Haynie. Al sO present was Mr. Lee, City Planner and Ned Julian Jr., Li ty Attorney. 7. The chairman called the meeting to order. Approval of minutes of September 28 regular meeting and October 5 work session. The minutes were approved as wrf tten. 2. Request of Marie Lekowi tz to change zoni nq of property located in Lake Gem Park from R-2 to R-M: Mrs. Le kowi tz was present represented by James Lormann. Mr. Lormann stated that Mrs. Lekowi tz pvrc has ed the property with the antlers to ndi ng that it was coned R-M and through the years it was re aned to R-2. Mr. Lormann further stated that this requested zoning change would not effect the character of the neighbor- hood because there are dvpl exec constructed alt around the property in question. 3. Mr. Julian re mmends that the Land Planning Agency request that council lift the moratorium on construction of duplexes. w 4. Motion by Mr; Leibens perger, second Eby Mr. Haynie that the request of Mrs. Lekowi tz be denied and that the Land Planning Agency request that city council lift the moratorium on construction of dupl exec in R-2 zoning so that Mr. Le kowi tz ca onstruct duplexes on the following described property: Lots 8 and 9,nLa ke Gem Park. Roll call vote: Leibens perger, Haynie, Nammon d: Yes. Ritter: No. Motion carried 3-1. 5. Mr. Julf an was present to an er questions of the Land Planning Agency regarding the Land Use Map. Mr. sJUlian statedthat there are two ncapts involved: the zo ing concept which is the use that a particular piece of property can havenf .e. R-1, R-2, R-3, etc., and the Comprehensive Land Plan ~~ihich is like an er7 ay or an outline as to where different types of uses are gof ng to be permitted in city. For example, in this Lomprehensi ve Land Plan you will say that in certain area you will allow residential u widen ti al u many forms. You then translate the general Cpl an into spec ifi cati on sec nnthe zoning map and say that in a certain ar si nql e-family residences will be allowed. Therefore, the zoning map becomes the translation of the plan into every day reality. Everything is controlled by the land Use Plan and everything derives its me ni ng from this plan. The zoning plan is subordinate to the Land Use Plan. Land Planning Agency Page 2 6. Mr. Julian further stated that the state statue says that all land development regulations shall be co si stmt with the adopted La ntl Use Plan or element or portion thereof and this m ns that no land can be used in the city in a fashion that is in istent with the plan.
