RESOLUTION NO. 04-1105
A RESOLUTION OF THE CITY COMMISSION OF
LONGWOOD, FLORIDA RELATING TO THE
MAINTENANCE OF THE BARRINGTON LOCAL
IMPROVEMENTS; CREATING THE BARRINGTON
MAINTENANCE ASSESSMENT AREA; IMPOSING
SPECIAL ASSESSMENTS AND ESTABLISHING THE
MAXIMUM ANNUAL AMOUNT FOR EACH TAX
PARCEL; APPROVING THE ASSESSMENT ROLL;
PROVIDING FOR COLLECTION OF THE ASSESSMENTS;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Longwood, Ftcrida Hbs "City
Commission") enacted Ordinance No. 01-1574 on June 18, 2001, as —dad and
supplemented by Ordinance No. 04-1701, aanacd bythe City Commission on July 19, 2004
(oollaetively, the "Ordivanc,") to provide forth, imposition ofspocial aesesemevta to farad
(I) the eonstmctlon of Local Improvements to benefit raal property located in Inca os.d
spacial sssessm,vl areas end (2) the oust of maintaining such Local Improvamevts; and
WItEREAS, on August 2, 2004, the City Commission adopted Resolution No. 04
1098 (the 'initial Assessment Resolution"), proposing the creation of the ➢arrington
Maintenance Assessment Area and describing She method of assessing the Maintenance Cost
ofthe Barrington Local lmpmvemeats(as defined therein) agaiast too real property that ll
be epui,liyb... filed it by, and directing prepaation ofthe ta.lative Assessment Roll and
the provision of the notices required by the Ordinance; and
WHEREAS, pursuant to the provisions of1ho Ordinance, the City Commission is
required n, confirm or repeal tha Initial Assessment u,aieton, with such amendments m the

interested parties; and
WHEREAS, the Assessment Roll has heretofore bee. filed at City Hall, as required
by the Initial Assessment Resolution; and
WHEREAS, as required bylhe terra ofthe Ordinan.eY notice ofapublic hearing has
been published and mailed to each real property owner proposed to be assessed notifying
such rest property owner of the opportunity to be heard; the proof of publication and an

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF LONGWOOD, FLORIDA, AS FOLLOWS:
SECTION 1. AUTHORITY. This Resolution is adopted pursuant to the
Ordinance, Chapter 166, Florida Statutes, and other applicable provisions of law.
SECTION 2. DEFINITIONS. This Resolution is the Final Assessment
R—hdion as defined in the Initial Assessment Resolution. All capitalized terms in this
Resolution shall have the meanings defived in the Ordinance avd the Ivifial Assessment
Resolution.
SECTION 3. CREATION OFTHE ASSESSMENT AREA. The Bamngton
Maintenance Assessment Area is hereby created to include the Tax Parcels described in
Appendix A hereto. The Barrington Maintenance Assessment Area is created forth, purpose
of enbancing the use and enjoyment of real property Iocated thereiv by funding the
Maintenance Cost of the Barrington Local Improvements.
SECTION d. CONFIRMATION OF INITIAL ASSESSMENT
RESOLUTION. The Initial Assessment Resolution is beraby confirmed.
SECTION 5. APPROVAL OF ASSESSMENT ROLL. The Assessment
Roll, a copy of,,bieh is attached hero[, as Appendix A, is hereby approved.
SECTION t. MAINTENANCE ASSESSMENTS.
(A) The Tax Parcels d—ibed in the Assessment Roll are hereby Ibnnd to ba
specially benefited by the Maiv[enanoa of[he Bamngnon Local Impmvamevts m the aznouvt
of the maximum anuuel Maintenance Assessment set forth in the Aasassmavt Roll. The
methodology for computing annual Maintenance Assessments described in Inc Initial
Assessment Resolution is hereby appm,ed. Annual Maintenance Assessme —roputed in
the manner described in lb.lnitisl Assessment Resolution are hereby Ivied and imposed on
all Tax Parcel, de,cdbed in the Ass crn Roll. Tex Parcels located in the Barrington
Maintenance Assessment Area shall have a maximum annual Maintenance Ass -rosin rate

2004.

SECTIONS. COLLECTIONOFMAINTENANCE ASSESSMENTS.The
Maintenance Assessments shall be collected pursuant to the Chiba= Assessment Collection
Act. Upon adeptiou of the Annual Assessment Resolution fer each Fiscal Yea, lbe
Assessment Coordivamr shall cause theoertificationand d li-q.f the Assessment RolI1a
the Tax Collector by September 15, in the ,,net prescribed by the Uniform Assessment
Collection Act. The Assessment Roll, as delivered to the Tax Colleeto, shall be
accompanied by a Certificate to Non -Ad Valorem Assessments is subittatia➢y the form
attached hereto m Appendix E.
SECTION 9. EFFECT OF FINAL ASSESSMENT RESOLUTION. The
adoption,ftbis Resolution shall be the final udjudieation ofthe issues presented herein and
in the Initial Assessment Resolution (including, but not limited to, the method by wMoh the
Maintenanoe Assessments will be computed, the Assessment Roll, the maximum annual
Maintenance Assessment and the levy and lien of the Maintenance Assessments) unless
proper steps are initiated in a court of,,mpet-j,b Fc io, to sm— reliefwitldn 20 days
from the date of City Commission action on this Resolution.
SECTION 10. ASSESSMENT NOTICE. The Assessment Coordimtot is
hereby directed to record this Resolution as notice of the Maintenance Assessments in the
Offroial R—d, Book in the office of the Seminole County Clark of Courts. Snch notioa
shall be in substantially the form attached as Appendix D hereto. The preliminary
Assessment Roll and enoh anmial Assessment Roll shall be retained by the Assessment
Coordinator and shall be available for public inspection.
SECTION 12. EFFECTIVE DATE. This Resolution shall take effect
fir—diatoly upon its adoption.
