Warren Ave Longwood FL, 32750 February 22,2005 Present: John "Bob" Lomax, Chair Ernest Tolos, Vice Chair Jack Greenhalgh, Member Andrew McGarry, Member Randy Porter, Member Also Present: Amy Goodblatt, Board Attorney Richard Taylor, City Attorney Butch Yelvington, Lieutenant Cathy Price, lnspector Bonnie Howington, lnspector Wendi Smith, Recording Secretary Absent: I. CALL MEETING TO ORDER/ROLL CALL: 7:00 P.M. Chairman Lomax called the meeting to order at 7:OOp.m. The Recording Secretary called the roll. 2. APPROVAL OF MINUTES: The minutes from the January 23, 2005 meeting were presented. Member Tolos made a motion to accept the minutes of the January meeting. Seconded by Member McGarry and Greenhalgh. Code Enforcement Board Attorney stated that there needed to be some changes on some of the fines and days. Page 5 of the minutes was amended to reflect that CEB 05-01-432, Hanson for $25 per day per vehicle. 3. REPORT CASE UPDATE: 4. PUBLIC HEARING: City A?ttorney conducted the swearing in of witnesses. CEB 05-02-440 BUTLEWLEHMAN 722 Commerce Cir Longwood, FI 32750 Code Compliance lnspector Price reported she cited this property on June 24.2004 under LDC, Art X, Violation of Approved Site Plan and CC, Chap 10 Occupational License. She revisited the property on July 01, 2004 the property was not in compliance, Notice of Hearing was sent Certified mail to the property owner on February 09, 2005. The city request that an Administrative fee of $1 00.00 be imposed. Code lnspector Price answered questions from the Board Members Robin Butler, Property owner of 722 Commerce Cir, spoke in reference to this violation. Brad Lehman, Business owner of 722 Commerce Cir, spoke in reference to this violation. Vice Chair Tolos moved to close the public hearing. Seconded by Member McGarry and carried by a unanimous voice. McGarry moved, based on the evidence and the testimony, to find the respondents guilty of violating LDC, Art X, and Violation of Approved Site Plan and the Respondents Lehman was also sited for CC, Chap Chap 10 Occupational License. In support of this motion he asked the board find the following facts occurred. Business running without occupational license, they are also violating their site plan requirements. He further moved to impose an Administrative fee on Lehman to pay $985.00 within 30 days of the service of this order, and to give the respondents Lehman until March 15,2005 to come into compliance or a fine of $250 a day shall accrue. Respondent Lehman is to operate with a valid occupational License. The respondent is to park and drive in compliance with the site plan. Respondent Lehman has 1 day from the date of the hearing to comply with the access and egress requirements or a penalty of $50 a day shall apply. Respondent Butler shall have 10 days from the date of service to comply with the access and egress requirements or a penalty of $50 per day shall apply. Seconded by Vice Chair Tolos and carried by a unanimous roll call. B. CEB 04-07-388 WILLIAMS 1090 Talmo Longwood, FI 32750 Code Compliance lnspector Price reported she cited this property on January 15,2005 under CC, Chap. 22,22-33 Storage of Boat, RV, and Trailer, CC, Chap. 12, 12-2(2) Trash, Debris, etc. and CC, Chap. 22,22-28 Inoperable Vehicle, CC, Chap. 12.5 Outdoor storage, CC, Chap 5 Sec. 5-164 Posting of Address. She revisited the property on January 30,2005 and the property was still not in compliance. Notice of Hearing was sent certified mail on February 09, 2005.The city requests the respondents be found guilty of violating CC, Chap. 22, 22-33 Storage of Boat, RV, and Trailer, CC, Chap. 12, 12-2(2) Trash, Debris, etc. and CC, Chap. 22,22-28 lnoperable Vehicle, CC, Chap. 12.5 Outdoor storage, CC, Chap 5 Sec. 5-1 64 Posting of Address.. The city request that an Administrative fee of $1 00.00 be imposed. The vehicle violation came into compliance before the notice was served. CEB MEETINGOZW05 Page-2 Code lnspector Price answered questions from the Board Members. Gregory Williams, Property Owner of 1090 Talmo, spoke in reference to this violation. Member McGarry moved to close the public hearing. Seconded by Member Greenhalgh and carried by a unanimous voice vote. Member Greenhalgh moved, based on the evidence and the testimony, to find the respondent guilty of the repeat violations of CC, Chap. 22, 22-33 Storage of Boat, RV, and Trailer, CC, Chap. 12, 12-2(2) Trash, Debris, etc. 12.5 Outdoor storage. He violated CC, Chap 5 Sec. 5-164 posting of Address. In support of this motion he asked the board find the following facts occurred. There are misc. items in the back yard and in the partially constructed garage. There is a large stack of items stored in the back yard. Garage has no roof or doors so items inside cannot be considered in compliance. A trailer has now appeared in the front side yard which is a repeat violation. He further moved to impose an Administrative fee of $100 and to be paid within 30 30 days from the date of service and to give the respondents 5 days to bring the property into compliance from the date of service of the order or a fine of $100 per violation per day will be imposed for each and every day of non compliance. Retroactive to January 15, 2005 for the repeat violation and 5 days from the date of service of the order or a find of $50 per day fine will be imposed. Seconded by Member McGarry and carried by a unanimous roll call. Ir C. CEB 05-02-435 DEAROLF 953 Lormann Cir Longwood, FI 32750 Code Compliance lnspector Howington reported she cited this property under CC, Chap. 22, 22-33 Boats, RV's, Campers and Trailers. She revisited the property on January 05, 2005 the property was not in compliance. Notice of Hearing was served on the property owners by Certified Mail on February 08, 2005 and served on the tenant on February 11, 2005 by an officer of the Longwood Police Department. The city requests the respondents be found guilty of violating CC, Chap. 22, 22-33 Boats, Rv's, Campers and Trailers. The city also request that an Administrative fee of $1 00.00 be imposed. Property is in compliance as of today. Code lnspector Howington answered questions from the Board Members. Judith Dearolf, Property Owner of 953 Lormann Cir, spoke in reference to this violation. William Dearolf, Tenant at 953 Lorrnann Cir, spoke in reference to this violation. Vice Chair Tolos moved to close the public hearing. Seconded by Member McGarry and carried by a unanimous. Member Andrew McGarry moved, based on the evidence and the testimony, to find the respondent guilty of CC, Chap. 22, 22-33 Boats, RV's. Campers and Trailers. In support of this motion he asked the Board find the following facts occurred. Trailer in the back yard not properly screened.
