John "Bob" Lomax, Chair Ernest Tolos, Vice Chair ( arrived at 7:20 p.m.) Gail Brown, Member Kelly Kirk, Member Amy Goodblatt, Board Attorney Richard Taylor, City Attorney Russ Cohen, Lieutenant Cathy Price, Inspector Bonnie Howington, Inspector Wendi Smith, Recording Secretary Debra Dube, Member 1. CALL MEETING TO ORDER1 ROLL CALL: Chair Lomax called the meeting to order at 7:25p.m. The Reccrcling Secretary called the roll. 2. APPROVAL OF MINUTES: The minutes from the June 28, 2005 meeting were presen!&. Vice Chair Tolos moved to accept the minutes ~f the iune nleeiing seconded by Member Brown. Amy Goodblatt, Board Attorney suggested the following changes to be made to the minutes: 1. Substitute the word "two" with the word too. 2. Case 04-1 1-422 use the word "tractor instead of tracter 3. Change Case number to 05-05-459, and to reflect in the minutes that Dube was the ?the property owner. Vice Chair Tolos moved to approve the amended minutes, seconded by Member Brown and carried by a unanimous voice vote with Member Dube absent. 3. REPORT CASE UPDATE: None 4. PUBLIC HEARING: City Attorney conducted the swearing in of witnesses. A. CEB 05-07-465 CABRERA 1222 Selma Rd Longwood, FI 32750 Code Compliance lnspector Howington reported she cited this property on January 5, 2005, under City Code, Chapter 12.5 Outdoor Storage. She revisited the property on January 13, 2005 and the property was not in compliance; Notice of Hearing was posted on July 14, 2005 by Code lnspector Howington. The city requests that an Administrative fee of $100.00 be imposed. Code lnspector Howington answered questions from the Board Members Maria Cabrera, homeowner, spoke in reference to this violation. Vice Chair Tolos moved to close the public hearing. Seconded by Member Kirk and carried by a unanimous voice vote with Member Dube absent. Member Kirk moved, based on the evidence and the testimony, to find the respondent guilty of violating City Code, Chapter 12.5 Outdoor Storage. In support of this motion, he asked the board find the following facts occurred; Household furniture was stored stored on the carport. He further moved to impose an Administrative fee of $100 to be paid within 30 days from the date of service and to give the respondents 5 days from the date of service or a fine of $1 00 per day will be imposed. Seconded by Vice Chair Tolos and carried by a unanimous roll call vote with Member Dube absent. B. CEB 05-07-466 Pro-Finis hlNIRMAUPARKE 108 Baywood # I 04 Longwood, FL 32750 Code Compliance lnspector Howington reported she cited this property on May 19, 2005 under City Code, Chapter, 10 Occupational License. She revisited the property on June 4, 2005 and the property was not in compliance; Notice of Hearing was served on July 9,2005 by a Longwood Police Officer. The city requests, that an Administrative fee of $100.00 be imposed. Code lnspector Howington answered questions from the Board Members. Thomas Green (spoke as Mr. Parke Attorney); spoke in reference to Mr Parke's violation. Member Brown moved to close the public hearing. Seconded by Member Kirk and carried by a unanimous voice vote with Member Dube absent. Vice Chair Tolos moved, based on the evidence and the testimony, to find the respondents guilty of violating City Code, Chapter, 10 Occupational Licenses. In support of this motion, he asked the Board find the following facts occurred; the business was operating without an occupational license. He further moved to impose an Administrative fee of $1 00 to be paid within 30 days from the date of service; property was in compliance as of the meeting date. Seconded by Member Brown and carried by a unanimous roll call vote with Member Dube absent. C. CEB 05-07-467 LEITMAN 1018 W. S.R. 434 Longwood, FI 32750 Code Compliance lnspector Price reported she cited this property on December 16, 2004 for the LDC, Art, Vl, Sec. 6.7.6 Maintenance of signs, January 20, 2005 for the LDC, Art Ill, Sec. 3. 6. I D(3) Handicap parking spaces. She revisited the property on January 16. 2005 for Maintenance of Signs and February 7,2005 for the Handicap Parking spaces and the property was still not in compliance. Notice of Hearing was posted on July 13, 2005 by a Code Officer Howington. The city requests that an Administrative fee of $1 00.00 be imposed. Code lnspector Price answered questions from the Board Members. Vice Chair Tolos moved to close the public hearing. Seconded by Member Brown and carried unanimous voice vote with Member Dube absent. Member Kirk moved, based on the evidence and the testimony, to find the respondent guilty of LDC, Art, VI, Sec. 6.7.6 Maintenance of signs, LDC, Art Ill, Sec. 3. 6. 1 D(3) Handicap parking spaces. In support of this motion he asked the Board + find the following facts occurred, The parking lot has been re-striped but Handicap spaces do not have the required signage to enforce violations, In addition, sign at -street side of building is still in disrepair. He further moved to impose an Administrative fee of $1 00 to be paid within 30 days from the date of service and to give the respondents 30 days to bring the property into compliance or a fine of $100 per day for violation LDC, Art, VI, Sec. 6.7.6 Maintenance of signs and to impose an Administrative fee of $250 to be paid within 30 days from the date of service for violation LDC, Art Ill, Sec. 3. 6. 1 D(3) Handicap parking spaces. Seconded by Member Brown and Vice Chair Tolos and carried by a unanimous roll call vote and Member Dube absent. C. CEB 05-07-470 SMlTHlLOREFlCElCable Contracting 183 E. Pine Ave Longwood, FI 32750 Code Compliance lnspector Price reported she cited this property on June 28, 2004 for the City Code Chap. 22, 22-32 Commercial Vehicles; City Code Chap. 12.5 Outdoor Storage. She revisited the property on June 28, 2005 for and the property was still not in compliance. Notice of Hearing was sent Certified mail to the property owner on July 11, 2005 and served on Joseph Grover on July 11 2005 by a Longwood Police Officer. The city requests that an Administrative fee of $100.00 be imposed. Code Inspector Price answered questions from the Board Members. Vice Chair Tolos moved to close the public hearing. Seconded by Member Kirk and carried unanimous voice vote with Member Dube absent. Vice Chair Tolos moved, based on the evidence and the testimony, to find the respondent guilty of City Code Chap. 22, 22-32 Commercial Vehicles; City Code Chap. 12.5 Outdoor Storage. In support of this motion he asked the Board find the following facts occurred, There is a large truck with a trailer and other equipment parked in the front yard of this residence and there is a large spool of cable in the backyard. He further moved to impose an Administrative fee of $100 to be paid within 30 days from the date of service and to give the respondents 15 days to bring the property into compliance or a fine of $250 per day per violation. Seconded by Members Kirk and carried by a unanimous roll call vote and Member Dube absent.
