CALL MEETING TO ORDER1 ROLL CALL: Chairman Lomax called the meeting to order at 7:00 p.m. The Recording Secretary called the roll. City of Longwood Attorney swore the respondents in. 2. APPROVAL OF MINUTES: The minutes from the July 27, 2004 meeting were presented. Mern ber Alvarado moved to approve the minutes. Szconded by Member McGarry, the recording secretary stated that there were some mistakes in the minutes and was going to fix them and reseen them out. Code Board Attorney Goodblatt, had additional changes that needed t?o be made. CEB 08-28-0411 3. REPORTS-CASE UPDATES: Lieutenant Yelvington stated that Conway BBQ (04-05-380) has made no contact with the city to bring their property into compliance. Code Board asked that this case be brought back at a later date, for the purpose of allowing the attorneys time to review the case facts. 4. PUBLIC HEARING: A. CEB 04-08-397 BAEZ/Rodri q uez 434 Longwood Circle Longwood, FL 32750 Code Compliance Inspector Price reported tnat Code Compliance Inspector Howington cited this property on Jcly 07, 2004 under City Code Chapter 22, Section 22-28, Inoperable Vehicle; City Code Chapter 12.5 Outdoor Storage; City Code Chapter 12, 12-2(1) Grass and Weeds over 10". She revisited the property on July 14, 2004; Notice of Hearing was sent Certified Mail tc the property olrvner. Notice of Hearing was served on Lillian Kodriquez signed by son Danie! Carnacho, Daniel is under age, so proper service on the tenant was not done by the Longwood Police Department. The city requests the respondents be found guilty of violation of City Code Chapter 22, Section 22-28, Inoperable Vehicle; City Code Chapter 12.5 Outdoor Storage; City Code Chapter 12, 12-2(1) Grass and Weeds over 10 the city recommends a $100 Administrative fee. In support of this motion he asked the board find the following facts occurred; the grass and weeds are in excess of lo", Household furniture1 appliances stored outside between house and, inoperable vehicle in side yard, vehicle parked in yard on North side of the house, high grass around it, algae and pine needles or! the vehicle. He further moved to give the property owner Ten CEB 08-28-0412 days from the date of service of final orders to bring the property into compliance or a penalty of $50 a day will be imposed for each and everyday of non compliance. In support of -th~sm otion he asked the board find the following facts occurred; RV parked in respondents driveway for a few days, moved to driveway of 102 Seedling Ct., a couple of houses down for a few days, then moved back to this driveway. RV bebngs to respondent. He further moved the property is riOW in compliance, no fine is imposed, administrative fee of $50. Allen Lane, property owner; told the board that he gave that car to a charity and they came and picked it up, so therefore the property is in compliance. He further moved the property is now in compliance, no fine is imposed, no administrative fee. In support of this motion he asked the board find the following facts occurred; there has been a commercial van parked in the driveway at this residence in violation of the parking and screening requirements. He further moved the property is now in compliance, no fine is imposed, no administrative fee. Longwood, FL 32750 Code Compliance Inspector Price reported she cited this property on July 24, 2004 under City Code Chapter 22, Section 22-32 Commercial Vehicle. Code officer ordered an immediate compliance due to prior violations. Notice of Hearing was served on Dcniel Bales at 12:21 p.m. on August 7,2004 by Officer Ladoczky of the Longwood Police Department. CEB 08-28-045 Member Alvarado moved, based on the evidence and the testimony, to find the respondent not guilty of City Code Chapter 22, Section 22-32 Commercial Vehicle, seconded by Member McGarry. Motion failed by a 2-2 roll call vote with Chairman Lomax and Member Simmonds voting nay, with Vice Chair Moehlenkamp absent, Member Greenhalgh absent, Member Tolos absent. Member Simmonds moved, based on the evidence and the testimony, to find the respondent guilty of City Code Chapter 22, Section 22-32 Commercial Vehicle. In support of this motion he asked the board find the following facts occurred, there is a large enclosed van parked in the street in front of the house. No fine is imposed, no Administrative fee. Seconded by Member McGarry and motion carried by a 3-1 roll call vote with Member Alvarado voting nay, with Vice Chair Moehlenkamp absent, Member Greenhalgh absent, Member Tolos absent. F. CEB 04-08-405 MEREDITHIBarbara; VEDNERlBrian 989 Wildflower Way Longwood, FL 32750 Code Compliance Inspector Price reported she cited this property on July 31,2004 under City Code Chapter 22, Section 22-32 Commercial Vehicle. Stacey Meredith, property owner, told the board that he has moved his commercial vehicle to a storage facility and his boss has been picking him up. Briar! Vedner business owner told the board that he has moved the vehicle and would like to know if they can cover the vehicle so his employee can drive his van home.
