Approval of Hi nu tes of May 6, 1985 Meeting: Motion by Mr. Lewis, seconded by Mrs. Shoma to to approve the Minutes of the May 6, 1985 Meeting as written. Hots on carried by a unanimous voce vote. 3. Mr. Dave Schulte spoke for the request sta ti nq that the slab had already been poured when the er as discovered. Ne stated the survey was re ved late. Mr. Schulte stated the four corners of the house were laid out to meet a ].]' m setback, which all either meet or exceed, but that the master bath area extended out and en oached into the required ]' setback by 1.]'. Cr: Pearl asked if the house was no completion and Mr. Schulte replied it Dr. Pears asked if FRL had attempted to purchase the additional footage nary from the adjacent property ow Mr. Schulte stated they had not. There was n0 ne present to speak for or aqa inst the request. (r. Pearl stated a phone call had been re 'ved from Mrs. (race Bradford sta ti n9 objection to the request and she sta tedeher re On for objection was due to lack of space in the ar yard for parking. It was snoted that Mrs. Bradford was the adjoining neighbor to the east, Mr. Nagle explained the re on for the request and stated that the Land Pla nni nq Agency had re mended denial of the variances but indicated approval o£ the bed and breakfast conept in the Ni stori cal District. Mr. Nagle stated that it appeared the project would be Feasible if the applicant would consider removi ny part of the existing wood deck in order to provide the required parking len9 tF of stalls and driveway width. Me further sia tad that the applicant did not need a ce for the width as there was adequate area to provide the required widths of the~pa rki ny stalls. He further stated that the driveway width of 19' a shown on the schematic s 6' short Of the required 25' two way driveway as required by ortli na nce. However, Mr. Nagle further stated, this project would not generate very much traffic. Or. Pearl asked iF driving ov septic Ca nk is permitted. Mr. Nagle stated the applicant was advised and also sent notice of the mee tf nn. Motion by Mrs. Shona te, s conded by Mr. Lewis to deny the variances requested by Oonna and Ronald Piqott, eIt was the co s of opinion of the Board t0 deny the request as the applicant was not Oresentctosan war questions posed by the Board. Motion carried by a unanimous roll call vote. s Mr. Lewis stated a regarding the FRC va request. He wa rued concern rl ante s cOnce that the house construction was allowed to continue. Mr. Lewis asked if FRC could l egai1y con ti nve Yo build and get inspections from the City knowing a viol anon xi sted. Mr. Nagle stated he believed Mr. Lewis wa asking Mr. Bryant, as Building Official, could he refuse to do further inspec ti onsson the house. Or. Pearl stated the Board had not yet ruled against the variance. Mr. Lewis stated the developer knew he needed the variance. Mr. Bryant sta tetl a directive from scan other person with authority was needed. Mr. Lewis made a motion t0 request a decision iron the City Attorney as to who can legally authorize a stop order on ons tructi On n Yhis particular ca and asked that carbon copies of the attorney's opinion be given to the C.i ty C.mmissi on.
