Chairman Richard Dullington opened the public hearing and asked whether anyone present
wished to speak in favor ot'Ordinanca 9fi-1320_ No one present indicated the desire to
speak in favor of the Or<linence.
Mr. Brock stated that we still have several individual single Pomily lots in the Low Density
s of the Ciry which would not ba affaetod by this Ordinenw. this Ordinance will
address itself only to new subdiviaiov. Wr. Gosline said the Ominanee applirs only to
new subdivision platted after the September I.
Ms. Randi Fitzgerald, attorney for Calton Homes, the builder of the Longwood Club
project, explained that the curtent prac[ice ofapplying the ISk on a lot-by-lot basis was
burdensome for newsubdivisions. She also explained that most other communities have
established minimum open space area requirements and that their aPPlication ofthese
requir s more Ibuel than the Ciry'.c She began to explore other alternatives
with the stefiwe
Ms. FitzgerelU suggested that rather thav alluentivg the ISR on slot-by-lot basis. the total
impervious surface area for the site as a whole could be used as a bank from which each
lot ould be allocated an imperv a. However. the total impervious surface areas of
eaoli lot could not exceed the0.4ISRafor tho total site
Ms_ Fitzgerald stated the currem [rend is [o smeller and smaller lots. When [he ISR is
appliedto smaller tors, there is vo space left to build. Carl responded for the record that

the staff had consistently told ERM Homes that the 0,4 ISR was inviolate and could not
be changed- Ther is. the current practiw was no[ a nnprice to the developers.

the uve of perv us pnv and turf block to provide parking epee wherein av open

end industrial sites.
Ms F'itzgw~ald said that after several mawings with the staff and Cohan Homes
repres s agreed that the best way to handle the matter ix to amend the
Ordinance to allow some flexibility in [he aplication oftbe ISR is a developer s
agreement. The developer agreement approach allows both the developer and the City to
important development protects.
Nr. Gosline said that Ordinance 96-1320 simply allows the Ciry and a developm

would require approval ofthe City Commission.
