Resolution 02-1054RESOLUTION NO. 02-1054 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LONGWOOD, FLORIDA, RELATING TO THE CONSTRUCTION OF ROAD LMPROVEMENTS; CREATNG THE GEORGIA AVENUEILAKEVIEW DRIVE ROAD PAVING ASSESSMENT AREA: AMENDING AND CONFIRMING THE INITIAL ASSESSMENT RESOLUTION; ESTABLISHING THE MAXIMUM AMOUNT OF THE ANNUAL ASSESSMENT PER FRONT FOOT; IMPOSING ASSESSMENTS AGAINST PROPERTY WITHIN THE ASSESSMENT' AREA; APPROVING THE ASSESSMENT ROLL; PROVIDING FOR COLLECTION OF THE ASSESSMENTS; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Commission (the "City Commission") of the City of Longwood Florida, enacted Ordinance No01-I574 on Jun, 18, 2001 (the "Ordinance"), to provide for the creation of assessment areas and authorize the imposition of ,p,d,l assessments to fund the cona —,00 of Io,al improvements I. eerve the property located therein; and WHEREAS,,, Juno 3, 2002, the City Commission adopted Resolution -No. 02-1047, the Initial Assessment Resolution, proposing creation,fthe Georgia AvenueT keview Drive Road Paving Assessment Aria and describing the method of assessing the cost of Road Improvements (as therein def ned) against L, real property that will be specially beneftRd thereby, and directing preparation of the tentative Assessment Rull and pmvisinn of the —fi— required by the Ordinance, and WHEREAS, pursuant to the provisions of the Ordinance, the City is required to confirm or repeal the Initial Assessment Resolutioo, with such amendments as the City Cornnusnion deems appropriate, she, hearing comments end receiving objections of all interested parties; and WHEREAS, the Assessment Roll has heretofore been filed at City Hall as required by the lorded Assessment Resolution and die Ordinance; and W HEREAS, m required by the terms ofthc Ordinance, notice ofa public hearioghas been published and mailed to each property owner proposed to be assessed notifying such pmperty owner ofthe opportunity to be heard; the proof of publication said an affidavit of mailing are attached hereto as Appendices A and B respectively, aad WHEREAS, a public hearing has been duly held and comments said objmfiom ofall interested persons have been heard and coruiderod as required by the tenors fthe Ordinance, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CTY OF LONGWOOD, FLORIDA, AS FOLLOWS: SECTION (.AUTHORITY. This Resolution is adopted pursuant to the Ordinance, Chapter 166, Florida Statutes, and other applicable provisions of law. SECTION Z.DEFI NITIONS. This Resoluton is the Final A sessment Resolution as defined in the Ordinance. All capitalized terms in this Resolution shall have the meanings defined in the Ordinance and the Initial Assessment Rosolution. SECTION 3.CREATION OF ASSESSMENT AREA. The Georgia Avenoe/Lakeview Drive Road Paving Assessment Area is I by created to include the Tax Parcels described in Appendix E attached h—t, The A sass ,- Area is created fnr We purpose of improving the use end enjoyment of property located therein by f-dlag the construction of Road hnprovements to benefitproperty lo—d within the Assessment Area SECTION 4.AMENDMENTTO THE INITIAL ASSESSMENT RESOLUTION. Section 1.03(f) of the Initial Assessment Resolution is hereby rem—bercd es Section L03(U) sad a new Settion 1.03(T) is added as follows: "(T) In the past, the City has vacated certain low-Iying property around Lake W ayman. Since in most cases, this property forms as additional, unbuildable lot adjacent to the ownets existing lot, the City has decided to forego r,imbursentem for the costs associated with paving the roadway adjacent to such lots unless the lot is otherwise buildable. If the lot is otherwtse buildable, then the City will include Such Frontage and require reimbursement b— the property owner." SECTION S.CONFIRMATION OF INITIAL, ASSESSMENT RESOLUTION. The Initial AsseSsment Resolution, as amended in Section 4 bercof, b hereby confirmed. SECTION 6.APPROVAL OF ASSESSMENT ROLL. The Assessment Roll, a copy of which is attached hereto as Appendix E, is hereby approved. SECTION 7.ASSESSMENTS. (A) The Tax ParecN described in the Assessment Roll are hereby found to be specialty benehned by construction of the Road Improvement, in the vnoun[ of the maximum mmual Assessment set forth in the Asse&sment Roll. The methodology tof computing anneal Assessments described in the Initial Assessment Resolution is hereby approved. Annual Assessments computed in the manner described in the Initial Assessment Resolution arc hereby levied and imposed on it rC Parcels described in the Assessmerrt Roll at either. (I) a maxunum amount of 5100.00, with respect to Tax Parcels (P.I.D. 3220305130M0001 I and P.I.D. 32203051301,000230), which haveeach requested the City to comtnet a driveway as part of the Road Improvements and are paying for rhesegtegated costs associated with such improvements; or (2) with respect to all other Tax Parcels, a maximum ammal mte of $25.00 per front fi-, in each case for a period of f Reen yews, commencing with the ad valorem tax bill to be mailed io October or November 2001 (B) Upon adoption ofthe Annual Assessmen[ Resolution for each Fiscal Year, the Assessments shall constitute a lien against assessed property equal in rank and dignity with the liens of ah state, county, district or municipal taxes and other non -ad valorem assessments. Except as otherwise provided by law, such lien shall be superior in dignity to all of hu liens, fides and claims, until paid. The lien shall be deemed peifectod upon adoption by the City Commission of the Amhual Assessmont Resolution and shall attach to the property included on the Asse--o Roll as of the prior January 1, the lien date for ad valor SECTION &COLLECTION OF ASSESSMENTS. The Assessments shall be collected pnrsuant[o the Uniform Assessment Collection Act. Uponadoptionofthe Annual Assessment Resolution for each Fiscal Year, the Assessment Coordinator shall cerise the cettifi-ion and delivery of the Assessment Roll —he Collector by September 15, in the mmmer prescribed by the Uniform Assessment Collection Act. 'fhe Assessment Roll, as delivered to the Tax Collecor, shall be accompanied by e Certificate to Non -Ad Valorem Assessment Roll in substantially the form —hod hereto as Appendix F. SECTION 9.EFFECT OF FINAL ASSESSMENT RESOLUTION.
