MEETING TO ORDER/ROLL CALL: Chairman Lomax called the meeting to order at 7pm. The Recording Secretary called the roll. 2. APPROVAL OF MINUTES: The minutes from the March 24, 2007 meeting
were presented. Member Tolos moved to accept the minutes of the March meeting, seconded by Vice-Chairman Kirk. Minutes carried by a unanimous roll call vote. 3. REPORT CASE UPDATES:
None 4. PUBLIC HEARING: Code Enforcement Board Atty. Goodblatt conducted the swearing in of witness?es and Chairman Lomax announced the case names to see which were present.
CEB 04/24/07 A. CEB 07-04-627 SUSSMAN, Mark and William, TRS 616 Vincent Place Longwood, FL 32750 As per Lt. Cohen, this case has been withdrawn as property is in compliance. C. CEB
07-04-629 THILMONY, Matthew/Cox, Kristen 337 E Palmetto Avenue Longwood, FL 32750 As per Lt. Cohen, this case has been withdrawn as property is in compliance. D. CEB 07-04-630 EDWARDS,
Ammie 562 Highland Street Longwood, FL 32750 As per Lt. Cohen, this case has been withdrawn as property is in compliance. E. CEB 07-04-631 KELLY, Linda/Kelly’s Martial Arts 1150 N CR
427 Longwood, FL 32750 As Per Lt. Cohen, this case will be continued till the May Code Enforcement Board meeting. B. CEB 07-04-628 HERNANDEZ, Edel and Carlota 1140 Hamilton Avenue Longwood,
FL 32750 Code Officer Howington stated she issued a Notice of Violation for CC, Chap. 86, Sec. 86-83 Boats, Trailers and RV Parking and CC, Chap. 18 Sec. 18-221 Outdoor Storage on 03/14/07
to comply by 03/15/07. A one day compliance date was given due to the fact that this property property had been cited 3 times previously for the same violation. Upon re-inspection on
03/17/07 and 03/21/07, the property was not in compliance and this case was then scheduled for the Board. She stated the Notice of Hearing was served on Carlota Hernandez on 04/04/07
at 3:12 pm by Ofc. Andrew Caroen of the Longwood Police Dept. She further stated the property is now in compliance, however the City requests the respondents be found guilty and requests
that a $100.00 Administrative Cost be assessed to be paid within 30 days of date of service of Final Orders. Code Enforcement Officer Bonnie Howington answered questions from the Board.
Carlota Hernandez, Property Owner, spoke in reference to this case and answered questions from the Board. Member Tolos moved to close the public hearing. Seconded by Member Putz and
carried by a unanimous voice vote. Member Vanatta moved, based on the evidence and the testimony, to find the respondents guilty of CC,Chap. 86, Sec. 86-83 Boats,Trailers & RV parking
and CC, Chap. 18, Sec 18-
CEB 04/24/07 222 Outdoor Storage. In support of this motion, he asked the Board find the following facts occurred upon which these violations existed: there have been other violations
over the 7 years the owner has owned the property; a Notice of Violation was issued on 03/15/07; a Notice of Hearing was issued on 04/04/07; and that the property is now in compliance.
He further moved to give the Respondents 0(zero) days from the date of service of the Final Orders to comply because the property is in compliance as of the day of the meeting that Administrative
costs of $100.00 be assessed and should be paid within 30 days from date of service of Final Orders. Motion seconded by Member Putz, however discussion ensued concerning violation CC,
Chap. 18, Sec. 18-222, should be CC, Chap. 18, Sec. 18-221. Member Vanatta amended his original motion. Seconded by Vice-Chairman Kirk and motion passed unanimously by a roll call vote.
Original motion also carried by a unanimous roll call vote. F. CEB 07-04-632 SAVI-KAN INC/Alarmtronics 1084 N CR 427 Longwood, FL 32750 Code Officer Howington gave a brief history of
the case that started in April of 2005 about running a business without an Occupational License. A Notice of Violation was issued on April 29, 2005 to comply by May 4, 2005. Mr. Patel
the Property Owner did get with Planning and was issued an Occupational License in August 2005, with the contingency that he would submit a site plan within one year prior to reapplication
for his 2006-2007 occupational license. In a letter from Mr. Paul Sizemore, Community Development Coordinator, giving Mr. Patel an additional 6 months from September 15 ,2006 to provide
a site development plan for his property and if the City did not receive a site plan by March 15, 2007, Code Enforcement would be notified and a Notice of Violation would be issued citing
LDC, Art. X , Sec. 10.0.2A(7) and LDC, Art. X, Sec. 10.2.0 and the Occupational License would not be renewed until compliance was met. On 03/16/07, a Notice of Violation was issued issued
citing LDC, Art. X, Sec. 10.0.2A(7) and LDC, Art. X , Sec. 10.2.0 to comply by 03/23/07. Code Officer Howington checked with Planning on 03/23/07, no site plan had been submitted and
a Notice of Non-Compliance was issued on 03/28/07 to comply by 04/02/07. As of 04/24/07, the property had not come into compliance and the business was still operating from that location.
Notice of Hearing was served on Penny Coyle (employee) on 04/04/07 at 3:05 pm by Officer Andrew Caroen of the Longwood Police Dept. A copy of the Notice of Hearing was posted on the
property and at City Hall on 04/13/07 and a copy was mailed First Class mail by Code Officer Price to Mr. Patel. The City is asking that the Respondents be found guilty of violating
LDC. Art. X, Sec. 10.2.0 Site Development Plans and ask that the respondents be given 30 days from the date of the receipt of the Final Orders to submit a site plan and have it approved
within 45 days of submittal. If the business moves to a different location within the City, that location must also meet all requirements of the City prior to opening. If property is
not in compliance, the City requests a fine of $250.00 per day be assessed until compliance is met. The City also asks for an Administrative cost of $100.00 be assessed and paid within
30 days of receipt of Final Orders. Code Officer Howington answered questions from the Board.
CEB 04/24/07 Mr. Patel, property owner, spoke in reference to this case and answered questions from the Board. Acting City Attorney Heather Mackery asked questions of Mr. Patel. Member
Tolos moved to close the public hearing. Seconded by Member Brown and carried by a unanimous voice vote Member Dolan moved, based on the evidence and testimony, to find the Respondents
guilty of LDC, Art. X, Sec 10.2.0 ,Site Development Plans as a matter of law and in support of this motion he asked that the property at 1084 N Ronald Reagan Blvd have a site plan submitted
within 30 days of receipt of Final Orders and must have approval within 45 days of submittal. If the orders are not met a penalty of $250.00 per day will be imposed for every day of
non compliance and that a $100.00 administrative cost be assessed and paid within 30 days of receipt of Final Orders. Motion seconded by Vice-Chairman Kirk. The Board discussed the penalty
motion. Member Dolan amended his original motion to cover any property within the City that that the Respondents choose to use as a business. Seconded by Member Tolos, and carried by
a unanimous voice vote. Original motion carried by a unanimous roll call vote. G. CEB 07-04-633 JONES, Elmore and Carla 1516 Meadowlark Street Longwood, FL 32750 Code Officer Howington
stated that she issued a Notice of Violation on 03/21/07 for CC, Chap. 86, Sec. 86-83 Boats, Trailers and RV parking to comply within 24 hours since the property had been cited previously
for the same violation. Upon re-inspection on 03/23/07, the property was in compliance and has been in compliance since. Due to the number of times the property had been previously cited,
Code Officer Howington felt that he had no intentions of staying in compliance. Notice of Hearing was served on Mr. Elmore Jones on 04/04/07 at 10:27am by Officer Arciola of the Longwood
Police Dept. The City requests that the respondents be found guilty of violating CC, Chap. 86, Sec. 86-83, Boats, Trailers, RV’s and that an Administrative cost of $100.00 be assessed
assessed to be paid within 30 days of service of the Final Orders. Code Officer Howington answered questions from the Board. As a matter of law, the case was withdrawn by the City due
to the fact that the property came into compliance before the compliance date and was not in violation after 03/23/07. H. CEB 07-04-634 BHAGWANDASS, Simboonath and Rautie 791 N Wayman
Street Longwood, FL 32750
CEB 04/24/07 Code Officer Howington stated she issued a Notice of Violation on 03/21/07 for LDC, Art. V, Sec. 5.3.1 Swimming Pool which requires that the pool be enclosed either by a
screen enclosure or a 6’ fence with a self latching gate. Compliance for this violation was within 24 hours due to the potential hazard of no fence around the pool. She also cited LDC,Art.
X, Sec. 10.1.0 no permit for the installation of the pool. Compliance date for this violation was 03/28/07. Upon re-inspection on 03/31/07, compliance had not been met, no permit had
been obtained and there was no enclosure around the pool. A Notice of Non-Compliance was issued on 03/31/07 to comply by 04/04/07. As of 04/24/07, the property is in compliance. The
Notice of Hearing was served on Simboonath Bhagwandass on 04/08/07 at 4:15pm by Officer Brown of the Longwood Police Dept. The City is requesting that the Respondents be found guilty
of violating LDC, Art.V, Sec. 5.3.1 and LDC, Art. X, Sec. 10.1.0 and that a $100.00 Administrative cost be assessed to be paid within 30 days of service of Final Orders. Code Officer
Howington answered questions from the Board. No Respondent present. Member Brown motioned to close the public hearing. Motion seconded by Member Putz and carried by a unanimous voice
vote. Member Putz moved to find the Respondents guilty of violating LDC, Art. V, Sec. 5.3.1 and LDC, Art. X, Sec. 10.1.0. In support of this motion she asked that the Board find the
following facts occurred: a Notice of Violation was issued on 03/21/07 to comply by 03/28/07; Upon re-inspection on 03/31/07 and 04/04/07, the property was not in compliance; Upon further
inspection on 04/24/07, the property was found to be in compliance. Since the property is in compliance, she moved that there be no fine imposed but a $100.00 Administrative cost be
assessed and must be paid within 30 days of receipt of Final Orders. Motion seconded by Vice-Chairman Kirk and passed by a unanimous roll call vote. 5. UNFINISHED BUSINESS: A. The July
