Chair Lomax called the meeting to order at 7:OOp.m. The Recording Secretary called the roll. 2. APPROVAL OF MINUTES: The minutes from the August 23, 2005 meeting were presented. Member McGarry moved to accept the minutes of the August meeting seconded by Vice Chair Tolos. Amy Goodblatt, Board Attorney, suggested the following changes be made to the minutes: 1. CEB 05-08-474 In the last paragraph, it should read "City Code, Chap. 22, 22-33" not "City Code, Chap. 22, 22-23';. Motion carried by a unanimous voice vote with Member Vanatta absent. 3. ?3. REPORT CASE UPDATE: None -4. PUBLIC HEARING: City Attorney conducted the swearing in of witnesses. CEB 09127105-1 a A. CEB 05-09-478 MCLAUGHLIN, Ronald & Linda 104 Shady Lane Longwood, FL 32750 Code Compliance lnspector Howington reported she cited this property on July 5', 2005, under City Code, Chap. 22, 22-33 Boats, Campers, Trailers. She revisited the property on July 14, 2005 and the property was not in compliance. Notice of Hearing was served on September 4th, 2005 by a Longwood Police Officer. The City requests that an Administrative fee of $1 00.00 be imposed. Code lnspector Howington answered questions from the Board Members. Ron McLaughlin, homeowner, spoke in reference to this violation. Vice-Chair Tolos moved to close the public hearing. Seconded by Member McGarry and carried by a unanimous voice vote with Member Vanatta absent. Member Brown moved, based on the evidence and the testimony, to find the respondent guilty of violating City Code, Chap. 22, 22-33 Boats, Campers, Trailers. In support of this motion, she asked the Board find the followin% facts occurred: NOV was issued on July 5'h, 2005 with no changes made on July l4lh, 22" , 30' 2005. She further moved to impose an Administrative fee of $1 00.00 to be paid within 30 days from the date of service of final orders )I. and gave the respondents 5 days from the date of service of Final Orders to bring the property into compliance or a fine of $50.00 per day for violation of City Code, Chap. 22, 22-33 Boats, Campers, Trailers. Seconded by Member Tolos and carried by a unanimous roll call vote with Member Vanatta absent. B. CEB 05-09-479 MELTON, Christopher 1508 Oriole St. Longwood, FL 32750 Code Compliance lnspector Howington reported she cited this property on June 2lSt, 2005 under City Code, Chap. 22, 22-28 Inoperable Vehicle. She revisited the property on July 8th, 2005 and the property was not in compliance. Notice of Hearing was served on September 3rd, 2005 by a Longwood Police Officer. The City requests that an Administrative fee of $1 00.00 be imposed. Code lnspector Howington answered questions from the Board Members. Christopher Melton, property owner, spoke in reference to this violation. Member McGarry moved to close the public hearing. Seconded by Member Kirk and carried by a unanimous voice vote with Member Vanatta absent. .L Member McGarry moved, based on the evidence and the testimony, to find the respondents guilty of violating City Code, Chap. 22, 22-28 Inoperable Vehicle. In support of this motion, he CEB 09127105-2 asked the Board find the following facts occurred: NOV was issued on June 21S', 2005 with ,m no change on July 8" & 23rd 2005 and that they came into compliance on September 27", 2005. He further moved to impose an Administrative fee of $100.00 to be paid within 30 days from the date of service of Final Orders. Seconded by Vice-Chair Tolos and carried by unanimous roll call vote with Member Vanatta absent. C. CEB 05-09-480 NAMEY, Charles 510 Highland St. Longwood, FL 32750 Code Compliance lnspector Howington reported she cited this property on July 7', 2005 for FBC, Sec. 104.1 .I & 105.6 Permits & Inspections. She revisited the property on July 19', 2005 and the property was still not in compliance. Notice of Hearing was served on Charles Namey on September 3rd. 2005 via Certified Mail. The City requests that an Administrative fee of $100.00 and a compliance date of October 18'~2, 005 be imposed. Code lnspector Howington answered questions from the Board Members. Charles Namey, property owner, spoke in reference to this violation. Vice-Chair Tolos moved to close the public hearing. Seconded by Member McGarry and carried by a unanimous voice vote with Member Vanatta absent. Vice-Chair Tolos moved, based on the evidence and the testimony, to find the respondent m guilty of FBC, Sec. 104.1 .I & 105.6 Permits & Inspections. In support of this motion, he asked the Board find the following facts occurred: New steps were installed with no inspections or permits. He further moved to impose an Administrative fee of $100.00 to be paid within 30 days from the date of service and gave the respondents until October lath, 2005 to bring the property into compliance or a fine of $250.00 per day for violation of FBC, Sec. 104.1.1 & 105.6 Permits & Inspections. Seconded by Member McGany and carried by a 3 to 2 roll call vote Chair Lomax and Member Kirk voting "nay" and with Member Vanatta absent. D. CEB 05-09-482 VANNATER, Sherry & Davy 922 Rangeline Rd. Longwood, FL 32750 Code Compliance lnspector Price reported this property has received their permit and paid their $100 fine. The case was withdrawn by the City. E. CEB 05-09-483 VOGEL, Jamie & Tonia 364 E. Church Ave. Longwood, FL 32750 Code Compliance lnspector Price reported she cited this property on July ls2'0,05 for City -Code. Chap. 22, 22-28 Inoperable Vehicle. She revisited the property on July 13". 2005 & August 181h, 2005 and the property was still not in compliance. However, property was found CEB 09127105-3 in compliance on September 2 7 ~2,0 05. Notice of Hearing was served on Tonia Vogel on ,-September 5, 2005 by a Longwood Police Officer. The City will let the Board decide the Administrative fee. Code lnspector Price answered questions from the Board Members. Member McGarry moved to close the public hearing. Seconded by Vice Chair Tolos and carried by a unanimous voice vote with Member Vanatta absent. Member Kirk moved, based on the evidence and the testimony, to find the respondent guilty of City Code, Chap. 22, 22-28 Inoperable Vehicle. In support of this motion he asked the Board find the following facts occurred: NOV was issued on July lS200t5, fo r inoperable Blazer with no change upon re-inspection on July 1 8th, 2005. He also recognized on September 27'" 2005 vehicle was removed and property was in compliance. He further moved to impose an Administrative fee of $100.00 to be paid within 30 days from the date of service of Final Orders. Seconded by Member McGarry and carried by a unanimous roll call vote with Member Vanatta absent. F. CEB 05-09-484 SHARKY'S IIIROTHSTEIN, LauralTRAN, An 272 W. 434 Longwood, FL 32750 Code Compliance lnspector Price reported she cited this property on August 6'h, 2005 for LDC, Art VI, Sec. 6.3.3 Permit Required. She revisited the property on August 1 2 ~ &lgh , e 2005 and the pro erty was still not in compliance. Notice of Hearing was served on An Tran on September 3'82005 via Certified Mail and First Class Mail. Notice of Hearing was also served on Haley Burton who is an employee of Laura Rothstein on September 2nd, 2005 by a Longwood Police Officer. The City requests that an Administrative fee of $1 00.00 be imposed. Code lnspector Price answered questions from the Board Members. Laura Rothstein, business owner, spoke in reference to this violation. Vice Chair Tolos moved to close the public hearing. Seconded by Member McGarry and carried by a unanimous voice vote with Member Vanatta absent. Member McGarry moved, based on the evidence and the testimony, to find the respondent guilty of LDC, Art VI, Sec. 6.3.3 Permit Required. In support of this motion he asked the Board find the following facts occurred: NOV issued on August 6, 2005 with no change found on re-inspection on August 12Ih & lgth, 2005 and that the property is currently in compliance. He further moved to impose an Administrative fee of $1 00.00 to each respondent to be paid within 30 days from the date of service of Final Orders.
