RESOLUTION NO. 044106
A RESOLUTION OF THE CITY COMMISSION OF
LONGWOOD, FLORIDA RELATING TO THE
MAINTENANCE OF THE GOLDEN GROVE LOCAL
IMPROVEMENTS; CREATING THE GOLDEN GROVE
MAINTENANCE ASSESSMENT AREA; IMPOSING
SPECIAL ASSESSMENTS AND ESTABLISHING THE
MAXIMUM ANNUAL AMOUNT FOR EACH TAX
PARCEL; APPROVING THE ASSESSMENT ROLL;
PROVIDING FOR COLLECTION OF THE ASSESSMENTS;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Commission of dte City of Longwood Florida (the "City
Commission") enacted Ordinance No. 01-1574 on lone 18, 2001, as amended and
supplemeoted by Ordinance No.04-1701,enacted by the City Commissionon Poly 19,2004
(collectively, the "Ordinance") to provide for f e imposition ofspeoial ase.—e.6 to flood
(1) the eonstNction of Local Imp—e- to benefit rent property located in proposed
special assessment areas and (2) the cost of maintaining such Local Improvements; and
WHEREAS, on August 2, 2004, the City Commission adopted Rasolotien No. 0,L
1099 (the "Initial Assessment Rasolotion"), proposing the ereetion of the Golden Grove
Maintenaace Assessment Area and describing the method ofassessiag the Maintenance Cost
of the Golden Grave Local Improvements In defined therein) against the real property that
will be speeiallybenefited thereby, and directing preparation oftheteotative Assessment Rell
and the provision of the notices required by the Ordinance; and
WHEREAS, pursuant to the provisions of the Ordinance, the City Commission is
required to confirm or repeal the Initial Assessment Resolution, with such amendments as the
City Commission deems app,,pd,w, after hearing comments and receiving objections of all
interested parties; and
WHEREAS, the Assessment RIP has breed— been filed at City Hall, as required
by the Initial Assessment Remhom; and
WHEREAS, as required by the terms.fthe Ordi........ tic ofa public hearing has
been published and mailed to each real property owner proposed to be assessed notifying
such real property onmer of the opportunity to be heard; the proof of publication and an
affd-it of mailing me attached hereto as Appendices Band C respectively; and

interested persons have been heard and considered, required by the terms ofthe Ordinance.
NOW, THEREFORE., BE IT RESOLVED BY THE CITY COMMSSION OF
THE CITY OF LONGWOOD, FLORIDA, AS FOLLOWS:
SECTION 1. AUTHORITY. This Resolution is adopted pursuant to the
Ordinance, Chapter 166, Florida Statutes, and other applicable provisions of law.
SECTION 2. DEFINITIONS. This Res.l,dm is the Final Assessment
Resolution as defined in the Initial Assessment Resolution. All capitalized terms in this
Resolution shall have the meanings defined in the Ordinance and the Initial Assessment
R.solutioe.
SECTION 3. CREATION OF THE ASSESSMENT AREA. The Golden
Gmve Maintenance Assessment Area is hereby oceated to include the Tex Pmda described
in Appendix A beret,. The Golden Grove Maintenance Assessment Area is created for the
purpose of enhancing the ase and enjoyment of real property located therein by funding the
Maintenance Coat of the Golden Grove Local haprovements.
SECTION 4. CONFIRMATION OF INITIAL ASSESSMENT
RESOLUTION. The Initial Aeseesmant Rasolutiov is hereby confirmed
SECTION 5. APPROVAL OF ASSESSMENT ROLL. The Assesa-a
Roll, a copy of which is attached homm as Appendix A., is hereby approved.
SECTION 6. MAINTENANCE ASSESSMENTS.
(A) The Tax Parcels described in tho Assessment Roll are hereby found to ba
specially benefited by the Maimm.anee of Ne Golden Grove Local Impmvemeats in Ibe
amount of the maximum annual Maivt.—Assessment set forth in the Assessment Roll.
The methodology for computing annual Maintenance Assessments described in the Initial
Assessment Resolution is hereby approved. Annual Maintenance Assessments computed in
the manner described is the Initial Assessment Resolution axe hereby laviad and imposed on
all Tax Parcels described in the Aeseesmant Roll. Tax Pemals located in the Golden Grove
Maintenance Assessment Area shall have amaximvm annual Maintevavoe Assessmeatrate
of 5108.10 par Platted Lot, commencing with the tax bill mailed in October ar November
2004.

SECTION 8. COLLECTION OF MAINTENANCE ASSESSMENTS. The
Maintenance Aasesameats shall la—Heeted pursuant to the Uniform Assessment Collection
Act Upon adoption of the Annual Assessment Resolution for each Fiscal Year, the
Asee aa- Coordinatorshalleaaw theoertifi,atmaand delivaryofthe Assessment Roll to
the Tax Collector by September 15, iv the manner preacnbed by the Uniform Assessment
Collection Act. The A.ssossmeat Roll, as delivered to the Tax Collector, she➢ be
accompanied by a Certificate to Non -Ad Valorem Assessments m substantially the form
attached hereto as Appendix E.
SECTION 9. EFFECT OF FINAL ASSESSMENT RESOLUTION.The
adoption of this Resolution shall be the final adjudication fthe issues presented herein and
in the lnitial Assessment Resolution (including, but not limited to, the method bywhich the
Maintenance Assessments will be competed, the Assessment Roll, the maximum annual
Maintenance Assessment and the levy cad lieu of the Maintenance Assessments) unless
prop,, steps are initiated in a court of—p,waO,mdi,f,, ba secure relief within 20 days
from the date of City Commission action on this Resolution.
SECTION 10. ASSESSMENT NOTICE. The Assessment Coordinator is
hereby directed to record this Resolution as notice of the Maintenance Assessments in the
Official Records Book inthe office of the Seminole Ceonty Clerkof CmM. Sach,,tice
shall be it, substantially the form attached as Appendix D hereto. The preliminary
Assessment Roll and each annual Assessment R,11 shall be retained by the Assessment
Coordinator and shall be available for publio inspection.
SECTION 12. EFFECTIVE DATE. This Resolution shall take offt

On August 30, 2004, the City Commission of the City of Longwood, Florida, adopted
Resolution No. 04-1106, which imposed special assessments against real property located
within the Golden Grove Malntenaoce Assessment Ares, which includes the real property

umbers and real property owners (as shown on the Seminole County ad valorem tax
