1. The meeting was called to order by Mr. Linton at J:02 PM
2. Approval of Minutes: Motion by Idr. flayni e, seconded by ftr. Pope, that the
Minutes of February 10, 1988 be approved as written. Motion carried by a
u nan~mous roll ca11 vole.
3. Variance -Applicant: Peter J. Cohen (lll ti mate Motors) Location: 895 N.
LR 42J. Request to allow a fence within the {ro nt setback of the boil ding.

Mr. Thompsen asked haw far the fence extended into the ri yht of way. Mr. Nagle
stated that according to the survey a portion of the fence, a triangular piece,
extends into the right of way. Mr. Nagle further stated that the way the fence

11r. Nagle stated from the information he could 9a that, it did not appear that the
old ri 9ht of way had every been abantlonetl, It was su99 ested that Mr. Lohen and
M1lr. Ila91e get together to see how the rlg ht, of way issue could be resolved.
Motion by Mr. Haynie, s cond ed by M1ir. Thomps en, to continue the Variance request
by Ultimate Motors until such time as the right of way i solved end
at that time to bring the request back to the LPA. 19oti onncarr ietl by a unanimous

4. Variance - Applicant: Dream Homes of Central Florida, Inc. Location: Vacant
lots on S si tle of Gh arch Ave. addressed as 226-228 E. Lhurch Ave. Request to
relocate an xisting dvpl ex with Cota1 livi n9 ar a of 1,444 sq. ft, without
alteration or addition to the duplex to meet theel , 600 sq. ft. li vi n9 area

There was disco ss ion regarding adding the add it ionai square footage of living
ea to bring the dwel linq up to code. tir. Reams s ated that would be a hardship
s he had not anticipated ha vi nq to do any additional construction and had a
pre-sold contract on the boil tli ng and would have to present an additional cost
to the potential buyer.
Mr. Haynie sta tetl he did not believe this dwell inq would be in con£l ict with
the rest of the neighborhood. 11r. Pope agreed.
Motion by Mr. Haynie, s tootled by Mr. Pope, to re ie nd to the Board of Adjust-
ment approval of the variance requested by OreamcHOmes to relocate an xis ti ng
duplex with a total living a a of 1,444 sq. ft. i~lpt ion ca ried by a three to
vote, wi tM1 Mr. Linton, Plre Haynie and Mr. Pope voting aye and Mr. Thompsen

Mr. Linton an nc ed that Mr. Naimlond had resigned from the LPA as he vas moving
to New Smyrnan6each. M1lr. Linton asked if the pep. L1 erk would write a letter
to Mr. Hammond thanking hiin for his service on the LPA.
Mr. Nagle stated there would be a Special Meeting of [he City Commission on Feb-
uary 29, 1998 and one of the items for discussion would be Dropos ed Ordinance
Ido. 839, the new landscape ordinance. Mr. Nagle encouraged [he LPA menbers
to attend the meeting if possible.
