Oa September 4, 2004, the City was hit by Hurticane Frances, resulting m substantiil and
extensive damage to both City property and residents' property. In order to expeditiously
manage and artange for cleanup and repairs of the damage, the City Administmwr
requests Ibet aul6ority be granted to deal with extraordinary measures to protect the
public health, safety and welfare.
FUNDING:
Public assistance through Federal Emergency Management Agency funding.

COMMIHSION OF THE CITY OF IANGWOOD, FLORIDA,
ADOPTING EMERGENCY REGULATIONS TO ADDRESS
THE AFTERMATH OF IIURRICANE FRANCES;
AUTHORIZING TDE CTFY ADMINISTRATOR TO
EXECUTE CERTAIN DISASTER RECOVERY
AGREEMENTS BY PIGGY BACKING ON CONTRACTS
ENTERED INTO RY SEMINOLE COUNTY; WAIVING
COMPETITIVE BIDDING REQUIREMENTS ON
CONTRACTS REQUIRED TO CLEAN-UP DEBRIS,
RESTORE UTILITIES, AND MAKE EMERGENCY REPAIILS
ON PUBLIC PROPERTY; AUTHORIZING TBE CTPY
ADMINIRTRATOR TO ENTER INTO TEMPORARY LEASE
AGREEMENTS WITA PROPERTY OWNERS FOR
PURPOSES OF CREATING TEMPORARY WASTE
REDUCTION STTES AND STAGING AREAS; PROVIDING
FOA SEVERABILPEY, EFFECTR'E DATE, AND A SLYTY
DAY EXPIRATION DATE.
WHEREAS, the City is granted the authority, under § 2(b), Art. V1R of the
Florida Cortstimtioo, to ex any power for municipal pwposes, except when
expressly prohibited by law; endue
WHEREAS, on September t, 2004, Governor lab Hush declared a state of
emergency under Executive Order Number 04-192 due to Hwicane Frances; aad
WHEREAS, Hurricane Frances caused substantial and extensive damage in the
City of Longwood including, but not limited to, downed ttees, lass of electric power,
damaged property, and loss of phone service; and
WHEREAS, given the substantial end extensive damage caused by Hurricane
Frances, the City of Longwood must mke extraordinary measures to protect the public
health, safety, and welfare; and
WHEREAS, the City Commisslon of the City of Longwacd, Florida, has
dete,mined it to be in [he best interest of the safety, health, and welfare ofthe citizere of
the City ofLOngwood to adopt this Ordinance.
NOW, THEREFORE, THE CITY COMMISSION OF THE CITY OF
LONGWOOD HEREBY ORDAINS, AS FOLLOWS:
