APPROVAL OF MINUTES: The minutes from the August 24,2004 meeting were presented. Member McGarry moved to approve the minutes, seconded by Ms. Moehlenkamp. Ms. Goodblatt, the Code Board Attorney stated that the cases that were withdrawn from the meeting were not stated in the minutes. Mr. McGarry amended his motion, and Ms. Moehlenkamp amended her second. 3. REPORTS-CASE UPDATES: 4. PUBLIC HEARI?NG: City Attomey conducted the swearing in of witnesses. 5. OLD BUSINESS: CEB MEETING 10R6104 6. NEW CASES: A. CEB 04-05-380 Conway BBQ 300 S. H w1~7-9 2 Longwood, FI 32750 Lt. Yelvington stated that the City wanted to vacate the final orders of July 8th 2004 due to the conflictive LDC Language of Section 1.4.2 C and to find this property in Compliance. Amy Goodblatt the Code Enforcement Board Attorney stated that all the order required was to meet with planning to decide on a color palate and its cost to paint. A meeting was all that was required if the City determined they didn't have to paint, that brings them into compliance. The City of Longwood withdrew this case from the agenda. B. CEB 04-10-407 GRANT 61 0 N. Grant St. Longwood, FI 32750 Code Compliance Inspector Howington reported she cited this property on May 11, 2004 under CC, Chap. 22, 22-33 Storage of Boat, RV, and Trailer. She also cited the property on January 29,2004 under CC, Chap. 12.5 Outdoor Storage. She revisited the property on May 18, 2004 for the boat and it was not in compliance. She revisited the property on February 5, 2004 for the outdoor storage and it was not in compliance. Notice of Hearing was served on October 2,2004 by an officer of the Longwood Police Department. The city requests the respondents be found guilty of violating City Code Chap. 12.5 outdoor storage and City Code Chap. 22, 22-33 storage of Boat, RV and trailer. The city recommends that an Administrative fee of $1 00.00 be imposed. Code Inspector Howington answered questions from the Board Members. James and Lillian Grant, Property Owners of 61 0 N. Grant St, spoke in reference to this violation. Member Les Simmonds moved to dose the public hearing. Seconded by Member Jack Greenhalgh and carried by a unanimous voice vote with Member Tolos Absent. Member Les Simmonds moved, based on the evidence and the testimony, to find the respondents guilty of violating City Code Chap. 22, 22-33 Storage of Boat, RV, and Trailer and City Code Chap. 12.5 Outdoor Storage. In support of this motion he asked the board find the following facts occurred. The air boat was located in the front yard of the home. There were appliances, furniture, boxes, etc. stored on the carport visible from the street. He further moved an Administrative fee of $50 and no fine will be imposed at this time. CEB 04-10410 ROUSElJeffrey 677 Seminole Ave Longwood, FI 32750 Code Compliance lnspector Howington reported she cited this property on July 07, 2004 under CC, Chap. 22, 22-33 Storage of Boat, RV, and Trailer; CC, Chap.10 Occupational Licenses. She revisited the property on August 07, 2004 for the trailers and occupational licenses and they weren't in compliance. Notice of Hearing was served on October 2, 2004 by an officer of the Longwood Police Department. The city requests the respondents be found guilty of violating City Code Chap. 10 Occupational Licenses and City Code Chap. 22, 22-33 storage of Boat, RV and Trailer. The city recommends that an Administrative fee of $100.00 be imposed and to give the respondents 5 days to comply from the receipt of final orders or a fine of $50.00 per day per violation be imposed until the property is in compliance. Member Luis Alvarado moved, based on the evidence and the testimony, to find the respondent guilty of violating City Code Chap. 22, 22-33 Storage of Boat, RV, and Trailer and City Code Chap. 10 Occupational Licenses. In support of this motion he asked the Board find the following facts occurred. There were 3 trailers at this location, two were utility type and one was a camper. A lawn maintenance business was being operated, no occupational licenses. He further moved an Administrative fee of $100.00 be imposed and to give the respondents 5 days from the date of service to bring the property into compliance or a fine of $50.00 per day will be imposed for each violation. Seconded by Vice Chair Laura Moehlenkamp and carried by a unanimous roll call vote with Member Tolos absent. D. CEB 04-1 0-409 EADSlKenneth 527 Southport Dr. Longwood, FI 32750 Code Compliance lnspector Howington reported she cited this property on August 13, 2004 under CC, Chap. 22, 22-33 Storage of Boat, and RV. She revisited the property on August 20, 2004 for the trailers and it was not in compliance. Notice of Hearing was served on October 3,2004 by an officer of the Longwood Police Department. The city requests the respondents be found guilty of violating City Code Chap. 22, 22-33 storage of Boat, RV and trailer. The city recommends that an Administrative fee of $1 00.00 be imposed and to give the respondents 3 days to comply from the receipt of final orders or a fine of $50.00 per day per violation be imposed until the property is in compliance. V, 5.3.1 Fence around pool. She revisited the property on September 21,2004 and the property was not in compliance. Property was posted on October 13, 2004. The city requests the respondents be found guilty of violating City Code Chap. 12, 12-2(1) Grass and weeds over 10" and LDC, Art. V, 5.3.1 Fence around pool. The city recommends that an Administrative fee of $100.00 be imposed and to give the respondents 5 days to comply from the receipt of final orders or a fine of $50.00 per day per violation be imposed until the property is in compliance. V, 5.3.1 Fence around pool. In support of this motion he asked the board find the following facts occurred. She revisited the property on August 7, 2004 and the property was not in compliance. Notice of Hearing was served on October 2, 2004 by an officer of the Longwood Police Department. The city requests the respondents be found guilty of violating City Code Chap. 22, 22-33 storage of Boat, RV and trailer; CC, Chap. 12, 12-2(2) Accumulation of Trash and Debris. The city recommends that an Administrative fee of $100.00 be imposed and since the property is in compliance now the city is requesting no fine. In support of this motion he asked the board find the following facts occurred. The old fence was taken down and left in back yard. The trailer was parked in side yard but not properly screened. She revisited the property on September 23, 2004 and the property was not in compliance. Notice of Hearing was sent Certified Mail on October 1, 2004 and signed and returned on October 5, 2004. The city requests the respondents be found guilty of violating City Code Chap. 12, 12-2(1) Grass and Weeds over 10". The city recommends that an Administrative fee be waived, CEB MEETING 10126104 Pape-5 and give the respondents 10 days from the date of service to come into compliance or a fine of $25.00 a day for each and everyday of non compliance.
