MEETING TO ORDER/ROLL CALL: Chairman Lomax called the meeting to order at 7pm. The Recording Secretary called the roll. 2. APPROVAL OF MINUTES: The minutes from the February 27, 2007
meeting were presented. Member Tolos moved to accept the minutes of the February meeting, seconded by Member Vanatta. Minutes carried by a unanimous roll call vote. 3. REPORT CASE UPDATES:
None 4. PUBLIC HEARING: Code Enforcement Board Atty. Goodblatt conducted the swearing in of witnes?ses and Chairman Lomax announced the case names to see which were present.
CEB 03/27/07-2 D. CEB 07-03-625 COMPLETE RENOVATIONS, INC. 114 W. Bay Avenue Longwood, FL 32750 As stated on the Agenda, this case has been withdrawn as property is in compliance. C.
CEB 07-03-624 McCORMICK, Thomas & Valerie 1520 Pelican Street Longwood, FL 32750 Code Officer Price stated this property has previously been cited 10 times and on 02/17/07 she notice
a truck with trailer so she issued a Notice of Violation for CC, Chap. 86, Sec. 86-83 Boats, Trailers and RVs with no compliance date because of numerous previous violations. Upon re-inspection
on 02/21/07, the property was not in compliance and this case was then scheduled for the Board. The City requested the respondent be found guilty so that in the future they can be cited
as repeat violators. There were no questions for Code Officer Price. Thomas McCormick, property owner, spoke in reference to this case. Member Tolos moved to close the public hearing.
Seconded by Vice-Chair Kirk and carried by a unanimous voice vote. Vice-Chair Kirk moved, based on the evidence and the testimony, to find the respondent guilty of CC, Chap. 86, Sec.
86-83 Boats, Trailers and RVs. In support of this motion, he asked the Board find the following facts occurred: box trailer parked not properly screened; cited 10 times previously but
that the property is now in compliance. He further moved to assess an Administrative Cost of $100.00 to be paid within 30 days from date of service of Final Orders. Motion seconded by
Member Putz and passed unanimously by a roll call vote. A. CEB 07-03-622 TOWNSHIP PLAZA ASSOC., LTD. 950-988, 1002-1014 & 1018 W. SR 434 Longwood, FL 32750 Code Officer Howington stated
she issued a Notice of Violation for CC, Chap. 18, Sec. 18-63 Minimum Property Standards and CC, Chap. 86, Sec. 86-55 Disposition of Wrecked or Discarded Vehicle on Private Property
on 01/19/07 on to comply by 01/26/07. Upon reinspeectio on 02/01/07, the property was not in compliance and a Notice of Non-Compliance was issued to comply by 02/05/07. Upon further
re-inspections inspections on 02/09/07 and 02/13/07, the property was not in compliance and this case was then scheduled for the Board. She further stated the Notice of Hearing was served
on Alvin Leitman on 03/12/07 via certified mail. The City requests the respondent be found guilty and be given 10 days to come into compliance or $250.00 per violation, per day fine
be imposed. The City also requests a $300.00 Administrative Cost be assessed to be paid within 30 days from date of service of Final Orders. Code Enforcement Officer Howington answered
questions from the Board.
CEB 03/27/07-3 Alvin Leitman, Registered Agent for the property owner, spoke in reference to this case and answered questions from the Board. Barry Revels, friend of registered agent,
spoke in reference to this case. Member Tolos moved to close the public hearing. Seconded by Member Putz and carried by a unanimous voice vote. Member Dolan moved, based on the evidence
and the testimony, to find the respondent guilty of CC, Chap. 18, Sec. 18-63 Minimum Property Standards and CC, Chap. 86, Sec. 86-55 Disposition of Wrecked or Discarded Vehicle on Private
Property. In support of this motion, he asked the Board find the following facts occurred: property cited on 01/19/07 and re-inspections on 02/01/07, 02/09/07 & 02/13/07 showed the property
not in compliance. He further moved to give the respondent 14 days from date of service of Final Orders to bring the property into compliance or a penalty of $250.00 per violation, per
day will be imposed for each and every day of non-compliance. He also moved to assess an Administrative Cost of $300.00 to be paid within 30 days from date of service of Final Orders.
Motion seconded by Vice-Chair Kirk and discussion ensued regarding the details of compliance. Member Dolan amended his motion to read “in regards to the standing water, respondent must
meet with the City engineer within 14 days to come up with a course of action”. Amended motion seconded by Vice-Chair Kirk and passed unanimously by a roll call vote. Original motion
passed unanimously by a roll call vote. B. CEB 07-03-623 ADAMS, William and Constance 2 Vacant lots at Jessup & Oleander Longwood, FL 32750 Lt. Cohen spoke and introduced Community Services
Interim Director, Paul Sizemore. Mr. Sizemore presented an overview of the City’s storm water management system and answered questions from the Board and the respondent’s attorney, Eric
Castleson. Code Officer Price then stated she issued a Notice of Violation for CC, Chap.74-38 Stormwater Management System on 02/08/07 on to comply by 02/15/07. Upon re-inspection on
02/16/07, the property was not in compliance and a Notice of Non-Compliance was issued to comply by 02/21/07. Upon further re-inspection on 02/24/07, the property was not in compliance
and this case was then scheduled for the Board. She further stated the Notice of Hearing was served on David Jones (37yr old nephew of property owner) on 03/08/07 at 4:18pm by Ofc. Lisa
Martin of the Longwood Police Dept. City Atty. Roper then summarized the case and answered questions from the Board. Eric Castleson, attorney for respondent, spoke in reference to the
case and answered questions from the Board and attorneys. Discussion ensued between the Board as to the scope of the case and the arguments that were heard. Member Tolos moved to close
the public hearing. Seconded by Vice-Chair Kirk and carried by a unanimous voice vote.
CEB 03/27/07-4 Member Dolan moved, based on the evidence and the testimony, to find the respondent guilty of CC, Chap.74-38 Stormwater Management System. In support of this motion, he
asked the Board find the following facts occurred: 02/08/07 showed the property in violation; respondent given until 02/15/07 to comply; re-inspection on 02/15/07 showed the property
not in compliance. He further moved to give the respondent 30 days from date of service of Final Orders to bring the property into compliance or a penalty of $250.00 will be imposed
for each and every day of non-compliance. He also moved to assess an Administrative Cost of $100.00 to be paid within 30 days from date of service of Final Orders. Motion seconded by
Vice-Chair Kirk and discussion ensued regarding the definition of compliance. Member Dolan amended his motion to read “respondent given 15 days from date of service of Final Orders to
come to a written agreement with the City in which a specific timeframe will be addressed or a $250.00 fine will be assessed …”. Amended motion seconded by Vice-Chair Kirk and passed
unanimously by a roll call vote. Original motion passed unanimously by a roll call vote. E. CEB 07-03-626 WASMAN, Jeri 653 N. Wildflower Court Longwood, FL 32750 Code Officer Price stated
she issued a Notice of Violation for CC, Chap. 86, Sec. 86-82 Commercial Vehicle on 02/16/07 to comply by 02/23/07. Upon re-inspection on 02/23/07, the property was not in compliance
and a Notice of Non-Compliance was issued to comply by 02/27/07. Upon further re-inspection on 02/27/07, the property was not in compliance and this case was then scheduled for the Board.
She further stated the Notice of Hearing was served on Jeri Wasman on 03/08/07 at 11:00am by Ofc. Carl Rentfro of the Longwood Police Dept. She further stated the property is now in
compliance however the City requests the respondent be found guilty so that in the future they can be cited as repeat violators. There were no questions for Code Officer Price. There
was no respondent present. Vice-Chair Kirk moved to close the public hearing. Seconded by Member Tolos and carried by a unanimous voice vote. Member Putz moved, based on the evidence
and the testimony, to find the respondent guilty of Chap. 86, Sec. 86-82 Commercial Vehicle. In support of this motion, she asked the Board find the following facts occurred: commercial
vehicle present at property; Notice of Violation issued on 02/16/07 to comply by 02/23/07; and re-inspections on 02/23/07 & 03/02/07 showed property not in compliance however the property
is now in compliance. She further moved to assess an Administrative Cost of $100.00 to be paid within 30 days from date of service of Final Orders. Motion seconded by Vice-Chair Kirk
and passed unanimously by a roll call vote.
CEB 03/27/07-5 5. UNFINISHED BUSINESS: A. Atty. Goodblatt requested the 07/24/07 Code Enforcement Board meeting be held on 07/31/07 as she will not be available and her replacement will
be on maternity leave. The Code Enforcement Board stated they would be available if the room is open. Code Enforcement Secretary, Kim Harris, will check and inform Lt. Cohen and Chairman
Lomax of the outcome. 6. NEW BUSINESS: A. Alvin Leitman of Township Plaza (case #98-06-016, repeat) requested an elimination of his fines which total $1,600.00 from the 02/27/07 Code
Enforcement Board meeting. The Board heard his request and no motion was made, therefore the request was denied. 7. OLD BUSINESS: None 8. ADJOURNMENT: Chair Lomax adjourned the meeting
