of Kon Compliance was issued 7/8/03 to comply by 7/9/03. Respondents were not present. Chairman Rob Lomas expressed lis concerns about a child accessing this pool from the open area, -\my Goodblatt suggested that this siruation be found as serious, imminent danger. Shc proposed having an emergency meeting mith the property owners to make them aware of the situation. After some dscussion Commander Yelvingron present ar the meeting was requested to have the Sotice of Hearing delivered to the respondents Immedmely so that thcy could attend this meering. indrew I\lcCk-n made a motion to proceed nith this, seconded by Clarence Lane. ,\11 in faror. llceting resumed at S:30 Phl Mr. Demas spoke. stated the pool --as put in about 8 years ago. the back n-all. the wesc side and d ~ne\-o fronts facing south are all 6 ft. fenced. The east side does nor has-e fenckg, because it backs up to his neighbor's propcm-and every time he mentioned to them abouc putting up a fcncc thcy have been very negati~ea bout it, but hc is milling to comply or remove the pool. --\mr-Goodblatt asked 5Lr. Demas how long did he estimate ir would take him to put up this fcncc. since he had to obtain a permit h s t for the fence or take the pool down. He sraced within 2 weeks. City Attornev suggested Mr. Demas places temporary barriers in the interim. or remove the ladder. Mr. Demas stated that the Gont part of the ladder is remm-ed. so it does not touch the ground. The ladder is on the side ot the house, and in order to remove it \vould ha\-e to be taken off a hook, lifted and brought down.
